2009 IBC Code Review: 62 Jefferson Ave., Salem, Mass.
1. Building Construction Type is "Type V-13". The vast majority of exterior walls and demising
partitions are concrete block with a wood ro'6f. Small area of combustible exterior wall at
Unit 4 defines the Construction Type. R-I Zone, Special Permits for business occupancy
2. Non-Sprinklered building.
3. Existing approved fire detection and alarm system installed.
4. Per Section 906.2 building Use & Occupancy is "Factory Industrial, F1 moderate-hazard
occupancy. Automobiles and other motor vehicles." By Special Permit the decision of the City
of Salem Board of Appeals on December 5, 2013 allows the use of all four (4) Units to be "auto
repair, auto part sales, and boat and engine service" Business use other than auto was allowed
by Special Permit by the Board of Appeals on Spetember 23, 2005.
5. Currently the building has three (3) auto related occupancies and one (1) B Business Occu-
pancy. (Unit I is tented to a dog care company, no boarding) Per Table 508.4 'Required
Separation of Occupancies" separation between F-1 & F-1, B & B, and F-1 & B is "N", 0 hours
fire separation required.
6. Building complies with Section 503 "Allowable Building Heights &Areas" as it is under
8,500 square feet and one (1) story only for an F I Occupancy. Height is not more than 40 feet.
Note: Unit 2 has an enclosed "Mezzanine". Per Section 505.4.1 this mezzanine is not required
to be "open" as it has an occupancy load of less than 10 persons.
7. Building area is approximately 4,100 square feet. Per Table 1004.1.1 Industrial Areas re-
quired per person is 100 square feet. Total Occupancy Load of 40 is allowed.
8. Per Tables 1015.1 and 1021.2 number,ofExits.allowed from "spaces" and"stories" is one (1)
for Occupancies F-I and B with an Occupancy Load of 49 or less. All Units in building comply.
9. Building need not comply with 521 CMR at this time as renovation or change of occupancy
is not occurring. Also, current tenant businesses are not open to the public. Existing one (1)

This Department received a complaint regarding the parking of a trailer truck at your property on Jefferson Ave.
I looked back at previous three ZBA decisions and the Board made it very clear that no outside storage of
anything other than cars or boats was allowed. The cars were limited to five. You are directed to cease parking
the trailer truck immediately.
I would also like to remind you that all three previous zba decisions stats that you are to comply with all State
Statutes, ordinances, codes and regulations.The Building Code clearly states that no premise shall be occupied
or used prior to the issuance of an occupancy permit. You have moved in yet another tenant(C-J
Transportation) without an occupancy permit. I am dealing directly with your tenant to remedy this issue but
any further violations will be treated as Building Code violations.
If you feel you are aggrieved by the zoning order, your Appeal is to the Salem Zoning Board of Appeals. If you
feel you are aggrieved by the Building Code issue, your Appeal is to the Board of Buildings, Regulations and

referenced the property next door, that property is not owned by you and is a single family residence. You also
had more than 60 days that you could have contacted this office. It is clear that you are delaying compliance
with the Plumbing Code. As a licensed Plumber,you are aware of this requirement for a M.D.0 trap and
should have installed the M.D.0 trap before your tenant occupied the building. Failure to address this issue

