NOVEMBER 18, 2004
EXECUTIVE SESSION
A Regular Meeting of the City Council was held in the Council Chamber
on Thursday, November 18, 2004 at 7.00 P.M. for the purpose of transacting any
and all business, at which time, the City Council, by recorded roll call vote, went
into Executive Session with Attorney Kevin Daly and Human Resource Director
William O'Neill to discuss a potential workmen's compensation settlement.
Notice of this meeting was posted on November 12, 2004 at 11.02 A.M.
Councillor Furey arrived late at 7.10 P.M.
President Leonard F. O'Leary presided.
President O'Leary turned the Executive Session over to Attorney Daley to
address the Council regarding the matter.
Attorney Daley stated that Mrs. Rita Peters owes the City money. In 1991 she got
hurt and filed for benefits. In 1998 she was awarded retroactive benefits for 7
years. The City doesn't have to pay interest. She owed $31,000.00 plus interest.
Attorney Daley stated he went after her for what she owed the city. Three years
and one month ago the judge got fired. The new judge said we would have to
settle or start the case over. We suggested that a $20,000.00 mortgage on
house. The daughter will sign off. If we try the case again we could lose and also
loose the fees for trying the case. A title search will be done.
Assistant Solicitor Beth Rennard who was also present stated that she was a
witness at the trial. Mrs. Peters has no assets.
Councillor Veno motion to approve. Councillor Bencal second it. All were in favor.
It was so voted.
C. O'Keefe moved for immediate reconsideration in the hopes it would not
prevail. Reconsideration was denied.
On the motion of Councillor Veno the Executive Session was adjourned by
unanimous roll call vote of 11 yeas, 0 nays, 0 absent.
