my apartment at 196 Lafayette st. Salem. I have asked my land-
lord to comply with fixing the repairs at this address. I believe
my apartment is in violation in the following areas ;
Failure to provide adequate locks for entry doors into building:
Failure to comply with requirements of the health code by providing
no barrels or place to store garbage.
Failure to maintain electrical facilities in a proper maner.
Toilet free from defects.
Wash basin free from defects.
Common area lighting is on tenant meter.
No fire extinguishers on building floors.

violations of the Mass Building Codes were found.

ADMINISTRATION AND ENFORCEMENT l
Department of Public Safety shall be notified in writing within seven (7) working
' days of any action taken under this section.
101.4 Referenced Standards: Where differences occur between provisions of this
code and referenced standards, the provisions of this code shall apply.
SECTION 102.0 ORDINARY REPAIRS
102.1 General: Except as provided in Section 113.1, a permit shall not be required
for ordinary repairs to buildings and structures.
SECTION 103.0 INSTALLATION OF SERVICE EQUIPMENT
103.1 General: When the installation, extension, alteration or repair of an
elevator, moving stairway, mechanical equipment, refrigeration, air conditioning or
ventilating apparatus, plumbing, gas piping, electric wiring, heating system or any
other equipment is specifically controlled by the provisions of this code or the
approved rules, it shall be unlawful to use such equipment until a certificate of
approval has been issued therefor by the building official or other agency having
jurisdiction.
SECTION 104.0 MAINTENANCE
104.1 General: All buildings and structures and all parts thereof,both existing and
new, shall be maintained in a safe and sanitary condition. All service equipment,
means of egress, devices and safeguards which are required by this code in a
building or structure, or which were required by a previous statute in a building or
structure, when erected, altered or repaired, shall be maintained in good working
order.
104.2 Owner responsibility: The owner, as defined in Article 2, shall be
responsible for the safe and sanitary maintenance of the building or structure and
its exitway facilities at all times, unless otherwise specifically provided in this code.

THE MASSACHUSETTS STATE BUILDING CODE
Exceptions:
1. Where the bottom riser adjoins a sloping public way, walk or driveway
having an established grade and serving as a landing, a variation in height
of the bottom riser shall not exceed 3 inches in every three feet of
stairway width.
2. On stairways serving as aisles in assembly seating, where necessitated by
changes in the gradient of adjoining seating areas to maintain adequate
sightlines, the maximum nonuniformity of riser heights within a flight and
the nonuniformity between adjacent risers shall not apply. Where a
nommiformity exceeds 3/16 inch between adjacent risers, the exact
location of the nonuniformity shall be indicated with a distinctive marking
stripe on each tread at the nosing or leading edge adjacent to the
nonuniform risers.
3. On stairways serving as aisles in assembly seating, where smaller
intermediate steps are provided between larger treads level with seating
platforms, such smaller intermediate steps shall have a uniform tread
depth of not less than 13 inches.
816.4.3 Winders: Winders shall not be permitted in required exit stairways except
in Use Group R-3 and stairways serving a single dwelling unit and in ornamental
stairways not required as an element of an exit. Such winders shall have a tread
depth of not less than 9 inches at a point not more than 12 inches from the side
where the tread is narrower and the minimum tread depth shall not be less than 6
inches.
816.5 Stairway guards and handrails: Stairways shall have continuous guards and
handrails on both sides, and in addition thereto, stairways more than 88 inches in
required width shall have intermediate handrails dividing the stairway into portions
not more than 88 inches wide. Only one handrail is required on stairways having a
width of less than 44 inches. Guards shall be constructed in accordance with Section
827.0. Handrails shall be constructed in accordance with Section 828.0.
816.6 Stair exit doors: Stairway exit doors shall comply with Sections 816.6.1
through 816.6.3.
816.6.1 Width: The minimum required width of every exit door to or from a
stairway shall be determined by the greater of the following criteria;
1. 28-inch clear width in buildings of Use Group R-3.
2. 36-inch minimum width of door leaf in buildings of Use Group I-2.
3. 32-inch clear width in all other cases.
4. The width required for the capacity of the stairway which serves the floor
area from which the exit door leads.

