EMERGENCY MEETING OF THE CITY COUNCIL
An Emergency Meeting of the City Council was held in the Council
Chamber on Wednesday, September 4, 2002 at 6.00 P.M. for the purpose of
confirming a declaration of emergency to repair water lines on Charles Street,
and authorize the Director of Public Services to expend the necessary funds.
This emergency affects the health, safety, and welfare of the citizens of the City
of Salem. Notice of this meeting was posted on September 4, 2002 at 12.06
P.M.
Councillors O'Keefe and Harvey were absent. Councillor DeToma arrived
at 6.15 P.M.
Council President Regina R. Flynn presided.
Mr. Stanley I. Bornstein, Director of Public Services, addressed the
Council and explained the situation on Charles Street.
Councillor Driscoll left the Council Chamber due to a conflict of interest.
Councillor O'Leary moved to confirm the declaration of emergency to
repair the water lines on Charles Street. It was so voted by a roll call vote of 7
yeas, 0 nays, 4 absent. Councillors Bencal, Chuber, Furey, Lovely, O'Leary,
Sargent, and Flynn were recorded as voting in the affirmative. Councillors
DeToma, Driscoll, Harvey, and O'Keefe were absent.
Councillor O'Leary moved for immediate reconsideration in the hopes it
would not prevail. Reconsideration was denied.
Councilor O'Leary moved that the Director of Public Services solicit a third
bid. The motion was defeated by a roll call vote of 4 yeas, 4 nays, 3 absent.
Councillors Lovely, O'Leary, Sargent, and Flynn were recorded as voting in the
affirmative. Councillors Bencal, Chuber, DeToma, and Furey were recorded as
voting in the negative. Councillors Driscoll, Harvey, and O'Keefe were absent.
Councillor Bencal moved for immediate reconsideration in the hopes it
would not prevail. Reconsideration was denied.
Councillor Bencal moved to authorize the Director Public Services to
expend up to $83,500.00 to repair the water lines. It was so voted by a roll call
vote of 8 yeas, 0 nays, 3 absent. Councillors Bencal, Chuber, DeToma, Furey,
Lovely, O'Leary, Sargent, and Flynn were recorded as voting in the affirmative.
Councillors Driscoll, Harvey, and O'Keefe were absent.

Councillor Chuber moved for immediate reconsideration in the hopes it
would not prevail. Reconsideration was denied.
Councillor Bencal moved to authorize the expenditure of up to $50,000.00
for curb to cub repaving of Charles Street upon completion of the water project.
It was so voted.
On the motion of Councillor O'Leary, the meeting adjourned at 6.50 P.M.
