EXECUTIVE SESSION
A Regular Meeting of the City Council was held in the Council Chamber on
Thursday, December 7, 2006 at 7.00 P.M. for the purpose of transacting any and all
business, at which time, the City Council, by recorded roll call vote, went into Executive
Session with the City of Salem Legal Department, to discuss a matter of pending
litigation. Notice of this meeting was posted on November 30, 2006 at 5.37 P.M.
All Councillors were present.
Council President Jean M. Pelletier presided.
Council President Pelletier then called upon Attorney Elizabeth Rennard, City
Solicitor, to address the Council.
Solicitor Rennard stated in 2004 the Fire Chief retired. At that time Civil Service
List Collective Bargaining — vacancy provided out of grade. (Glenn Beaudet and Chief
Cody) Administration didn't do second part of test assessment not valid list. Met with the
union under civil service rule it was a valid list.
Arbitrator entered into agreement to settle case to grant the two the out of grade. Cost
$7,281.26 total each would get $3,500. It is my opinion to settle instead of going
forward. It could cost more.
Councillor Pelletier asked where the money is coming from.
Solicitor Rennard said an appropriation.
Councillor O'Keefe asked can he participate?
Solicitor Rennard responded yes.
Councillor O'Leary moved approval.
Approval was adopted by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.
Councillor O'Leary moved immediate reconsideration in the hopes it would not prevail.
Reconsideration was denied.
On the motion of Councillor O'Leary, the Executive Session adjourned, and the
regular meeting continued by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.