Petition of MICHAEL MCLAUGHLIN requesting a Special Permit under Section 3.3.2
Nonconforming Uses of the Salem Zoning Ordinance to allow use of the property for auto repair,
auto part sales, boat and engine service, and auto body work, at the property located at 62
JEFFERSON AVE (RI Zoning District).
A public hearing on the above Petition was opened on November 20, 2013 pursuant to M.G.L Ch. 40A, 9 11.
The hearing was closed on that date with the following Salem Board of Appeals members present: NIS.
Curran (Chair), Mr. Duffy, Mr. Watkins, and Mr. Tsitsinos.
The Petitioner seeks a Special Permit under Section 3.3.2 Norco!l jjming Utes of the Salem Zoning Ordinance.
Statements of fact:
1. In the petition date-stamped October 30, 2013, the Petitioner requested a Special Permit to allow the
following nonconforming uses: auto repair, auto part sales, boat and engine service, and auto
bodywork, at the property located at 62 Jefferson Avenue.
2. bfr. Michael McLaughlin, the Petitioner, presented the petition for the property at 62 Jefferson
Avenue.
3. Mr. McLaughlin bought the existing auto repair building in 2006. Since that time he has appeared
before the Board of Appeals twice to request Special Permits for nonconforming uses for various
businesses that he has leased his space to.
4. The Petitioner is appearing to request a Special Permit to allow auto repair, auto part sales, boat and
engine service, and auto body work, so that he can lease his space to businesses suited to the building
without having to appear before the board for every new tenant. Additionally, the Petitioner has a
new tenant that operates a boat repair business, which the Petitioner would like to be allowed under
the Special Permit.
5. 'f he property is in an R-1 zoning district. The property is located in an area with other industrial and
commercial uses. The building itself is well suited to the types of businesses that the Petitioner is
seeking permission to have on the property.
6. The previous Decisions issued granting the two previous Special Permits had specific conditions
prohibiting outdoor storage, except storage of cars; towing/repossession of cars after l Iput; operating
hours after l Ipm (except in cases of emergency); and outdoor auto repairs.
7. Mr. Robert Dunham, 60 Jefferson Avenue, submitted a letter in opposition to the Petition. .Mr,
Dunham Submitted photographs supporting his letter, which demonstrated that the Petitioner has
been allowing outdoor storage, in violation of the conditions of the previous Special Permit.

The Salem Board of appeals, after careful consideration of the evidence presented at the public hearing, and
after thorough review of the petitions, including the application narrativc and plans, and the Petitioner's
presentation and public testimony, makes the following findings that the proposed project meets the
provisions of the City of Salem Zoning Ordinance:

On the basis of the above Statements of Fact and Findings, the Salem Board of Appeals voted four (4) in
favor (Ms. Curran — Chair, Mr. Duffy, Mr. Watkins, and Mr. Tsitsinos in favor) and none (0) opposed, to
approve the Special Permit to allow auto repair, auto part sales, and boat and engine service on the property,
subject to the following terms, conditions, and safeguards:
1. The Petitioner shalt comply with all city and state statutes, ordinances, codes and regulations.
2. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly
adhered to.
3. No auto body work shall be performed
4. No outdoor storage, except storage of cars or boats, is permitted. No more than five (5) cars or boats
may be Stored on site at a time.
5. The terms of this Board's two previous special permit decisions in March 200{) and September 2005
relative to this property are incorporated herein by reference unless specifically altered by this
decision.

A hearing on this petition was held on September 21, 2005 with the following Board
Members present:Nina Cohen, Chairman, Richard Dionne,Nicholas Helides, Bonnie
Belair and Robin Stein. Notice of the hearing was sent to abutters and others and notices
of the hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioner request a Special Permit to allow a Plumbing Business to replace existing
Automotive Shop for the property located at 62 Jefferson Avenue located in an R-1 zone.
The provision of the Salem Zoning Ordinance which is applicable to this request for a
Special Permit is Section 5-3 (2) (8)which provide as follows:
Notwithstanding anything to the contrary appearing in this Ordinance,the Board of
Appeal may,in accordance with the procedure and conditions set forth in Section 8-6 and
9-4, grant Special Permits for alterations and reconstruction of nonconforming structures,
and for changes, enlargement,extension or expansion, of nonconforming lots, land,
structures, and uses,provided however, that such change, extension, enlargement or
expansion shall not be substantially more detrimental than the existing nonconforming
use to the neighborhood.
In more general terms,this Board is, when reviewing Special Permit requests, guided by
the rule that a Special Permit request may be granted upon a finding by the Board that the
grant of the Special Permit will promote the public health, safety, convenience and
welfare for the City's inhabitants.
A. Special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other lands,
buildings or structures in the same district.
B. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise,to the petitioner.
C. Desirable relief may be granted without substantial detriment to the public good
and without nullifying or substantially derogating from the intent of the district or
the purpose of the ordinance.

