A hearing on this petition was held May 20, 1998 with the following
Board Members were present: Nina Cohen, Michael Ward, Ronald
Harrison, Paul Valaskagis and Stephen Buczko. Notice of the hearing
was sent to abutters and others and notices of the hearing were
properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
At the request of the petitioner's Attorney, Henry Lucas, the Salem
Board of Appeal voted 5-0, to grant leave to withdraw this petition
without prejudice for a Special Permit to enable to re-build
non-conforming structure to its original status for the property
located at 301 Lafayette Street.

Dear Mr. Keenan:
Pursuant to your request, I am pleased to provide the attached summary of the floor area
calculations for the subject Project.
As you can see, we have calculated that the total Gross Square Foot Area of the building prior to the
fire was approximately 6391 SF, and that the total Livable Square Foot Area of the building was
approximately 6243 SF.
Based on our visual inspection and measurement of the building, we determined that 100% of the
first floor area, 95% of the second floor area and approximately 25% of the third floor area remains
intact and was not destroyed by the fire that occurred at the property in December 1997. Therefore,
the total square footage of floor area remaining intact totals approximately 5080 square feet, or
approximately 80% of the total Gross Square Foot Area of the building.
It is my professional opinion, therefore, that more than 50`90 of the building's floor area has not
been destroyed, and that the building can be reconstructed to its original condition prior to the fire a
as indicated by Article VIII, Section 8.4, Subparagraph 2, of the City of Salem Zoning Ordinance. b

Dear Inspector Tremblay:
Issue Presented: You have asked for my opinion/review of the proposed reconstruction
of the nonconforming structure at 301 Lafayette Street that was recently partially
destroyed due to a fire.
While the Massachusetts Zoning Law (Chapter 40A, Section 6) does not expressly
authorize the reconstruction of an accidentally"destroyed", nonconforming structure, the
City of Salem's Zoning Ordinance does provide such protection. Specifically, Section 8-
4(2) provides:
Should such structure be destroyed by any means to an
extent of more than fifty(50) percent of its replacement
cost or more than fifty (50) percent of its floor area at the
time of destruction, ithh is a l not be reconstructed except in

Webster's Ninth New Collegiate Dictionary defines "destroy" as "to ruin the structure,
organic existence, or condition of." Thus, the focus becomes how much of the structure
of 301 Lafayette Street was ruined by the fire?
Replacement Cost
Peter Strout(Peter Strout General Contracting) has opined that the cost of the repairs is
less than fifty (50) percent of the total replacement cost of the structure. Total cost to
replace the main structure being $729,630.00 and the repairs to be done $325,000.00.
(See attached opinion). As we discussed, this portion of the ordinance (replacement cost)
is rather nebulous. It does appear, however, that they have minimally met this vague
standard.

Dan Pierce of Pierce Architects has also provided a breakdown of the square footage
before and after the fire. Although Mr. Pierce's description of the third floor appeared
overly optimistic (25% still in tact), it does appear that his opinion that more than fifty
(50) percent of the total structure is still in tact is accurate. Indeed, at our request, you
were afforded the opportunity to inspect the premises on May 11, 1998, and found that
approximately seventy(70) percent of the structure still in tact. For the record, Mr.
Pierce's calculations as to total area were in accord with the City of Salem's Assessor's
Card (6,242 sq ft versus 6,175 sq ft respectively). (See attached copies of both).
As it appears that the cost of repairs is less than fifty percent of total replacement costs
and that only approximately thirty (30) percent of the floor area has been destroyed,
reconstruction can proceed without the need for a special permit or variance. Certainly,
"reconstructed" means to an extent no more nonconforming than previous. Going
forward, this new structure will continue to be protected under Mass. Gen. L. Ch. 40A,
Section 6 as the original nonconforming structure.

Based upon my analysis of the center bearing wall, its as-built condition, and the fact that virtually
all of the studs that had been assumed to remain at the first floor have been replaced, please see
the following:
There are now two rows of 2x4 @ 16"o.c, SPF"Stud" grade or better studs running from the first
to second floor. These are sometimes aligned and sometimes not, depending upon the presence
and layout of openings in the wall. Because these are of a smaller finished dimension and lower
wood grade than was used in the 1890's,each pair must be reinforced with 24's.
The 2x6's should be oriented perpendicular to the wall (parallel to the 2x4's) and should be
located on the side of the wall that is in bearing (under cut joist ends and/or under the wall that
runs to the third floor above and over the supporting beam below). The facing edges of the 20's
should be aligned with the edges of the W's to contact the wall finishes. Please note that this
will conflict with the current door pockets at some locations and it is not known at this time
whether pocket doors will be retained. In the case that they are, triple 2x4 sisters should be
added in lieu of the 24's along the doors,
The 26's should be nailed to the W's at no less than 6" on center, and the wall sheathing
should be attached to either the 2x4 or the 24, continuously. Where possible, the 26's should
also be nailed to the W's on the wall at the far side.

A VARIANCE FOR 301 LAFAYETTE STREET
A hearing on this Petition was held on January 20, 1982, with `b �llilc�&��� t0�
Board Members present: Douglad Hopper, :Chairman, Messrs. Hacker, Piemonte, ee etry U
and Associate Member Martineau. Notices of the hearing were sent to abpftte�s and !-
others and notices of the hearing were properly published in the Salem Evening
News in accordance with Massachusetts General Laws Chapter 40A. LITY GLE�,,t. &t,{,E.y.Hpgg:
The Petitioners are requesting variances for the property at 301 Lafayette ,
Street to use the first floor of the property for a law office. A.variance is
required because the property is in a.:R-3 district where the proposed use is prohibited
without a variance.
The Board of Appeals, after consideration of the evidence presented at the
public hearing and after viewing the property makes the following findings of fact:
1. The property in question is the site of six residential units, four of
which are in the building designated as 301 Lafayette Street.
2. The property is a large structure which is easily adaptable to a law
office.
3. The continued use of the property for- only residential units presents
an economic hardship on the Petitioners.
On the basis of the above findings of fact, and the evidence presented at
the public hearing, the Board of Appeal. concludes as follows:
(1) The property in question is unique because of its size and
configuration and because of its unique ability to accommodate
a substantial number of off-street parking spaces.
(2) The conditions described above especially affect the structure
in question but do not generally affect the zoning district in
which the building is located.
(3) The conditions described above which affect the land in question, but
not the zoning district generally cause financial hardship to the
Petitioners.
(4) The desired variance may be granted without substantial detriment
to the public good because the proposed use of the property is in
harmony with other non-residential uses in the area.

Therefore, the Board of Zoning Appeal unanimously voted in favofft&-'
granting the requested relief. The Board grants a variance to. the Petitioners

1) The first floor of :the property designated as 301 Lafayette Street
may be used as a law office for not more than 4 attorneys.

2) The property may also be used for not more than three residential units.
3) Petitioners shall provide eleven parking spaces at the site as
shown on the plans submitted to the Board unless this requirement is modified in
accordance with paragraph 4.
4) Petitioners 'shall submit their proposed parking plan to the Salem
Fire Marshall for his review. Alterations, if any, in that plan ordered by the
Salem Fire Marshall shall be incorporated in and become part of this variance.
