As you are aware the tenant(ScuttleButt's)has been using the roof area without a legal occupancy permit. In the past you have stated to my client Mr. Steve Faber that he must provide you with a police report before you could proceed. First I find this requirement a total disregard of the Commonwealth of Massachusetts Building Code(Sixth Edition). Any occupancy of a structure without proper occupancy permits the Building dept, should issue a Cease and Desist Order. This Tenant has a record of ignoring all requirements of the law as well as his lease. He has time and again lied to my client and your office. I do not understand why no formal action has been taken by your department. Tom St. Perrier delivered a copy of a letter informing Mr. Casio not to occupy the roof area. On Oct. 7, 1999 there was a table and chairs along with storage of bar supplies out on the roof. It is obvious Mr. Casio is not going to comply with the No Occupancy requirements. You also stated to Mr. Faber that if he obtained Photographs and a Police report documenting people out on the roof that you would close Scuttlebutt's until they complied. I have had Holstein Roofing from Holbrook Ma. (the original installer of the roof membrane) reinspect and do corrective work to the roof. Mr. Holstein informs me that due to foot traffic o0n the roof the 15 year warrantee is now void. He went on further to state that this roof will be lucky to last another 5 years(this was a 20 year roof). Mr. Faber has expended 3,000 to 4,000 dollars in repairs over the last year. Mr. Holstein also informed me that the original construction done by Mr. Casio under a permit issued to Mr. Steve Livermore( Casio's Architect)was improperly installed.No flashing or counterflashing where installed no sealing at the joints in the plywood siding etc. I have requested a full report from Mr. Holstein in writing and will forward a copy to your office. I have poi9nted out to Ms. Joanne Scott of the Health Dept.that the flooring in the Kitchen area and behind the bar area is not properly adhered. I also noticed that there was no membrane to prevent water from leaking into the downstairs tenant spaces. She informed me that she would have the flooring re-inspected but that the membrane issue is the Building Department's responsibility. I also reported that the floor drain in the kitchen area was not connected to a grease trap as required by the State Plumbing Code. Again she stated that that was beyond her jurisdiction. Your office is aware that sometime within the last two or three months Mr. Casio has installed a dance floor and stage platform within the establishment. This work was done without a Permit and with altering the existing Occupancy permit. When I discussed this with Tom St. Pierre from your office he informed me that the yearly inspection was coming up and the everything would be taken care of then. It is my opinion that the State Code requires that a permit be issued before work is done. This is a place of assembly and should a problem occur it could effect many people. Why your department allows Mr. Casio to do whatever he pleases is beyond me. Peter,in the past we have had discussions concerning the above problems. The differences noted are: • The general illumination in the show area indicated on the drawings is not installed. • The insulation of the roof was eliminated because, according to the tenant, the roof is insulated above the roof deck. • The gypsum wallboard ceiling, which is the responsibility of the landlord, has not been installed. It was determined prior to the start of construction that this work would not need to be completed until the roof deck was occupied by the adjacent tenant. • We indicated on our drawings that the electric panel was to be moved. According to the tenant, permission was given by the electrical inspector and the fire marshall to leave the panel in its original location. • We called for the ceiling framing at the toilets to be 2 x 10's at 16" on center. The ceiling was framed with 2 x 6's. This framing is acceptable provided the area on top of the toilets is not used for storage. • The emergency lights in the toilets are not installed. • The entrance door on our drawings was shown full height in the frame. In order to meet the condition that the door match the chiropractor's door around the corner in the same building, a T - 0" door was installed.
