Dear Condo Owner:
For the last several years, Paula Mooney a unit owner
in your complex has had problems with her heating. The
unit has been inspected by Boston Gas , City of Salem Gas
Inspector, City of Salem Plumbing Inspector and by the
City of Salem Building Inspector and after having a
-conference on the subject it was agreed that the only
solution to solve the unknown problem was to have Paula
hire a 'heating -plumber and have -him perform test on each
unit .
This test will not involve any work whatsoever in the
units at -this time. He will only be checking- to see if
heating is working correctly, this should not take any
longer 'than one or two hours .
What this office is asking is that all unit owners
cooperate in allowing the test to be conducted by Paula
Mooney.
Paula Mooney will be contacting you in the near
future to coordinate this test . Please cooperate in this
matter .

My wife Cynthia and myself have been owner/occupants of 193
Lafayette Street, Unit #1 since July, 1988 . Since that time
we have been experiencing, along with other owner/occupants
of the Condominium Association, major problems as a result
of a transient boarding house situation which exists at 193
Lafayette Street, Unit #2, owned by Albert and Joyce
Rodenhiser on Saugus, MA. Currently and consistently four
( 4 ) unrelated tenents reside on individual rental agreements
- on a monthly per room basis with a three ( 3 ) person
turnover since August of 1988 .
As a result of discussions with Salem Housing Authority
staff, I am informed as to the coding of our building and
have copies of supporting documentation (see enclosure ) . As
we understand it, condominium units (a total of 6) of 193
and 195 Lafayette Street are defined as type R-3 districts
which restricts rooming and boarding to not more than two
persons . Consequently I am requesting your immediate action
as required to quicly enforce the R-3 designation partially
resolving our problem.
Efforts have been made both directly with the owners to no
avail . On going efforts continue as such a situation also
violates Condominium By-Laws and regulations as set forth in
the Master Deed. Problems also exist such as probable drug
dealings, late night loitering and frequent disturbances
from traffic, most of which can be attributed to the
situation as explained.
Please contact me as you require . Your swift attention is
greatly appreciated .

be used for no purpose other than for normal transit through

G. No sign, plaque or communication of any description
shall be placed in the window of or on the exterior of any Unit
or Common Area or Facilities by a Unit Owner without the prior
written reasonable approval of the Trustees.
Section '5 .20_. Water and Sewer Charces . Water
shall be supplied to all of the Units and the Common Areas and
Facilities through one or more building meters and the Trustees

10 . PURPOSE. . The Building and the Units and other
facilities therein are to be used for residential purposes
only. Any other lawful use may be made only with the prior
written consent of the Trustees . Residential use shall be
deemed to include incidental. accessory uses such as
professional offices , studios and the like , provided that the
general public enters by appointment and no nuisance is created

thereby. The Trustees s.hal.l have the right to terminate any
such Accessory Residential Use which they deem, in their sole
discretion, to' amount to a nuisance .
11 . RESTRICTIONS ON USE. Unless otherwise permitted by
instrument in writing' duly executed by the Trustees then in
office or if more than one Trustee , by a majority of the
Trustees then in office and pursuant to provisions of the
By-Laws of the Trust :
(a) No Residential Use shall be used for any purpose
other than a purpose permitted under Paragraph 10 above;
(b) No Unit shall. be used or maintained in a manner

contrary to or inconsistent with the provisions of this Master
Deed , the Trust , the By-Laws , or Chapter 183A.
(c) The richt of a Unit Owner to decorate his or her
Unit is subject to the right of the Trustees to control or
regulate any aspect of such decoration which , in the reasonable
judgment of the Trustees , when viel-;ed from outside of such

Unit , materially detracts from the aesthetic or architectural
integrity of the Buildings .
(d) All use and maintenance of Units shall be
conducte6 in a manner consistent with the comfort and

convenience of the occunants of the other Units .
(e) The exterior aesthetic of architectural integrity
of the Buildings and the Units shall be preserved and , to that
end , no ;change , addition , structure , projection , decoration or
other feature shall be erected , placed upon or attached to the
exterior of any such Unit or any part thereof without the prior
written consent of the Trustee .
(f) The right of a unit owner to sell , transfer , or
otherwise convey his or her unit shall not be subject to any

right of first refusal or similar restriction .
(,g) All leases or rental agreements for units shall be
*in writing and specifically subject to the N,aste.r Deed , the
- Declaration of Trust , the By-Laws and the Rules and Regulations
of the Condominium. No unit estate may be leased or rented for
a period of. less than thirty (30) days.

