REGULAR MEETING OF THE CITY COUNCIL
A Regular Meeting of the City Council was held in the Council Chamber on
Thursday, May 24, 2001 at 7.00 P.M. for the purpose of transacting any and all
business. Notice of this meeting was posted on May 18, 2001 at 8.33 A.M.
All Councillors were present.
Council President Joan B. Lovely presided.
Councillor Hayes moved to dispense with the reading of the record of the
previous meeting. It was so voted.
President Lovely requested that everyone please rise to recite the Pledge of
Allegiance.
#356 -APPT. EDWARD A. CURTIN TO SCHOLARSHIP & EDUCATION
COMMITTEE
The Mayor's appointment of Edward A. Curtin to serve as a member of the
Scholarship & Education Committee for a term to expire August 31, 2002, was
confirmed under suspension of the rules by a roll call vote of 10 yeas, 0 nays, 1
absent. Councillors Sargent, O'Keefe, LaCava, Hayes, Harvey, Furey, Flynn, Driscoll,
DeToma, and Lovely were recorded as voting in the affirmative. Councillor O'Leary
was absent.
Councillor Furey moved that a letter and City Seal be sent to Mr. Al Viselli. It
was so voted.
#357 - REAPPT. FRANK KULIK AS DIRECTOR OF ASSESSING
The Mayor's reappointment of Frank Kulik as Director of Assessing for a term
to expire the first Monday in May, 2002, was confirmed by a roll call vote of 10 yeas, 0
nays, 1 absent. Councillors Sargent, O'Keefe, LaCava, Hayes, Harvey, Furey, Flynn,
Driscoll, DeToma, and Lovely were recorded as voting in the affirmative. Councillor
O'Leary was absent.
Councillor Harvey requested and received unanimous consent to suspend the
rules to allow Mr. Kulik to speak.
#358 - TRANS. PARKING DEPARTMENT ELECTRICITY
The following Order, recommended by the Mayor, was referred to the
Committee on Administration and Finance.

Ordered: That the sum of Fifteen Thousand Dollars ($15,000.00) is hereby
transferred from the "Parking Department - Salaries - part-time" Account to the

His Honor the Mayor.
#359 - TRANS. PARKING DEPARTMENT OTHER EXPENSES
The following Order, recommended by the Mayor, was referred to the
Committee on Administration and Finance.
Ordered: That the sum of Ten Thousand Dollars ($10,000.00) is hereby
transferred from the "Parking Department - Salaries - full-time" Account to the
"Parking Department - Other Expenses" Account in accordance with the
recommendation of His Honor the Mayor.
#360 - MAYOR'S LETTER REGARDING COUNCIL'S CONCERNS OF SALEM HIGH
SCHOOL RENOVATION PROJECT.
The following Letter was received from the Mayor. The communication was
received and filed.
To the City Council
City Hall
Salem, Massachusetts
Ladies and Gentlemen of the Council:
I am writing in response to your concerns regarding the City's ability to fund the
potential additional interest costs for the High School Renovation Project.
You may have already heard Superintendent Levine has been informed by the State
Education Board that the reimbursement rate for Salem High School has been
increased from 78% to 90%. It is very likely with this 90% reimbursement formula, we
will now get priority one funding status. However, we must apply for that status and
will not receive confirmation until a later time.
In the meantime, I am writing to respond to your concerns regarding "lag time" or
potential additional interest costs. While I would prefer the flexibility of funding the
potential additional interest costs directly in the City's FY 06-07 Operating Budget, I
will, however, commit $250,000-$350,000 from the next 6 years' Medicaid
Reimbursement to be transferred to a Special Revenue-Debt Service Fund (schedule

attached). These funds will be for the express purpose of offsetting the potential
additional interest costs which may occur in the event of a delay in state
reimbursement for this project. I am confident that this action will address your
concerns and limit any financial impact on future City Operating Budgets.
I am committed to fulfilling the City's School Building Program and appreciate the
support the City Council has shown in rebuilding the City's schools. I look forward to
working with you to see this important project through to fruition.

