You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger or materially impair your health or safety and that your landlord knew about the violations before you were behind in- your rent_ B. You did not cause the violations and they can be repaired while you continue to live in the building. C. You are prepared to pay any portion of the rent iiito count if a judge orders you to pay it. (For this,it is best to put the rent money aside in a safe place.) 2. Rent Receivership(Massachusetts General Laws,Chapter 11,section 127 C-R):The occupants and/or the Board of Health may petition the District or Superior Court to allow rent to be paid into court rather than to the owner. The court may then appoint a "receiver" who may spend as much of the rent money as is needed to correct the violation. The receiver is not subject to a spending limitation of four months'rens 5. Breach of Warranty of Habitability: You may be enuded to sue your landlord to have all or some of your rent returned if your. dwelling unit does not meet minimum standards of habitability. 6. Rowley Plaza 144 Turnpike St. Box A4 Rowley, MA 01960 Attention: Tony Annis Re: 233 Lafayette St. Salem, MA 'October 13 , 1987 Dear Tony, I inspected the conditions of the existing lintels and fire escapes with you on September 16, 1987 ,at the referenced building. There are several lintels which need to be replaced. I am attaching herewith a schedule showing the required sizes for the various masonry openings. It will only be possible to determine which lintels are in need of repair when you have erected the necessary staging around the building and a close up inspection can be made. The two fire escapes located toward the front'-of the building were found to be in good structural conditon, but the one toward the rear of the building needs repair work. The through bolt anchors at each bracket have pulled outward. Investigation shows that at -the time of installation the installer did not remove the wood baseboards inside the finished rooms where the bolts are anchored. These bolts must be detached, the backing plate removed, the wall finish cut out and then the plate and nut. can be reinstalled against the face of the brick wall. It may be necessary to repair exterior brick work at each bracket location. Very ruly yours, Ken Dennison, P.E. KFD/shk \,,0 of A?4 s4. KENNF. These louvers had dampers tied into thk fire-' alarm system. While this system meets the building code requirements, the contractor suggested that providing a louver to the exterior complies with the code and would be less expensive. In discussing this issue with you, it was decided that Section 2111 .0 of the State Building Code was the applicable section to be complied with. Because our floor area is more than twice the appliance area by Section 21 1 1 .3 and 21 1 1 .3. 1 and 21 1 1 .4, we are required to provide a single louver, at the top of the room, without a damper, whose area equals 1 sq.in. per 1000 btu input capacity. If your interpretation of the code is different from that outlined above, please notify me at once, otherwise we will proceed with the change. Best, Thaddeus S.