The Board of Appeal, after careful consideration of the evidence presented, and after
viewing the plans, makes the following findings of facts:
1. Attorney William Quinn presented the petition and represented the following;
a. The owner Mike McLaughlin has operated this business franchise since
1997.
b. The business is presently being operated out of Beverly,Ma.
c. The subject site will be used for the operation of the business office and
Storage of material only.
d. There will be no retail use or visitation to the site by customers.
e. The use will be no more imposing than the former use as Bob's Carburetor
f. Two issues in the sale of the property to the petitioner are in the process of
being resolved. There is an encroachment issue as well as it was
determined that 2,750 sf of land located at 108 Jefferson Ave,presently
used for parking is owned by North Shore Medical Center.
g. A letter dated September 20,2005 from North Shore Medical Center was
presented indicating that discussions of a sale concerning the parcel are in
process.
h. Attorney Quinn also presented a plan dated September 16, 2005 by
Registered Engineer Gail Smith,attached to the letter showing eight
parking spaces on the parcel under discussion for conveyance.
i. Attorney Quinn also presented a parking requirement calculation for the
premises indicating; 3 on site employees, 6 company vehicles, gross floor
area excluding storage of 500 sf,indication a total of 8 spaces needed.
j. Attorney Quinn requested that consideration of approval of the petition be
conditioned upon the petitioner obtaining use of 8 parking spaces.
k. There will be no late night use of the premises and no hazardous materials
stored on site.
1. Another tenant,a used car business occupies the subject and will continue
to operate there. They have a license to have 10 cars.
m. The petitioner will renovate the facade.
n. There are 3 on street parking spaces.
On the basis of the above findings of fact, and on the evidence presented at the hearing,
the Board of Appeal concludes as follows:
1. Literal enforcement of the provisions of the ordinance would involve substantial
hardship on the petitioner.

4. Special conditions exist which especially affect the subject property,but not the

On the basis of the above findings of fact,the Zoning Board of Appeal voted 5 in favor
and 0 in opposition to grant the Special Permit requested, subject to the following
conditions.
1. Petitioner shall comply with all city and state statues, code ordinances and
regulations.
2. All requirements of the Salem Fire Department relative to smoke and fire safety
shall be strictly adhered to.
3. Petitioner shall obtain a building permit prior to beginning any construction.
4. Petitioner shall obtain a Certificate of Inspection.
5. All construction shall be done as per the plans submitted and approved by the
Building Commissioner.
6. Petitioner shall obtain approval from any City Boards or Commission having
jurisdiction including,but not limited to the Planning Board.
7. Petitioner shall obtain use of a minimum of 8 parking spaces.

detriment to the public good.
2. The requested relief does not nullify or substantially derogate from the
intent or purpose of the zoning ordinance.
3. In permitting such change, the Zoning Board of Appeals requires certain
appropriate conditions and safeguards as noted below.
On the basis of the above findings of fact and all evidence presented at the public hearing
including, but not limited to, the submitted documents and testimony, the Zoning Board of
Appeals concludes:
1. A Special Permit is granted to allow the expansion of a currently nonconforming use

A public hearing on the above petition was opened and closed on March 18, 2009 pursuant to
Mass General Law Ch. 40A, § 11. The following Board of Appeals members present: Robin
Stein(Chair), Richard Dionne, Bonnie Belair(alternate), and Jimmy Tsitsinos (alternate).
Petitioner seeks a Special Permit pursuant to Section 8-5 of the City of Salem Zoning

1 do not wish to be confrontational but wish to follow-up on the topic and tone of our
conversation on Thursday aune 19, 2008 at your.office. My understanding of that
conservation was that you felt that I failed to respond to your letter to call and speak with
you about a complaint involving my building at 62 Jefferson Ave.
I did of course receive and read that letter. I immediately reviewed the situation with the
person using my garage bay and reviewed the limits involved in the space rental. I also
checked and verified that there were no hazardous materials stored on the premises.
did not call you at your office to speak of the situation as your letter suggested I call and
speak with you if I had any questions. I had no questions as the complaint and the
resolution was obvious to me. (Please see copy of letter to verify statement.)
As a property owner and Salem business man I am well aware of the need to develop and
retain a good relationship with City Hall and the Building Inspector's office.
Please accept my apology if I failed to react to the meaning of your letter. I have sent Bob
Dunham a letter. I have included a copy for you to review which suggests that a
complaint which involves 62 Jefferson Ave. would best be handled by first calling the
problem to my attention.

