Neighbors again allege occupants of the property have been disturbing their peace with large early morning parties. I have been informed our police department has responded to several calls for disturbances in the last two weeks. The Salem Building and Fire Departments have made recent inspections and I am told the property is in the process of being sold again. I characterize this property as"Animal House II", Please FAX(978-744-9353)me copies of any police responses to this property since April 1, 2001. Could you suggest an appropriate course of action whereby increased cruiser patrol of this area may temper alleged occupant disturbances? I now plan to ask Salem City Solicitor John D. Appendix II (14) Legal Remedies for Tenants of Residential Housing The following is a brief summary of some of the legal remedies tenants may use in order to get housing code violations corrected : 1. Rent Withholding(Massachusetts General Laws, Chapter 239, section 8A): If Code Violations Are Not Being Corrected you may be entitled to hold back your rent payments. You can do this without being evicted if: You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger or materially impair your health of safety and that your landlord knew about the violations before you were behind in your rent. You did not cause the violations and they can be repaired while you continue to live in the building. You are prepared to pay any portion of the rent into court if a judge orders you to pay it. ( For this, it is best to put the rent money aside in a safe place) 2. Repair and Deduct(Massachusetts General Laws, Chapter III, section 127L): The law sometimes allows you to use your rent money to make the repairs yourself. If your local code enforcement agency certifies that there are code violations which may endanger or materially impair your health, safety, or well-being, and your landlord has received written notice of the violations, you may be able to use this remedy. If the owner fails to begin necessary repairs(or to enter into a written contract to have them made)within five days after the notice or to complete repairs within 14 days after notice, you can use up to four months rent in any year to make repairs. 3. Retaliatory Rent Increases or Evictions Prohibited (Massachusetts General Laws, Chapter 186, section 18, and Chapter 239, Section 2A): The owner may not increase your rent or evict you in retaliation for making a complaint to your local code enforcement agency about code violations. If the owner raises your rent to try to evict within six months after you have made the complaint, he or she will have to show a good reason for the increase or,eviction which is unrelated to your complaint. You may be able to sue the landlord for damages or if he or she tries this. 4. Rent Receivership (Massachusetts General Laws Chapter II, section 127 C-H): The occupants and/or the Board of Health may petition the District or Superior Court to allow rent to be paid into court rather than to the owner. The court may then appoint a"receiver" who may spend as much of the rent money as is needed to correct the violation. The receiver is not subject to a spending limitation of four months'rent. 5. Breach of Warranty of Habitability: You may be entitled to sue your landlord to have all or some of your rent returned if your dwelling unit does not meet minimum standards of habitability. 6. Unfair & Deceptive Practices (Massachusetts General Laws, Chapter 93A) : Renting an apartment with code violations is a violation of the consumer protection act and regulations, for which you may sue an owner. The information presented above is only a summary of the law. Before you decide to withhold rent or take any other legal action, it is advisable that you consult an attorney. If you can not afford to consult an attorney, you should contact the nearest legal services office, which is Neighborhood Legal Services 37 Friend Street Lynn, MA. 01902 (781)-599-7730 CITY OF SALEM HEALTH DEPARTMENT Nine North Street Salem, Massachusetts 01970 Page of -3 Dater Name: C7rlii i/ Address: Specified Time Reg.#410.. During a hearing before Ms. Joanne Scott, the Health Agent for the City of Salem's Department of Health, Ms. Hiraldo met with your representative, Mr. Nick Sabino, and set a schedule for fixing those items identified in the attached report. During this meeting, Mr. Sabino agreed that the tenants would provide access to the premises on Friday and Saturday, June 22nd and 23`d, respectively so that the Landlord could address the deficiencies identified in the attached report. However, on June 23`d, Ms. Hiraldo's workers were asked to leave the premises. Furthermore, Mr. Chad Merson advised the landlord that he planned to remove the mailboxes that were recently installed by the Landlord. Please be advised that your refusal to provide access to the leased premises is precluding the Landlord from repairing those items identified on the attached report. Ms. Hiraldo also finds Mr. Merson's action particularly disturbing in light of Mr. Sabino's representations during the hearing that Mr. Merson had already moved out of the apartment. It appears from an occupant's statement to the Board of Health that there are at least six unrelated tenants living in a single apartment there. As you know, we've been trying to address this issue especially in Councilor O'Keefe's Ward — largely due to college students. The Salem Zoning Ordinance allows for unrelated individuals to reside together "provided that a group of three 3 or more persons who are not within some degree of kinship shall not be deemed to constitute as family." Salem Zoning Ordinance Article II, Sec. 2-2(b). Thus, there should be no more than two unrelated living together. Please request that Mr. Pena rectify this or we will seek an application for a criminal complaint for violation of the Zoning Ordinance. As always, thank you for your assistance in this matter. The Salem Police Department has responded there to alleged disturbances of the peace incidents several times in the past two weeks. I have asked Salem Police Chief Robert St. Pierre to forward me copies of any recent police reports for this address. Salem Assistant Building Inspector Thomas St. Pierre this date advised me the property is being sold again. Attached is a un-datod affidavit from the prospective owner relative to his future use of this property. I am concerned about the existing occupancy of this building, which I characterize as "Animal House II". I understand there are three(3) existing apartments in this building, which is situated in an R-I residential district. You have determined the Salem Zoning Ordinance stipulates no more than two unrelated individuals may lease or reit an apartment or dwelling unit. If my am correct and each individual had a motor vehicle, there would be six(6)vehicles on the property. I counted twelve(12)vehicles in the parking lot at the property the weekend of Mayl2, 200 1. 1 believe the landlord is conducting a un-licensed rooming house operation at this address. The neighbors and myself are frustrated by the lack of action in resolving the issue of more than two unrelated individuals leasing or renting an apartment in this building. Please review this issue and commence legal action on behalf of City of Salem to evict more than two unrelated individuals from each apartment at this address. aspect "yh A.0' e,S Councillor W d Se 28 Surrey R SALEM MA 01970,4365 Home 978-744-1884 FAX 978-744-9353 P/c Mayor Stanley J.U90Vicz,Jr.;Fie Chief Robert W.Turner;Building Inspector peter R.Strout;Police Chief Robert St Pierre;Health Agent Joanne Scott Jun 01 01 07: 14a Joanne Scott Salem BOH 978 740 9705 p, z May-31 -01 12 .40 66SPTG/CEV HAFRO1731 617-478-8151 p _ Ot Citp ofa[etn, lagatl)ttgetto; `Q0p, I 333 0(hrr d 11)r 1Cily t'Lowlnl 3tt \fid trity liall e COUNUMeRS-A2 LAROE JOAN H. You will recall we had previous building code violations with a previous owner who rented rooms to Salem State College students. This property is zoned R-1 single family residences. The new owner evidently has the same plan. Please investigate this matter and advise me of your findings. Respectfiilly, se A.