#360A - RESOLUTION SUPPORTING DEDICATION OF MEDICAID
REIMBURSEMENT FOR SPECIAL REVENUE DEBT SERVICE FUND.
The following Resolution was received from the Mayor. The resolution was
received and filed.
Resolution
Whereas, the Salem City Council has been consistently supportive of the renovation
and building projects of the Salem Public Schools and the Salem School Committee
wishes to acknowledge their support;
Whereas, the Salem City Council has already authorized the renovation of the Salem
High School for $24.7 million at 65% reimbursement from the state;
Whereas, the Massachusetts Department of Education School Building Assistance
Board has indicated that the DOE sets great importance on the full renovation of the

Salem High School and has made a commitment to Salem to fund a renovation project
of$37.5 million with 90% reimbursement, should Salem remove the high school
project from the current project list and reapply for funding;
And whereas, Salem would achieve significant savings over the period of the bond
with higher reimbursement;
And whereas, Salem cannot know the schedule of reimbursement payments unless
application is made to the state by June 1, 2001;
And City Councillors wish to be assured of the fiscal feasibility of such reapplication
should there be a delay of reimbursements following completion of the renovation;
Therefore be it resolved: That in recognition of our shared responsibilities, the
Salem School Committee supports the Mayor's decision to dedicate $250,000 per
year from Medicaid Reimbursements to a Special Revenue - Debt Service Fund to
offset any increase in short term interest due to the high school renovation project;
and that the Salem School Committee respectfully requests that the Salem City
Council authorize a new bond limit of$37.5 million for the Salem High School
renovation project at the next meeting on Thursday, May 24, 2001, so that an
amended application may be made to the state by June 1, 2001.
#361 - ORDER REFERRING THE SALEM GLASS CO. PROJECT TO THE
MASSACHUSETTS DEVELOPMENT FINANCE AGENCY
The following Order, recommended by the Mayor, was adopted by a roll call
vote of 10 yeas, 0 nays, 1 absent. Councillors Sargent, O'Keefe, LaCava, Hayes,
Harvey, Furey, Flynn, Driscoll, DeToma, and Lovely were recorded as voting in the
affirmative. Councillor O'Leary was absent.
AN ORDER REFERRING A PROJECT IN THE CITY OF SALEM TO THE
MASSACHUSETTS DEVELOPMENT FINANCE AGENCY
WHEREAS, the Massachusetts Development Finance Agency (the "Agency") has
received an inquiry from The Salem Glass Co. and Saluki Realty, LLC (collectively,
the "Sponsor", which term includes any parent, subsidiary or related affiliated entity)
as a potential Sponsor of a project to be financed by the Agency and to consist of
certain industrial development facilities (the "Project") to be located in the City of
Salem, Massachusetts, the Project being generally described as follows: (I) the
acquisition of approximately 4.5 acres of land located on Technology Way in Salem;
(ii) the construction of a building thereon containing approximately 48,000 square feet;
(iii) the acquisition and installation of machinery and equipment for said building; (iv)

site improvements; and (v) costs related thereto, all to be used by the Sponsor in
connection with its business as a manufacturer of aluminum and glass windows,
doors, frames and related products, all as more fully described in the Sponsor's
application for tax-exempt financing dated January 25, 2001;
WHEREAS, the Agency has notified the City in writing of such inquiry by the Sponsor,
in compliance with Section 8(a) of Chapter 23G of the Massachusetts General Laws,
as amended; and
NOW, THEREFORE, BE IT ORDERED that the City Council acting in the name and
behalf of the city of Salem, Massachusetts, hereby requires the Agency assume the
role of an industrial development financing authority in financing the Project, as
authorized by Section 8(a) of Chapter 23G of the Massachusetts General Laws, as
amended.
#362 - DECLARE SURPLUS TWO BUSSES AND THE COUNCIL ON AGING VAN,
AND AUTHORIZE PURCHASING AGENT TO DISPOSE OF SURPLUS
The following Order, recommended by the Mayor, was adopted.
ORDERED: That three city-owned vehicles, two busses and one van formerly
used by the Council on Aging, are hereby declared surplus city property;
and be it further ORDERED: that the Purchasing Agent, in accordance with the
provisions of M.G.L. Chapter 30B Section 15, is hereby authorized to dispose of said
surplus vehicles by public request for bids.
#363 - MAYOR SUBMITTING ANNUAL BUDGET FOR FISCAL YEAR 2002
A communication was received from the Mayor, after the deadline of Tuesday
Noon, submitting the fiscal year 2002 Operating Budget and the Fiscal year 2002
Enterprise Funds Operating Budget.
Councillor Driscoll requested and received unanimous consent to suspend the
rules to allow the matter to come before the Council.
Councillor Driscoll moved that the matter be referred to the Committee on
Administration and Finance under the rules. It was so voted.
#364 - MAYOR SUBMITTING AMENDMENT TO FISCAL YEAR 2002 OPERATING
BUDGET FOR THE CITY CLERK'S ELECTIONS DEPARTMENT BUDGET