Dear Bob,
1 would like to request that any future problems that pertain to the use of my building or
involving a tenant at 62 Jefferson Avenue be called to my attention personally. This will
lead to a positive result and good relations between neighbors in the future.
My part time girl did tell me that someone had come into the office and complained to
her about the garage bay rear use. She did not have a name or a business card to whom
that person was.
She told me to expect a phone call the next day from the individual that had stepped in.
Instead, I received a call from the assistant building inspector a few days later about an
abutter's complaint.
This was followed by a letter from the building inspector's office the following week
with a second complaint.
I was out of the country for two weeks in May and therefore may not have seemed
responsive to the issue in this time frame.
I would prefer to have a civil relationship with my next door neighbor and therefore
request personal notification to me, not my office staff or-employees on any issues that
might arise in the future. -

existing wood burning stove that exists at your location. After reviewing our information
it has been determined that this installation goes back quite a few years, in fact predating

allowable use, grand-fathered under the current code. The continued use of this device is
allowed, and no further permitting is required; provided that this device is not moved or

Records in this department show a Special Permit was granted
by the Zoning Board of Appeal in 1971 allowing the display and
sale of ten (10) motor vehicles at the above referenced property.
To the best of my knowledge this use has continued from that time
until 1990 when the license was allowed to.lapse. Should the property
remain unlicensed for twenty four (24) consecutive months the Special
Permit will lapse.
I am concerned however, as to where on the property the vehicles
are to be displayed. In the past there have been problems with regards

A hearing on this Petition was held on April 28, 1982 with the following
Board Members present: Douglas Hopper, Chairman, Messrs. Hacker, LaBrecque,
! Feeherry and Associate Member Luzinski. Notice of the hearing was sent to
abutters and others and a notice of the hearing was properly published in
the Salem Evening News in accordance with Massachusetts General Laws
Chapter 40A.
The Petitioner has requested a Special Permit to construct a 16' x 25'
concrete block addition to the southerly side of the existing non-conforming
structure at the site. The addition is to be used in connection with the
petitioner's automotive repair business.
The property is within an R-1 District; however, the property has for
many years been a non-conforming use and structure.
The provision of the Salem Zoning Ordinance which is applicable to this
request for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in
this Ordinance, the Board of Appeal may, in accordance
with the procedure and conditions set forth in Section
VIII F and IX D, grant Special Permits for alterations
and reconstruction of nonconforming structures, and for
changes, enlargement, extension or expansion of non-
conforming lots, land structures, and uses, provided,
however, that such change, extension, enlargement or
expansion shall not be substantially more detrimental
than the existing nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit
requests, guided by the rule that a Special Permit request may be granted
upon a finding by the Board that the grant of the Special Permit will promote
the public health, safety, convenience and welfare of the City's inhabitants.
The Board, after considering the evidence at the hearing on this matter,
makes the following findings of fact:
1) Petitioner's proposed addition was strongly supported by
Petitioner's neighbors and others. No neighborhood opposition
whatsoever was raised at the public. hearing.

2) Although the property is in an R-1 zone, it has for many years
been a non-conforming use and the proposed addition to the
property will have a negligible effect on the area.
3) The area in question has a number of other commercial properties.
4) There is adequate parking in the area.
5) There is, because of the topography of the land in question, a
partial natural buffer between this property and some of the
surrounding residences.
On the basis of the above findings of fact and on the ev3Aence presented
at the public hearing, the Board of Appeal finds (i) that the proposed use
of the property will not be substantially more detrimental than the existing
use to the neighborhood, (ii) that the proposed use of the property will
promote the public health, safety, convenience, and welfare of the City's
inhabitants, and (iii) that the proposed use of the property is in harmony
with the Salem Zoning Ordinance. Accordingly, the Board unanimously approved
the granting of a Special Permit to the Petitioners.
The Special Permit is therefore granted in accordance with the following
terms and conditions:
1) A 16' x 25' concrete block addition may be constructed.

