Dear Steve :
Please be advised that I have reviewed a July 24 , 1985
decision of the Board of Appeal relative to a Variance/Special
Permit which was granted at the above location. Apparently,
there is some question as to the interpretation to be given
condition #5 relative to six ( 6 ) parking spaces to be used
by neighbors on Laurel, Linden and Lafayette Streets. The
common and approved usage of the English language is
dispositive that this condition is met when six ( 6 ) parking
spaces are provided for neighbors as indicated. As the
condition does not enumerate specific individuals, any
neighbors from the streets indicated may use the spaces .

Dear Mr. Foley:
Thank you for sending additional information regarding the above captioned matter. It
does appear that 1 Laurel Street was granted an easement for the three parking spaces on
March 24, 1987. This, however, came after the Board of Appeals decision which provided
the condition that "six (6) spaces to be used by the neighbors on Laurel, Linden and Lafayette
Streets exclusively." The condition was not for three (3) for 1 Laurel and three (3) for the
remainder.
This condition did not prevent Greystone Realty Trust from granting an easement to 1
Laurel. More importantly, it does not relieve its obligation to provide six parking spaces
additionally for the other neighbors. Thus, the bottom line appears to be there needs to be an
additional three (3) spaces for the exclusive use of the neighbors of Laurel, Linden and
Lafayette. This would bring the total to six(6) as required by the Board of Appeals.
Please discuss with the association and let me know what corrective action, if any, you
plan to take. Thank you for your attention to this matter.

Dear Mr. Tremblay:
I appreciate your letter of July 17, 1996 concerning our three designated parking
spaces located at subject address. My mother, Dorothy W.C. owns the 1 Laurel St.
property since the passing of my father in April of 1995. Being a lawver, my mother was
quite concerned when she read your letter and wants this misunderstanding resolved as
soon as possible.
I act in my mother's behalf handling the day to day operations and tip keep of her
property. My brother William of Marblehead assists my mother with her legal affairs.
My brother Leo from Montana works closely with William especially when William is out
of the country, which he is currently.
Your letter was informative and it is now clear why there is so much confusion as
to the easement that One Laurel Street has for three (3) parking spaces designated as E-1,
E-2, E-3 on a site entitled "Plan of Land in Salem, Massachusetts. prepared for Greystone
Manor Condominiums on -\larch 23,1987" recorded with the Registry of Deeds on
September 23, 1987. What I don't see included with the copy of the Board of Appeal 8
conditions that you sent me is a copy of the MASTER DEED. BOOK 9202 PG 3 57-3 83
and EASEMENT, BOOK 9197 PG 544-547. You are correct in so stating that six spaces
are to be used by neighbors on Laurel, Linden and Lafayette streets exclusively However,
von may want to refer to the Master Deed which excludes three (3) parking spaces which
were conveyed by easement to my father, William A. and my mother, Dorothy W.C. This
is in addition to the six(6) parking spaces mentioned above.
My mother has instructed me not to remove the three (3) signs which my brother
William authorized me to install on May 10, 1996 In addition he has requested that you
send a letter to the Greystone Manor Condominiums as well as the residents of Laurel,
Linden and Lafayette streets clarifying the rights of the neighbors to use six (6) parking
spaces and the exclusion of three (3) additional parking spaces to be used exclusively by
the residents at# One Laurel Street.
After you have had the opportunity to familiarize yourself with the Master Deed,
please fell free to contact me with any questions that you might have. I would be more
than happy to meet with you at the site, 1 Laurel St. or at your office, which ever is most
convenient for you.
Incidentally, the three signs which we installed back in May disappeared about a
month ago for two days. My mother attributed the mishap to vandalism by �Ouths from
another neighborhood. This made sense however, upon further investigation by me, the
signs were retrieved unblemished including hardware in the dumpster located at Graystone
Manor Condominiums.
I appreciate your assistance in handling this matter in a prompt and timely manner
so there won't be any more disruption in the neighborhood.

