RONAN_ FOR VARIANCESaAT 274 LAFAYETTE STREET - (R-3) A hearing on this petition was held June 15, 1994 with the following Board Members present: Stephen Touchette, Chairman; Gary Barrett, Albert Hill and Nina Cohen. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting Variances from side, rear, lot size and distance between buildings to allow the fire damaged carriage house to be demolished and rebuilt. Property is located in the R-3 zone. The Variances which have been requested may be granted upon a finding by this Board that: 1. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involved. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. There was no opposition to the petition. 2. The petitioner represented that his immediate neighbor at 276 Lafayette St. , was in support of his proposed reconstruction. 3 . The Salem Historic Commission has reviewed the plans and have given their approval. 4 . The existing carriage house is in disrepair as a result of age and a fire that damaged parts of the interior and the roof. 5. The proposed structure will be used as a garage. Special conditions exist which especially affect the subject property but not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioner. 3. Desirable relief can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted unanimously, 4-0 to grant the variances requested, subject to the following conditions: 1. A reduction to thrity-three (33) per cent of the specified outdoor values for recirculating HVAC systems is permitted. In no case shall the outdoor air quantity be less than five (5) cfm per person. We believe that these youngsters are more often victims rather than subjects in need of punishment or treatment . They usually lack advocacy, trusting relationships and support systems . Our intervention philosophy is humanistic , yet we do not espouse any specific treatment modality. Our staff is chosen not on the basis of professional background and expertise, but rather upon committment to and demonstrated skills in working with people . Currently, the Institute is operating three programs : Outreach Counseling An the. Malden area; a Foster Care Pro-ram for adolescents in the North Shore area; and an Experiential Learning Program as alternative education without walls in the DYS Region IV area. The Outreach Counseling Pro-ram ram is based upon the premise (borne out .by research and documented by facts ) that there. are `our major underlying causes of delinquency: 1 . Failure in school, dropping out and acquiring an ille; mate identiy. 2 . Lack of backing and advocacy due to the lower socio-economic, status of most delinquents ; 3 • Labeling of youngsters by the criminal justice :system which increases his/her criminal self-image; 4 . Lack of family support and frequently recipient of and scapegoating for family conflicts . Foster home care seems to be one step beyond the home environment, yet one step short of :segregating troubled youths in the alien and artificial environment of a group home . NYI 's Foster Care Program provides the following services : recruits., trains and supervises foster families for adolcauents ; provides counseling, individual, group and family services to the youth and his family of origin, wherever it is deemed necessary; conducts Some visits and intensive counseling to the foster families for the purpose of providing them with insights into the youngster's problems and exploring methods of handling them; conducts regular meetings with foster parents in order to provide them with a forum for exchanging learning experiences , gain- ing new insights , seeing films , and hearing speakers . The roster Care program is staffed by the Director of the agency who provides supervision, one social worker/co-ordinator, two counselors , and one secretary/resource person . The Experiential Learning Program, called ELP, is an al. Le::•na - tive educational program to public school education for delinquent youths . Since the purpose of the educational system is to prepare the young for adult roles within society, its structure closely parallels that society, with emphasis upon goal achievements , com- petitive ouc'cess and adjustment to and acceptance of the social order. When a youngster fails to conform to these pressures , society views him/her as rejecting its values and therefore rejects and labels the child "delinquent" . The ELP offers each student an individualized, structured program designed according to his/her special needs . The specific areas of need are determined during the intake procedure and are achieved in a ,joint decision-making process . . The student agrees to and makes a commi.ttment, to his/he!.- own program . The 3LF's educational process aids youn„rLere, in making deci- sions affecting their lives in a constructive and responsible manner.