ARTICLE 10
FIRE PROTECTION SYSTEMS
(Ibis Article is entirely unique to Massachusetts)
SECTION 1000.0 GENERAL
1000.1 Scope: The provisions of this article shall specify where fire protection
systems are required in all buildings or structures or portions thereof.
1000.1.1 Authority: Plans submitted under Section 113.5 and Article 6 of this code
relative to this article shall be reviewed by the local fire official for approval of the
following items:
Y 1. source and capacity of water supply, including size of water main;
2. location of hydrants and siamese connections;
3. access for fire fighting apparatus and rescue vehicles;
4. provisions for a fire pump, if necessary, including electrical supervisory
control;
5. design and location of standpipes and/or sprinkler systems and related
equipment;
6. design and location of required fire alarm systems, including detection,
supervision, and all related equipment;
7. smoke control;
8. firefighter elevator key location and associated,equipment;
9. location and protection of furnace rooms, boiler rooms and rooms of
similar uses; and
10. fire access panels (see Section 1019.2.1.)
1000.2 Installation requirements: The installation methods, repair, operation and
maintenance of fire protection systems shall be in accordance with this code and the
BOCA National Fire Prevention Code and/or 527 CMR as applicable (listed in
Appendices A and G respectively).
1000.3 Maintenance: The owner, tenant or lessee of every building or structure
shall be responsible for the care and maintenance of all fire protection systems,
including equipment and devices, to ensure the safety and welfare of the occupants.
Fire protection systems shall not be disconnected or otherwise rendered

unserviceable without first notifying the fire department. When installations of
required fire protection systems are interrupted for repairs or other necessary
reasons,the owner,tenant or lessee shall immediately advise the fire department and
shall diligently prosecute the restoration of the protection.
1000.4 Threads: All threads provided for fire department connections to sprinkler
systems, standpipe systems, yard hydrants or any other fire hose connections shall
be uniform to those used by the local fire department.
1000.5 Signs: Where fire suppression control valves are located in a separate room
or building, a sign shall be provided on the entrance door. The lettering for such
sign shall be of a conspicuous color and shall be at least 4 inches in height, and shall
read.Sprinkler Control Valves or Standpipe Control Valves or indicate other types of
systems (see Sections 1012.4.1 and 1014.8 for additional signs).
1000.6 Tests: Where required by this article and the standards referenced herein,
all flow test connections and points of fluid discharge shall be reasonably accessible
and acceptable to the administrative authority.
SECTION 1001.0 PLANS AND SPECIFICATIONS
1001.1 Required: Plans shall be submitted to indicate conformance with this code
and shall be reviewed by the department prior to issuance of the permit.
Note: Since the fire department is responsible for inspection for the proper
maintenance of fire protection systems in buildings, the administrative
authority shall cooperate with the fire department in the discharging of
responsibility to enforce this article.
1001.2 Plans: The plans and specifications submitted to the department shall
contain sufficient detail to evaluate the hazard and the effectiveness of the system.
The details on the hazards shall include materials involved, the location and
arrangement, and the exposure to the hazard.
1001.3 Calculations: The details on the fire protection system shall include the
design considerations, calculations and other information as required by this code.

Legal Remedies for Tenants of
Residential Housing
The following is a brief summary of some of the legal remedies tenants may use in order to get housing code violations
corrected:
1. Rent Withholding(Massachusetts General Laws,Chapter 239,section 8A): If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in
your rent.
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent into court if a judge orders you to pay iL (For this, it is best to put the
rent money aside in a safe place.)
2. Repair and Deduct(Massachusetts General Laws,Chapter 111,section 127L):The law sometimes allows you to use your rent
money to make the repairs yourself.If your local code enforcement agency certifies that there are code violations which
endanger or materially impair your health,safety,or well-being,and your landlord has received written notice of the violations,
you may be able to use this remedy.If the owner fails to begin necessary repairs(or to enter into a written contract to have them
made)within five days after notice or to complete repairs within 14 days after notice,you can use up to four months'rent in any
year to make the repairs.
3. Retaliatpry Rent Increases or Evictions Prohibited(Massachusetts General Laws,Chapter 186, section 18,and Chapter 239,
section 2A): The owner may not increase your rent or evict you in retaliation for making a complaint to your local code
enforcement agency about code violations.If the owner raises your rent to tries to evict within six months after you have made
the complaint,he or she will have to show a good reason for the increase.or eviction which is unrelated to your complaint. You
may be able to sue the landlord for damages of he or she tries this.
4. Rent Receivership(Massachusetts General Laws,Chapter 11,section 127 C-H):The occupants and/or the Board of Health may
petition the District or Superior Court to allow rent to be paid into court rather than to the owner.The court may then appoint a
"receiver"who may spend as much of the rent money as is needed to correct the violation.The receiver is not subject to a
spending limitation of four months'rent.
5. Breach of Warranty of Habitability: You may be entitled to sue your landlord to have all or some of your rent returned if your
dwelling unit does not meet minimum standards of habitability.
6. Unfair and Deceptive Practices(Massachusetts General Laws,Chapter 93A):Renting an apartment with code violations is a
violation of the consumer protection act and regulations,for which you may sue an owner.