Back in July of 1985 , the City of Salem Board of
Appeals granted permission to Lafayette Real Estate Trust
to convert a carriage house to four condo units , and
variances in order to construct twelve condominium units
in this R-3 district .
Upon doing so the Board of Appeal had 8 conditions
that had to be addressed (copy of Board of Appeal
conditions enclosed ) .
Condition #5 reads as follows ; A minimum of thirty
three ( 33 ) parking spaces be maintained on site, and of
there thirty three ( 33 ) spaces , six spaces to be used by
neighbors on Laurel , Linden and Lafayette Streets ,
exclusively.
I do not find anywhere in the conditions where three
(3 ) of the parking spaces where set aside for residents of
1 Laurel Street only. Please remove said signs and
conform with the City of Salem Board of Appeals
conditions .

A hearing on this petition was held July 17, 1985 =d con ued until July 24,
1985 with the following Board Members present: JaZes Hac&�_ , Chairman; Messrs. ,
Charnas, Gauthier, Luzinski and Strout. Notice of the hc•?!*ing was sent to
abutters and others and notices of the hearing were properly published in the
Salem Evening News in accordance with Massachusetts General Laws Chapter 40A.
Petitioners are requesting a Special Permit to convert carriage house to four
condominium units and all necessary Variances in order to construct twelve
condominium units in this R-3 district.
The Board of Appeal, after careful deliberation, established there was a sub-
stantial difference from the petition that was denied by the Board on May 15, 1C
the difference being two less units on the property. Mr. Gauthier made a motion
to hear the petition. Mr. Charnas seconded the motion. By a vote of 4 - 1
(Mr. Hacker voted in opposition) the Board of Appeal voted to hear this petition
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing
in this Ordinance, the Board of Appeal may, in
accordance with the procedure and conditions set
forth in Section VIII F and IX D, grant Special Permits
for alterations and reconstruction of nonconforming
structures, and for changes, enlargement, extension, or
expansion of nonconforming lots, land, structures,
and uses, 'provided, however, that such change, extension,
enlargement or expansion shall not be substantially more
detrimental than the existing nonconforming use to the
neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Perr..':'_ will promote the public health
safety, convenience and welfare of the City's inhabitants.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the sane district;
b. literal enforcement of the provisions of the Zoning Ordinance would inv
substantial hardship, financial or otherwise, to the petitioner; and
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
DECISION ON THE PETITION OF LAFAYETTE REAL ESTATE TRUST,

r The Board of Appeal, after careful consideration of the evidence presented at tt.
hearing and after viewing the plans, makes the following findings of fact:
1 . The total of sixteen ( 16) units requested would overburden the area
and a lesser amount would be satisfactory. The developer agreed to a
total of ten ( 10) units;
2. The Carriage House will be moved to the front of the property as per
plans submitted to the Board on July 24 , 1984;
3. The petition was continued from the July 17, 1985 meeting;
4 . Approximately two years ago a similar petition was denied;
5. Approximately two months ago a similar petition was denied;
6. The Board voted four to one that there was a substantial difference

from the previous petitions;
7. Several neighbors were opposed to this petition;
8. Few neighbors spoke in favor of this petition if the total number
of units were reduced;
9. Because of the shape of the land, in all probability, it could not be
used in a lesser fashion than the ten ( 10) units.
On the basis of the above findings of fact, and on the evidence presented at
the hearing, the Board of Appeal concludes as follows:
1 . Special conditions and circumstances exist which affect this lot
and which do not affect the district;
2. The proposed use wJll not be substantially more detrimental
to the neighborhood;
3. Literal enforcement of the Zoning Ordinance would work a substantial
hardship upon petitioners;
4. The relief requested can be granted without substantial detriment to
the public good and without substantially derogating from the intent
of the district or the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted four to one, 4-1 , (Mr. Hacker voted
in opposition) to grant the Special Permit and Variance requested on condition:
1 . There be no more than ten ( 10) units total, as per plan submitted
to the Board at the July 24, 1985 meeting;

Condition if5 reads as follows : A minimum of thirty
three ( 33 ) parking spaces be maintained on site , and of

I do not find anvwhere in the conditions where three
( 3 ) of the parking spaces where set aside for residents of