A communication was received from the Mayor, after the deadline of Tuesday
Noon, submitting the following amendment to the fiscal year 2002 Operating Budget.
Councillor Driscoll requested and received unanimous consent to suspend the
rules to allow the matter to come before the Council.
Councillor Driscoll moved that the matter be accepted and referred to the
Committee on Administration and Finance under the rules. It was so voted.

Councillor Flynn introduced the following Order, which was adopted.
ORDERED: That the Committee on Ordinances, Licenses and Legal Affairs
investigate the development of a citation that the Licensing Board or their department
designee can issue to people/businesses on violations of Salem Ordinances and
licenses.

Councillor Lovely introduced the following Order, which was adopted.

#368 - ORDINANCE, TRAFFIC, HANDICAP PARKING, CLOUTMAN STREET
Councillor Lovely introduced the following Ordinance, which was adopted for
first passage.

An Ordinance to amend an Ordinance relative to Traffic, Handicap Parking
Be it ordained by the City Council of the City of Salem, as follows:
Section 1. Chapter 42, Section 50B, is hereby amended by adding the following:
"In front of#15 Cloutman Street for a distance of twenty (20) feet." "Handicap
Parking Tow Zone."
Section 2. This Ordinance shall take effect as provided by City Charter.

Councillor Driscoll offered the following report for the Committee on
Administration and Finance. It was voted to accept the report and adopt the
recommendation.

appropriation of$$35,000.00 from Free Cash to Human Resources Unemployment
Compensation has considered said matter and would recommend approval.
NEIGHBORHOOD ASSOCIATIONS AND RELATED ISSUES
Councillor Flynn gave an oral report for the Committee on Government
Services relating to the recent meetings to discuss neighborhood issues. She stated
that information will soon be forwarded to all City Councillors.
(#193) - BOND ORDER -APPR. $12,850,000.00 FOR ADDITIONAL COSTS AT
SALEM HIGH SCHOOL
Councillor Driscoll moved to take from the table the Bond Order of
$12,850,000.00 for Salem High School Renovations. It was so voted.
Councillor Driscoll requested and received unanimous consent to suspend the
rules to allow Mayor Usovicz to address the Council.

Councillor Flynn assumed the Chair for President Lovely
Councillor Driscoll moved adoption of the Bond Order for first passage. First
passage was adopted by a unanimous roll call vote of 11 yeas, 0 nays, 0 absent.
Councillor Driscoll moved for immediate reconsideration in the hopes it would
not prevail. Reconsideration was denied.
Councillor Driscoll moved that the City Council adopt the following emergency
preamble.
"That the City Council hereby declares the following Order regarding the bond
issue for repairs to the Salem High School an emergency involving the health, safety
and welfare of all the students, faculty, administration and guests attending and
visiting Salem High School. Specially, said emergency involves the complete repair
and elimination of extensive water penetration through the walls, ceilings, windows
and roof, as well as complete repair of electrical, plumbing, and HVAC systems. As
an emergency, said order shall be allowed to pass finally (first and second passage)
at this meeting.
The emergency preamble was adopted by a unanimous roll call vote of 11
yeas, 0 nays, 0 absent.
Councillor Driscoll moved to immediate reconsideration in the hopes it would
not prevail. Reconsideration was denied.
Councillor Driscoll moved that the Bond Order be adopted for second and final
passage under the provisions of Massachusetts General Laws, Chapter 43, Sections
20 and 22, and Sections 20 and 22 of the City of Salem Charter.
The Bond Order was adopted for second and final passage by unanimous roll
call vote of 11 yeas, 0 nays, 0 absent.
Councillor Harvey moved for immediate reconsideration in the hopes it would
not prevail. Reconsideration was denied.
Councillor Harvey moved for a two-minute recess.
#375 - REDISTRICTING OF WARD AND PRECINCTS - ORDINANCE EFFECTIVE IN
2002 STATE ELECTION YEAR