Solicitor regarding the garages you demolisehd at 193-195 Lafayette St.
While you are in violation of Salem's Demolition Delay Ordinance, the
structures you destroyed do not appear to have been significant and a
permit would likely have been granted quickly. Under these circumstances,
the Historical Commission plans no action in this matter.
In the future, however, do not demolish any structures until you have
contacted the Building Department and secured a demolition permit.

In response to your letter dated October 12, 1984, there are statements in
this communication which do not convey correctly my conversation with Mr. Ed
Pinanski .
1- This building is not at the present time two separate buildings, due to
the fact that the fire wall has opennings in it, which defeats its purpose.
2- I did not refuse the installation of a fire detection system, I said that
the system that will be installed, must conform with the type of occupancy
observed by me at the time of inspection.
3- Under Massachusetts General Law, Chapter 140, Section 22 , you are in fact
operating a "rooming house" , and you are at present in violation of that law.
You must be licensed to operate this type of business.
4- Your statement that, "these apartments are individually rented" , is only
partially correct. You can not have more than three(3) unrelated individuals
in any one (1) apartment at any one time, and you do. I have observed personal-
ly seven (7) people in one apartment at one time.

This is not a matter of me changing my position on this property, its your
better understanding of rights , laws and safety for people who rent from you in
this building and/or any other buildings that are owned by you in the City of
Salem.
In order to install a fire detection system at 193-195 Lafayette Street, accord-
ing to your standards , it will be required, from you, in writing the names of
each individual renting your apartments , their apartment numbers. An agreement
in writing that no individual will sub-let or take in boarders in their respect-
ive apartments.
The repair of the fire wall and the inspection thereof by the Building Inspector
and the Fire Inspector.

Then, and only then , will I reconsider my outlook on this jammed up fire trap.

As the result of an inspection of the premesis, structure, open land area,
or vehicle owned, .occupied, or otherwise under your control , the fol-
lowing recommendations are made .and shall serve as a notice of a violation
of the laws, ordinances, or regulations pertaining to the prevention of
fire and the protection of life and property.
1. This property lacks an approved system of automatic smoke detectors.
The detectors currently in use are of the battery type, and were found
to be inoperable due to lack of batteries.
2. The exitways of the building lack emergency lighting.
3. Rubbish has been allowed to accumulate within the exitways, and on
rear porches.
4. An accumulation of debris exists under the basement stairs on the Chase
Street side.
5. A conversion to gas heating units has been made in the recent past. Two
unused oil tanks remain in the basement area. These tanks shall be re-
moved in accordance with Fire Department regulations.
6. Uncovered rubbish barrels are being kept under the rear porches. Evidence
of burned materials exists in and around these barrels.
7. The rear porches appear to have serious structural defects.
8. You are in violation of the provisions of Chapter 140, Section 22, relative
to "Lodging House" definition.

Dear Condo Owner:
For the last several years , Paula Mooney a unit owner
in your complex has had problems with her heating. The
unit has been inspected by Boston Gas , City of Salem Gas
Inspector, City of Salem Plumbing Inspector and by the
City of Salem Building Inspector and after having a
conference on the subject it was agreed that the only
solution to solve the unknown problem was to have Paula
hire a heating plumber and have him perform test on each
unit.
This test will not involve any work whatsoever in the
units at -this time . He will only be checking to see if
heating is working correctly, this should not take any
longer than one or two hours .
What this office is asking is that all unit owners
cooperate in allowing the test to be conducted by Paula
Mooney.
Paula Mooney will be contacting you in the near
future to coordinate this test . Please cooperate in this
matter .

Dear Condo Owner :
For the last several years, Paula Mooney a unit owner
in your complex has had problems with her heating. The
unit has been inspected by Boston Gas , City of Salem Gas
Inspector , City of Salem Plumbing Inspector and by the
City of Salem Building Inspector and after having a
conference on the subject it was agreed that the only
solution to solve the unknown problem was to have Paula
hire a heating plumber and have him perform test on each
unit .
This test will not involve any work whatsoever in the
units at this time. He will only be checking to see if
heating is working correctly, this should not take any
longer than one or two hours .
What this office is asking is that all unit owners
cooperate in allowing the test to be conducted by Paula
Mooney.
Paula Mooney will be contacting you in the near
future to .coordinate this test . Please cooperate in this
matter .