On Thursday, June 6, 1985, the Planning Board of the City of Salem held
a public hearing regarding the application of Lafayette Street Real
Estate Trust for a Special Permit under Section R, Site Plan Review, of
the Salem Zoning Ordinance ; with respect to the construction of ten
housing units at 256-258 Lafayette Street, Salem, MA.
At a regularly scheduled meeting of the Planning Board held on Thursday,
November 8, 1985, the Board voted, by a vote of seven in favor, none
opposed, to approve the application as complying with the requirements
for the issuance of the Special Permit with the following conditions:
l -'Work'shall-conform to plan entitled, "Site_ Plan,_ Lafay_ette__Villa
Condominiums", dated November 6, 1985.
2. Board of Health requirements:
a. Employ an acceptable method of holding and removal of refuse;
b. Employ an acceptable method of cleaning and maintaining the
surface drains;
C. Employ an acceptable method for dust and street cleaning
control during site construction;
d. Employ an acceptable method for removal of all construction
debris and vegetation waste from site;
e . Prior to water system (drinking water) being put into service
that it be tested for pressure and bacteria;
f. Prior to site startup and during site construction employment
of a licensed pest control firm for site evaluation and
service.
3. Board of Appeal requirements as set forth in decision granted on
July 24, 1985, shall be strictly adhered to.
4. All construction shall be in accordance with the following
conditions:
a. No work shall commence before 7:00 a.m. on weekdays and 8:00
a.m. on Saturdays. No work shall continue beyond 5:00 p.m.
No work shall be conducted on Sundays or holidays. Inside work

b. All construction shall be carried out in accordance with the
Rules and Regulations of the Planning, Board. A Clerk of the
Works shall be provided by the City a[ the expense of the
developer as is deemed necessary by the Director of Public
Serdices or the City Planner.
5. Landscaping shall be subject to plan entitled "Site Plan Lafayette
Villa" and shall conform to the following:
a. Shrub diameters shall be a minimum of 2' : Mature trees shall
be a minimum caliper of 3".
b. Shrubs and trees shall be maintained in a healthy and thriving
condition. Should these plantings not remain in a healthy and
thriving condition, the responsibility for replacing such
plantings shall be the owner or his successor in interest. d
Final landscaping plan shall be approved by the Planning Department
prior to issuance of Certificates of Occupancy.
6. Snow and rubbish removal shall be the responsibility of the
developer or his successor in interest.
7. Moving of the carriage house shall be done with strict regard for
the preservation of the structure.. Any damage which may occur during
the move shall be repaired to duplicate the original appearance in
accordance with SHC guidelines.
8. Off—street lighting facilities which used at night shall be provided
with adequate lighting installed and maintained in such a manner so as
not to reflect or cause glare on abutting or facing residential premises
nor to cause reflection or glare which adversely affects safe vision of
operators of vehicles moving on nearby streets. A recommended standard
for lighting is a minimum intensity of one (1 ) foot candle on the entire
'surface of the parking facility.
9. Substantial violation of any of these conditions shall result in
revocation of this permit by majority vote of the Planning Board.
I hereby certify that a copy of this decision and plans have been filed
with the City Clerk and copies are on file with the Planning Board.
This Special Permit shall not take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed and no appeal has been filed or that if such appeal has been
filed, and it has been dismissed or denied, is recorded in the Essex
County Registry of Deeds and is indexed in the grantor index under the
name of the owner of record or is recorded on the owner's certificate of
title. The fee for recording or registering shall be paid by the owner
or applicant.

5 . A basic fire alarm legend shall be placed on the 4 Laurel St .
plans , as they are considered a separate application. These
plans will not have the items required on the plans for the
front structures , as this is considered a basic four family
dwelling; unit , with less restrictive fire alarm requirements.
6 . Access stairs to boiler room, under front of carriage house,
shall be shown. Boiler room shall be completely enclosed as
per building code. Method of enclosure of walls and ceiling
shall be shown on plan.
7 . On sheet#3 of 4, for carriage house , shall show the note, that
all apartment smoke detectors for both second and third floor
apartment units , shall be interconnected , within wach apartment .
Plans shall be returned to submitter, for revision, with items as
listed above to be provided.
Plans then may be resubmitted to this office, with an application
for plan approval (Form #81) , and then upon approval will be atamped
and Form #81 issued . This office will keep one set of plans , two
sets are to then be provided the Building Inspector, for his approval.

