MINUTES - Executive - 6/26/2003 210 CITY OF SALEM JUNE 26, 2003 EXECUTIVE SESSION A Regular Meeting of the City Council was held in the Council Chamber on Thursday, June 26, 2003 at 7:00 P.M. for the purpose of transacting any and all business, at which time, the City Council, be recorded roll call vote, went into Executive Session with the City of Salem Legal Department,to discuss an update on a Property Tax Valuation and Special Education Litigation settlement. Notice of this meeting was posted on June 20, 2003 at 8:45 A.M. Councillor Furey was recorded as absent. Council President Leonard F. O'Leary presided. Councillor President O'Leary then called upon Solicitor John Keenan to address the Council regarding the special education settlement. Solicitor Keenan stated that this is in regards to Alex Worth a special ed. Child at Horace Mann has autism. The problems are with teachers and staffing. We settled. The Attorney wants attorney fees and I whittled it down to $8,250.00. I'm recording settlement received. Councillor O'Keefe made a motion that the school pay. The motion was withdrawn. Councillor Lovely moved approval of$8,250.00 for settlement. It was adopted by a roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Sargent, O'Leary, O'Keefe, Lovely, Harvey, Flynn, Driscoll, DeToma, Chuber and Bencal were recorded as voting in the affirmative. Councillor Furey was recorded as absent. Councillor Harvey moved immediate reconsideration in the hopes it would not prevail. Reconsideration was denied. Councillor President O'Leary then called upon Solicitor John Keenan to address the Council regarding the Power Plant issue. Councillor Sargent left due to conflict of interest. Solicitor Keenan stated that we have reached an agreement on the cleanup. That's been holding up the tax agreement. The agreement as it stands in excess of 4.5 million dollars which is the ceiling. The plant will be cleaned up. It will be in compliance in 2005. The company is in 3 billion dollars in default. On the motion of Councillor Flynn the Executive Session adjourned, and the regular meeting continued by roll call vote of 9 yeas, 0 nays, 2 absent.