On June 11 , 1987 I posted the above referenced property with Stop-Work Orders
as per section 122.0 Article 122. 1 and am now confirming in writing that you
are in Violation of Section 113.0 Article 113. 1 Commonwealth of Massachusetts
State Building Code, fourth edition.
In addition no structure over fifty (50) years old maybe demolished without
a review by the Historic Commission, see enclosure.
Please remove twisted steel angles in the sidewalk area and make sidewalk
safe for use.

demolition permits for certain buildings
Be it ordained by the City Council of the City of Salem, as follows:

uemolitibn Delay) of the Code of Ordinances is .hereby enacted as follows :
"The Director of Public Property shall receive applications for
demolition of buildings or structures , and, in 'accordance with
applicable l,atis or - regulations, issue permits for demolition of
buildings. subjec.t to the following restrictions :
(a) No permit for demolition of an existing building or structure
which is listed or eligible for listing on the National
Register of Historic Places, or which is located in an
established Historic District, created pursuant to this Code
of Ordinances, or which is fifty (50) or more years old,shall
be granted unless it is first submitted to the Historical
Commission for review and comment .

(b) Upon submission to the Historical Commission, the Commission,
within 30 days of such submission, shall issue a preliminary
recommendation regarding the granting of a demolition permit .
If the Commission issues a recommendation in favor of the
granting of such a permit , a demolition permit shall be
issued. If the Commission issues a recommendation in
opposition to the granting of such a permit for demolition, no
permit shall be issued until a more thorough investigation is
undertaken and a final written recommendation is provided by
the Commission. Such investigation and reco-.r.,endatior, shall
be complezed within 180 days of the original submission to the
Historical Commission.
(c) During said maximum one hundred—eighty (180) day period, the
Historical Commission shall meet with the property owner and
conduct such hearings or investigation as it may determine to
be necessary in the formulation of its written recommendation
regarding the granting of such permit. The Historical
Commission shall consider the following criteria in its
deliberations:
(1 ) The building or structure is of such interest or quality
that it would reasonably meet National , State or local
criteria for designation as an historic or architectural
landmark.
(2) The building or structure is of such unusual or uncom-mon
design, texture, or materials that it could not be
reproduced or be reproduced only with great difficulty
and expense .
( 3) The building or structure is of such architectural or
historic interest that its removal would be to the
detriment of the public interest .
(4) Retention of the building or structure would help
preserve and protect an historic place or area of
historic interest in the city.
(d) The Historical Commission shall , within said one hundred-
eighty (180) day period, issue a written recommendation to the
Director of Public Property and to the property owner,
regarding the granting of the permit for demolition. If no
such recommendation is issued within said period, the
Historical Commission shall be deemed to have recommended the
granting of said permit.
(e) In the case of a residential garage or storage shed (but
excluding carriage houses as defined in the Zoning Ordinance ,
Section II. B. ) , the Director .shall forward an application for
demolition of such a structure to the City Planner and a
representative of the Historical Commission. Within fifteen
(15) days of the receipt of such a request, the Director., the
City Planner,,.and the Historical Commission representative .
shall make a determination of the historical or architectural
significance of the garage or shed. If the structure is
deemed significant by a majority of these three (3)
individuals, the application shall be forwarded to the full
Historical Commission for review as outlined above. If the
structure is deemed to possess no historic or architectural
significance by a majority of these three (3) individuals, or.
if no action, is taken within the fifteen (15) day period, then
a demolition permit shall be issued.
(f) Nothing in this Ordinance shall supersede the regulations of
the State Building Code 780 CMR, Sections 123 .0 and 124.0
regarding Unsafe Structures and Emergency Measures .
.Section 2. Part II , Chapter 19, Article IV, Section 19-65 of the Code
of Ordinances is hereby amended by adding the following:
(h) To review and comment on any application for a demolition
' permit for any building or structure in the city which is
listed or eligible for listing on the National Register of
Historic Places , or which is located in an established
Historic District created. pursuant to this Code of
Ordinances , or which is fifty (50) or more years old.
"Section 3. This Ordinance shall take effect as provided by City
Charter.