On Thursday, June h, 1985, the Planning Board of the City of Salem held
a public hearing regarding the application of Lafayette Street Real
Estate Trust for a Special Permit under Section D, Site Plan Review, of
the Salem Zoning Ordinancei Ordinancewith respect to the construction of ten

aregularly scheduled meeting of the Planning Board held on Thursday,
November 8, 1035, the Board voted/ by a vote of seven in favor, none ~
opposed, to approve the application as complying with the requirements
for the issuance of the Special Permit with the following conditions:
1 . Rork sball conform to plan entitled, "Site Plan, Lafayette Villa
Condominiums", dated November 6, 1085.
2, Board of 8eulcb requirements:
�
a. Employ an acceptable method of holding and removal of refuse; ,
h. Employ an acceptable method of cleaning and maintaining the
surface drains;
C. Employ an acceptable method for dust and street cleaning
control during site construction; I
d. Employ an acceptable method for removal of all construction
debris and vegetation waste from site;
e. Prior to pater system (drinking mater) being put into service
that it be tested for pressure and bacteria;
f. Prior to site startup and during site construction employment

service.
3. Board of Appeal requirements as set forth in decision granted on
July 24, 1985, shall be strictly adhered to,
4. All construction shall be in accordance with the following
conditions:
a. No work shall commence before 7 :00 a.m. on weekdays and 8:00
a.m. on Saturdays. No work shall continue beyond 5:00 y,m^
No work shall be conducted on Sundays or holidays. Inside work
of a quiet nature sball. be permitted at other times;

b. All construction shall be carried out in accordance with the
Ruies and Regulations of the Planning Board. A Clerk of the
Works shall be provided by the City at the expense of the
developer as is deemed necessary by the Director of Public
Services or the City Planner.
5. Landscaping shall be subject to plan entitled "Site Plan Lafayette
Villa" and shall conform to the following:
a. Shrub diameters shall be a minimum of 21 . Mature trees shall
be a minimum caliper of 3".
b. Shrubs and trees shall be maintained in a healthy and thriving
condition. Should these plantings not remain in a healthy and
thriving condition, the responsibility for replacing such
plantings shall be the owner or his successor in interest.
Final landscaping plan shall be approved by the Planning Department
prior to issuance of Certificates of Occupancy.
6. Snow and rubbish removal shall be the responsibility of the
developer or his successor in interest.
7 . Moving of the carriage house shall be done with strict regard for
the preservation of the structure. Any damage which may occur during
the move shall be repaired to duplicate the original appearance in
accordance with SHC guidelines.
8. Off—street lighting facilities which used at night shall be provided
with adequate lighting installed and maintained in such a manner so. as
not to reflect or cause glare on abutting or facing residential premises
nor to cause reflection or glare which adversely affects safe vision of
operators of vehicles moving on nearby streets. A recommended standard
for lighting is a minimum intensity of one (1) foot candle on the entire
surface of the parking facility.
9. Substantial violation of any of these conditions shall result in
revocation of this permit by majority vote of the Planning Board.
I hereby certify that a copy of this decision and plans have been filed
with the City Clerk and copies are on. file with the Planning Board.
This Special Permit shall not take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed and no appeal has been filed or that if such appeal has been
filed, and it has been dismissed or denied, is recorded in the Essex
County Registry of Deeds and is indexed in the grantor index under the
name of the owner of record or is recorded on the owner's certificate of
title. The fee for recording or registering shall be paid by the owner
or applicant. p

Dear Mr. Serafini,
In order to clearify the Parking Space Problems at the property
located at 256-258 Lafayette Street. As you know this office must
enforce the site plan as approved by the Zoning Board of Appeal
and has no authority to allow deviations from that plan. There has
apparently been changes made which effect the size and number of
spaces and until this matter has been corrected or an amended
decision has been approved by the Zoning Board of Appeal no further
Certificates of Occupancy will be issued for the project.
In addition it has come to my attention that the six (6) spaces
to be used by neighbors have apparently been deeded to one or two
abutters rather than available to these neighbors on a "first come"
basis, not the intent of the Zoning Board of Appeal in either my
opinion or the City Solicitor.

