in re : Land located at 15 Juniper Avenue, Salem, MA
Dear Mr. McIntosh:
Please be advised that this office is representing the
Shawmut Bank of Boston, N.A. as a prospective mortgagee of the above-
captioned property.
The prospective buyers of this property are Peter D. Marquis
and Lynnell A. Marquis , of Galway, New York. The current owners and
proposed sellers are Jean Paul Dionne and Jane E. Dionne.
The house in question was originally built as a summer camp
and has been on the site for at least 75 years .
Mortgagee banks, given the current market conditions , find
themselves in a position where it is necessary for them to sell their
mortgage notes in what is called a secondary market .
The secondary market has rather stringent conditions one of
which is the preparation of a plot plan to determine whether or not
the property falls within flood plain zoning and whether or not the
property conforms to the zoning ordinances for the municipality in
which it is located.
A plot plan of the above captioned was prepared at the request
of this office by Bay State Survey Service of Beverly. This plot plan,
a copy of which is attached hereto for your records, reveals not only
that the property falls within a flood hazard zone, but also that it
encroaches upon Juniper Avenue. A site examination of the premises
would reveal an enclosed porch which, although it does not extend over
the sidewalk, appears from the plot plan to encroach approximately 1611
upon the public way more commonly known as Juniper Avenue.

It is my opinion, that given the length of time that the pro-
perty has existed in this condition, a very strong argument could be
made in the Land Court that the present owners have title through
adverse possession. This , unfortunately, would take considerable time
and would be quite expensive.
In its present condition, given the conditions of the
secondary market, the property is unsaleable.
By means of this letter, I would request that you, as Director
of Public Property, review the same to see if it is possible to have
a 16" by 34 .25 ' section of land abutting this property declared as
surplus public property. In so doing, it is my hope that the City
Council and the Mayor would concur and allow a sale of said portion of
land to the current owners of the property.
It is my understanding that the City Council will be meeting
this week and I would hope that you might find it possible to declare
this strip of land as surplus property so that the Council could send
it to Community Development.
