I have reviewed your letters dated September 23 and 24, 1997, as well as, previous correspondence from your office to my client. On behalf of Ms. Welch, 1 apologize for the delay in responding to your letters. As I told you over the telephone, Ms. Welch has had some difficulty with the tenants on the second floor, which is the subject matter of your September 23 letter. The purpose of this letter is to explain what course of action Ms. Welch intends to take in this matter. First, I will describe some of the relevant facts. Approximately, a year or so ago, Ms. Welch had another difficult tenant, who was not paying rent. In response to Ms. Welch at to evict her, the tenant complained to the Building Department and the Health Department. As a result of those complaints and inspections by both Departments, Ms. Welch was ordered to make certain repairs to the building. She made a good faith attempt to make the necessary repairs, but for financial reasons she could not complete all of them, and meanwhile, the second floor apartment became vacant. In an attempt to bring in some money to not only make repairs, but to pay the mortgage, on or about September 1, 1997, Ms. Welch rented the second floor to the current five Salem State College students. Ms. Welch was not aware that by renting the premises to the five, unrelated students, she was in violation of the Zoning Ordinance. I would also note that the students promised to make certain repairs to the premises, including removing the debris from the second floor porch, as partial consideration for the rental. Almost from the beginning of their tenancy, the students have been a nuisance to Ms. Leo Tremblay October 21, 1997 Page 2 Welch, other tenants in the building and to neighbors. They make a great amount of excessive noise at all hours. In addition, they have a dog despite Ms. Welch's instruction not to have dogs or cats in the premises. In mid-September, Ms. Welch verbally informed the students that she intended to evict them because of there conduct. Soon thereafter, the students apparently complained to the Building Department and the Health Department. As a result, you determined that the students were illegally occupying the second floor and there were continuing violations of the Building Code. On September 29, 1997, Ms.Welch served the students with a Notice to Terminate Tenancy. On October 1, 1997, the Health Department inspected the premises and found several, albeit minor, Sanitary Code violations. After Ms. Welch received the notice of violations from the Health Department, she attempted to enter the second floor to make an inspection and to undertake repairs. She was verbally abused by some of the students and she was told to leave the premises. Ms. Welch intends to take the following course of action concerning the property. Today, I will be filing a Complaint with the Northeast Housing Court seeking a Court order to enter the premises for the purpose of making repairs. Ms. Welch will then make the repairs to the premises required by the Building and Health Departments. Finally, after November 1, 1997, as the Summary Process Rules require, I will commence a summary process action against the students.