Dear Steve :
Please be advised that I have reviewed a July 24 , 1985
decision of the Board of Appeal relative to a Variance/Special
Permit which was granted at the above location . Apparently,
there is some question as to the .interpretation to be given
condition #5 relative to six ( 6 ) parking spaces to be used
by neighbors on Laurel , Linden and Lafayette Streets . The
common and approved usage of the English language is
dispositive that this condition is met when six ( 6 ) parking
spaces are provided for neighbors as indicated. As the
condition does not enumerate specific individuals , any
neighbors from the streets indicated may use the spaces .

A hearing on this petition was held October 15, 1986 with the following Board
Members present: James Hacker, Chairman; Messrs. , Fleming, Luzinski, Strout and

and notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.

Petitioner, owner of the property, requests Variances & Special Permit from
density and setbacks to allow a single family dwelling to be converted to a three
unit condominium in this R-3 district.
The Variance which has been requested may be granted upon a finding of the Board j
that:

a. special conditions and circumstances .exist which especially affect '.
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district,
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner; and

public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:

Notwithstanding anything to the contrary appearing in this
Ordinance, the Board of Appeal may, in accordance with the
procedure and conditions set forth in Section VIII F and IX D,
grant Special Permits for alterations and reconstruction of
nonconforming structures, and for changes, enlargement, extension
or expansion of nonconforming lots, land, structures, and uses,
provided, however, that such change, extension, enlargement or
expansion shall not be substantially more detrimental than the
existing nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City's inhabitants.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . Neighborhood was in favor of the conversion;
2. Structure is too large to make it economically feasible to
remain as a single family dwelling

On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions exist which affect this property but do not
generally affect other property in the sane district;
2. Literal enforcement of the provisions of the Zoning Ordinance would work
a substantial hardship to the petitioner; and
3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance
4. The granting of the Special Permit requested will promote the public health,
safety, convenience and welfare of the City's inhabitants. .
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant a Special
Permit to allow single family to be converted to three unit condominium, Variances
from minimum lot width, lot area, minimum lot area per dwelling unit and side yard
setback on the northerly side of the property. Special Permit and Variances are
granted subject to the following terms and conditions:
1 . Building must comply with all applicable Massachusetts State
Building Code requirements;
2. All regulations of the Salem Fire Prevention Bureau must be
adhered to;
3. A Building Permit for all construction must be obtained;
4. A Certificate of Occupancy for each unit must be obtained;
5,. Must meet any conditions of the Planning Board and the
Historic Commission

Off-Street Parking - Uncovered, not included in structure:
Off-street parking spaces shall be provided and maintained by the owner of
the property for each building or use which, after effective date of this
Ordinance, is erected, enlarged, or altered, according to the following
regulations:
1 . All parking space required by this Ordinance shall be
on the same lot as the building or use which they are
intended to serve, except that the Board of Appeals
may permit the parking spaces to be provided within
four hundred feet of the building of use intended to
be served, if the Board determines that it is impractical
to provide parking on the same lot with the building.
If a separate lot is used for parking, the ownership
of the lot must, for all times, be held by the same
ownership as the lot on which the building is erected.
if the parking lot ownership is separated from the owner-
ship of the building, thisshall be deemed a violation
and the Building Inspector shall void the Certificate of
Occupancy.
2. Notwithstanding any other provision of this Ordinance,
off-street parking shall not be required:
a. For. any Church or other place. of worship, or secondary
school, or institution of higher education, with the
exception. of the State College at Salem where local
Ordinances shall prevail.
3. Required parking spaces shall not be reduced or encroached
upon in any manner unless a change in use occurs which
permits a change in the amount of parking area required.
4. Design of all off-street Parking Facilities
a. Parking facilities shall be occupied only by passenger
cars and commercial vehicles not exceeding seven and
one-half feet in width and eighteen feet in length.
b. The minimum dimensions of stalls and aisles shall be
as follows:

1 ) Stall width shall be at least nine feet.
2) Stall depth shall be at least nineteen feet for all
angle parking and twenty-two feet for parallel
parking. Such dimensions may include no more
than two feet of any landscaped setback area
adjacent to the front or rear of a stall and used
for bumper overhang.

