Petitioner appealed to the Building Inspector for a permit to erect an addi-
tion to an existing building at 53 Jefferson Avenue and was refused said per.
mit as his plan showed that he could not allow the required distance to the
side boundary lines as specified by the City of Salem Zoning Ordinance .
j A hearing was held on this petition on July 23, 1968, pursuant to notices
1 mailed postpaid to the petitioner, abutters, Board Members, and others,
and advertisements published in The Evening News advising of. this hearing.
All Board members were present at the hearing. Herbert Gold, an official
of petitioning company appeared with his contractor, Richard Walsh of Bev-
erly, and they sta.ted the case.
No one appeared in opposition.
After due consideration thereof, the Board voted unanimously to have peti-
tioner present two complete sets of plans and a plot plan to the Building
Inspector, and no permit is to be issued until these are received and are-
approved by him.

Roof Load Capacity
Dear Mr. Fletcher:
This is to report on our investigation of the long-span
roof over the so-called Baler Room at the subject
processing plant.
The Baler Room is the section of the plant immediately
adjoining the Receiving Room. It was the Receiving
Room in which a partial collapse of the roof and sup-
porting block walls was suffered in the heavy wind and
snow storm last Friday, January 20, 1978 .
As discussed with you yesterday at North Shore' s office,
the company wishes to continue to occupy the Baler Room
and all the other sections of their premises not con-
tiguous to the Receiving Room. This will permit them
to continue operations, on a somewhat limited basis,
-- the roof failure can be investigated and the Receiving
Room redesigned, as necessary, and reconstructed.
To :this end, you have asked us to investigate the design
and construction of the Baler Roam.
DESCRIPTION
The Baler Room is 59 feet wide by 88 feet long inside.
Its walls are 12-inch concrete block. The maximum un-
braced height of bearing wall is 21'-6" . The roof
consists of long-span joists, 32 inches deep, spaced
at 7 '-3" , with a center-to-center span of 60 feet.
The Baler Room section of the plant was constructed in

1966 . Structural plans were by Harold C. Merrifield,
P.E. , of Melrose, ;now deceased. The joists are iden-
tified on the plans as 32LH10 .
CAPACITY OF STRUCTURE
According to the Standard Load Table adopted by the
AISC in June 1962 , the 32LH10 joists, at the span and
spacings indicated, are rated for a total safe uniform
load which is equivalent to 53 pounds per square foot
of roof.
Deducting a dead load of 18 psf, which
includes a 3 psf allowance for suspended
piping, joists have a capacity for snow
load of 35 psf. This meets the maximum
requirement of the Massachusetts Build-
ing Code.
As a check on the plans, we measured, at the site, the
actual size and thickness of the angle members comprising
the long-span joists. The results of these measurements
and our calculations of the stresses produced in the
members by the applied live and dead loads are given
on the attached computation sheets. These computations
also show that joists are adequate.
Additional computations show that the 22 gauge roof deck
and the supporting masonry walls are adequate for the
loads to which they can be subjected.
CONDITION OF BUILDING
During our inspection of the Baler Room yesterday after-
noon, we looked carefully for any signs of disturbance
which might have been caused by the recent maximum
loading or by the collapse of the remote end of the
Receiving Room. In my opinion, no such disturbance has
taken place.

SUMMARY
Based on our examination of the premises and supported
by our calculations, copies of which are attached, it
is my opinion that the Baler Room is entirely safe for
occupancy and that it and the other plant areas removed
from the locus of the recent collapse can safely be
certified for continued occupancy.

Dear Mr. Powers:
This is to inform you that at a regular meeting of the Conservation
Commission, held on Tuesday, February 20, 1979 a vote was taken,
five in favor, one abstain and none opposed that the owners of North
Shore Recycled Fibers Corp. , at 53 Jefferson Ave may be in violation
of Section VII, Wetlands and Flood Hazard Districts, subsection 4,
"Special Permit Uses."
Subsection 4 states "In the Wetlands and Flood Hazard Districts no
structure or building, including pipes and wells, shall be erected,
constructed, substantially improved, enlarged, or otherwise
created or moved;. . .unless all the following conditions are found
to exist as part of the granting of a Special Permit by the Planning
Board." -
North Shore Recycled Fibers Corporation is in a A3 Flood Hazard Zone
and failed to apply for a Special Permit from the Planning Board
before beginning construction.
The Conservation Commission is requesting that you, as the Zoning Enforcement
Officer, investigate this situation and report the resulting action
to the Conservation Commission within 14 days as outlined in Section IX,
subsection B of the Salem Zoning Ordinance.

At the time of issuance of the building permit for
reconstruction of the wing of subject building it
was not the opinion of this office that the work
proposed would represent "substantial improvement".
The reconstruction was done completely on the existing
foundation and only represented a very small percentage
of the entire existing building.

On Thursday, July 15, 1993, the Planning Board of the City of
Salem held a public hearing regarding the application of Nicholas
Fiore for a Special Permit under Section 7-16, Wetlands and Flood
Hazard Districts of the Salem Zoning Ordinance, with respect to a
proposal to regrade the existing slope and associated work within
a Buffer Zone at 6-8 Clark Avenue, Assessor ' s Map 3, Lots 117 &
118 .
At a special scheduled meeting of the Planning Board held on
Thursday, July 29, 1993, the Board voted by a vote of seven (7 ) in
favor , none opposed, to approve the application as complying with
the requirements of a Special Permit, subject to conditions:
1 . Conformance with Plan
Work shall conform to plan entitled, "Exhibit F, Notice
of Intent Plan in Salem, Ma For Nicholas Fiore" , dated
August 27, 1992, revised September 22, 1992 prepared by
Landmark Engineering & Survey, Inc. Michael J. Dononvan,
Professional Engineer
2 . Conservation Commission
Work shall comply with all requirements of Order of
Conditions issued by the Salem Conservation Commission on
September 24, 1992 - DEP File #64-209.
3 Board of Health
Work s all comply with all requirements of the Board of
Health approval dated July 12, 1993 ..
4 . Construction Practices
All construction shall be carried out in accordance with
the following Conditions:
a. No work shall commence before 8: 00 a.m. on weekdays
and 8 : 00 a.m. on Saturdays. No work shall continue
beyond 5: 00 p.m. There shall be, no work conducted on
Sundays or holidays.
b. All reasonable action shall be taken to minimize the
negative effects of construction .on abutters. Advance
notice shall be provided to all abutters in writing at
least 72 hours prior to commencement of construction.
5 . Violations
Any vi ation of these conditions shall result in
revocation of this permit by the Planning Board.
This Special Permit shall not take effect until a copy of the
decision bearing the certification of the City Clerk that twenty
days have elapsed and no appeal has been filed or that if such
appeal has been filed, and it has been dismissed or denied, is
recorded in the Essex County Registry of Deeds and is indexed in
the grantor index under the name of the owner of record or is
recorded and noted on the owner ' s certificate of title. The fee
for recording or registering shall be paid by the owner or
applicant.