Petitioner through Counselor John R. Serafini, appealed to the Board of Appeals for a
Special Permit to permit him to maintain for resale no more than ten (10) :•rotor vehicles
on his property at n62 Jefferson Avenue.
A hearing was held on this appeal on Monday, September 20, 1971 , pursuant to notices
mailed postpaid to the Petitioner, his attorney, Board members, abutters, and others, and
advertisements published in the Salem Evening News, advisinq..,Qj this hearing.
Counselor Serafini appeared for the Petitioner, and stated the case; his client was the
owner of the premises at n62 Jefferson Avenue and has operated a motor vehicle repair
shop for a number of years; the premises were formerly in an automotive zone, but as
a result of the 1969 rezoning, the premises became non-conforming.
Counselor Serafini presented a petition signed by all the neighbors of the Petitioner
approving of his application for the special permit.
Counselor Serafini stated that the Special Permit was necessary for the economic sur-
vival of his client, and also pointed out that the premises were kept in a neat and
clean manner and that the Petitioner operated his business in a fashion that was very
cognizance of the rights of others.
Councillor Joseph Ingemi and Councillor Jean Levesque and Councillor Michael Ruane
were all recorded in favor of this petition.
Board members present at the hearing were Mr. -Abbott, .Acting Chairman; Mr. Doyle,
Secretary; Mr. Boulger; and Associate Members-Mr. Tanch and Mr. Welch.
No one appeared in opposition.
T::e Board on the basis of the evidence, found that the Special Permit requested could be
granted without.in any way derogating from the intent of the ordinance and that the Special
Permit to maintain for resale no more than ten (10) motor vehicles was reasonable and
in view of the fact that the area occupied by the Petitioner was formerly an automotive
zone and thet tae surrounding area in general was commercial and automotive, on the
h_sis of this evidence, the Board unanimously voted to grant this Special Permit to maintain

Dear Mr. Ruscio:
Enclosed you will find a copy of a 1971 Zoning Board of Appeal
decision granting permission for the sale of motor vehicles at your
property located at 62 Jefferson Avenue. To the best of my knowledge
this Special Permit has continued to be kept active through January
of 1990 . I would caution you though, if the property is not licensed
for this use for twenty four (24) consecutive months, the Special
Permit will lapse and you will have to re-apply to the Board.

been issued by the Inspector of Buildings to park, store, or occupy a trailer
at the above referenced property.
A careful check of our records indicate there is not now, nor has there
ever been, such a permit issued.

DECISION ON THE PETITION OF F. ROBERT RUSCIO CONCERNING PROPERTY LOCATED AT�62.JBFFERSON
AVENUE IN AN R-1 DISTRICT.
A hearing on this petition was held on November 14, 1979 with the following Board
members present: James Boulger, Jr. , Chairman; Douglas Hopper; John Nutting; Joseph
Piemonte; and Edward Luzinski. Notice of the hearing was sent to abutters and others
and a notice of the hearing was published in the Salem Evening News on October 31.,
and November 7, 1979 in accordance with Massachusetts General Laws, Chapter 40A.
The Petitioner is requesting a variance to extend a non-conforming business at
62 Jefferson Avenue (R-1 District) by the construction of an addition 30 feet by 18
feet for the repairing of cars.
The petitioner operates a carburator rebuilding and repair shop on the premises
situated at 62 Jefferson Avenue abutting the property of New England Telephone and
Telegraph, Mikes Autobody Shop, Michaud Bus Lines and Titus Furniture Warehouse.
The petitioner is in an R-1 zone which was changed from an Industrial zone in 1965
and is now a non-conforming use in that zone. The area is predominantly commercial
and industrial.
Letters from City Councillors Martineau, Nowak, Centerino and O'Keefe in favor were
submitted. Six letters from abutters were submitted in favor. Councillor Stephen
Lovely appeared and spoke for the petitioner. He stated that all of the abutters
were for this petition. Mr. Ruscio was a good neighbor and this addition would
permit him to work out of the elements, the area is primarily commercial though
zoned R-1. His immediate abutter is the telephone company garage and they are not
affected by this addition. There was no opposition.
The petitioner submitted plans of the proposed addition.
The Board voted unanimously to grant the variance requested. The Board found that
even though the area is zoned R-1, the proposed extension of the non-conforming
use would be in harmony with the commercial and industrial character of the neighbor-
hood and that it could grant the variance without substantially derogating from the
intent of the Zoning Ordinance.