4. Approximately two years ago a similar petition was denied;
5. Approximately two months ago a similar petition was denied;
6. The Board voted four to one that there was a substantial difference
from the previous petitions;
7 • Several neighbors were opposed to this petition;
8. Few neighbors spoke in favor of this petition if the total number
of units were reduced;
9. Because of the shape of the land, in all probability, it could not be
used in a lesser fashion than the ten (10) units.
On the basis of the above findings of fact, and on the evidence presented at
the hearing, the Board of Appeal concludes as follows:
1 . Special conditions and circumstances exist which affect this lot
and which do not affect the district;
2. The proposed use will not be substantially more detrimental
to the neighborhood;
3. Literal enforcement of the Zoning Ordinance would work a substantial

Dear Mr. Munroe:
I have reviewed your letter of May 16 , 1988 to Attorney
John R. Serafini, Sr. in connection with the above-captioned
matter, a copy of which was sent to this office. In April,
1988, at the request of Mr. Santry, I addressed this situation
and I will herein attempt to clarify my opinion on this matter.
In my opinion, Condition #5 of the Variance/Special
Permit relative to six ( 6 ) parking spaces to be used by
neighbors on Laurel, Linden and Lafayette Streets is satisfied
so long as these spaces are used by neighbors on any one
or all of said streets . The fact that some or all of the
spaces are used by neighbors who have been granted easements
to use said spaces exclusively does not alter the fact that
the condition is met so long as the use is for the benefit
of people who reside on any of said streets . In my opinion,
the fact that those people have exclusive rights to use said
spaces meets the requirements of Condition #5 .

I was asked to inspect the work that was performed roofing the various buildings that
make up Greystone Manor Association. I was asked to look at some of the problems
present after the roof contractor finished. Several leaks are evident. Also there were
many instances of poor workmanship. Several flashing details were damaged or missing.
Bent gutters were obvious in several locations. Every skylight I looked at had the factory
flashing bent upwards and unserviceable,There were several areas where nails were

The purpose of this letter is not to pinpoint the individual problems, "they have been
detailed by others", but to show overall the quality of the work was not good. I spoke
with the contractor Leo Penia, but he does not feel that the problems are his. I disagree.
The State Building Code Section 1508 requires, "Flashing to be installed at wall and roof
intersections" at gutters, wherever there is a change of roof slope or direction and around
all roof openings"

Dear Ms. Rossi:
See the enclosed letter from Tom St.Pierre,Building Inspector for the City of Salem. As you can see, at his
instruction the Greystone Manor condo association recently constructed a wall structure inside the fenced in
dumpster area,designed to help prevent the dumpster from being placed in a location that might lead to
further damage of your adjacent garage when it is emptied.
The remaining set of issues seems to stem from the dumpster lid being left open, and the general unsanitary
condition of the dumpster. As you have described,the uncovered dumpster has lead to problems with flies,
odor and blowing trash. As you know,there are several paragraphs of Sec. 2423 of the Salem Code of
Ordinances that outline proper maintenance and operation of a dumpster,including that they must be covered
at all times,must be immediately emptied when full,and that the dumpster area must be.kept'free of odors,
scattered debris,overflowing and all other nuisances." These elements of the ordinance are enforced by the
City Health Department. I have copied David Greenbaum,health inspector for our part of the City, on this
letter, and will ask that he keep a close eye on the condition of this dumpster, as I will as well. I would ask
you too to notify me of violations of this portion of the ordinance, so that I can inform David to cite the
condo association.
I'm sorry that this problem has been so difficult to solve. I hope these measures together will help alleviate
the problem for you. I will keep a close eye on it.