Councillor Flynn assumed the Chair for President Lovely.
President Lovely offered the following report for the Ad-Hoc Committee on
Redistricting. It was voted to accept the report.
The Ad-Hoc committee on Redistricting to whom was referred the matter of
redistricting the Ward and Precinct boundaries in the City of Salem, under the
provisions of Chapter 54, Sections 1 and 2, due to the results of the census 2000, has
considered said matter and would recommend that the attached Ordinance, redrawing
the ward and precinct lines in the City of Salem, effective in the State Election Year
2002, be adopted for first passage.
Councillor O'Leary moved to waive the reading of the lengthy Ordinance. It
was so voted.
Councillor O'Leary moved that the Ordinance be adopted for first passage. It
was so voted by a roll call vote of 9 yeas, 0 nays, 2 absent. Councillors Sargent,
O'Leary, O'Keefe, Hayes, Furey, Flynn, Driscoll, DeToma, and Lovely were recorded
as voting in the affirmative. Councillors LaCava and Harvey were absent.
Councillor O'Leary moved for immediate reconsideration in the hopes it would

imposed under the provisions of Chapter 54, Section 1, that the matter be declared an
emergency by roll call vote. It was so voted by a roll call vote of 9 yeas, 0 nays, 2
absent. Councillors Sargent, O'Leary, O'Keefe, Hayes, Furey, Flynn, Driscoll,
DeToma, and Lovely were recorded as voting in the affirmative. Councillors LaCava
and Harvey were absent.

An Ordinance to amend an Ordinance relative to the description of Ward and Precinct
Boundaries in the City of Salem
Be it ordained by the City Council of the City of Salem, as follows:
Section 1. Chapter 2, Article I, Section 2-8 of the City of Salem Code of Ordinances,
is hereby amended by deleting this section in its entirety, and inserting inplace
thereof, the following:
Section. 2-8.Description of ward boundaries.
The division of the city into seven (7) wards shall be established, known, bounded,
and described as follows:
Ward 1. Beginning at the intersection of the centerlines of Salem Green and Church
Street; thence running easterly by the centerline of Church Street to the centerline of
St. Peter Street; thence running southerly by the centerline of St. Peter Street to the
centerline of Brown Street; thence running easterly by the centerline of Brown Street
to the centerline of New Liberty Street; thence running southerly by the centerline of
New Liberty Street to the centerline of Essex Street; thence running easterly and

RESOLUTION:
Whereas, the City will be receiving grant funds for the Salem High School Project
from the Commonwealth of Massachusetts School Building Assistance Program, at a
minimum reimbursement rate of seventy-eight (78) percent and most likely at a rate of
ninety (90) percent;
Whereas, the Mayor, School Committee, and School Superintendent have expressed
to the Council that reimbursement for the Salem High School Project, if approved as a
Category I Project, shall commence immediately following completion of renovations
to the Salem High School Project or sooner,
Now Therefore Be It Resolved:
That the City Council hereby acknowledges and supports the Mayor's agreement to
set aside $250,000.00 per year from Medicaid Reimbursements to off-set Salem High
School Project expenses;
The City Council hereby acknowledges the Mayor's offer to rescind the bond order for
the High School Project if state reimbursement is less than 78% or if the High School
Project does not obtain category I status by SBAB.
