The Building Department recently became aware that the Rear Exit Access of Unit 3, at 10
Jefferson Avenue passes through a space that is being used by Maria's Place restaurant(Unit 4)
for storage, and as a location for a free-standing Commercial Ice Machine.
This condition is a violation of the International Building Code.
1014.2 Egress through intervening spaces.Egress through intervening spaces shall ...
not pass through adjoining or intervening rooms or areas,except where such adjoining rooms or areas and the area
served are accessory to one or the other... .
The Ice Machine also impinges on the means of egress pathway.
1017.2 Aisles in Groups B and M.In Group B and M occupancies,the minimum clear aisle width shall be
determined ...for the occupant load served,but shall not be less than 36 inches.
1018.2 Corridor width.The minimum corridor width shall be ... not less than 44 inches.
Exceptions ... Thirty-six inches ...with a required occupant capacity of less than 50.
The issues above must be resolved before Unit 3 can be opened for business. As it stands now,
Unit 3 is a non-compliant and incomplete space.
Failure to resolve the issues cited above will be construed as non-compliance and may result in
the issue of municipal tickets and fines as well as further enforcement actions.

It has come to our attention through our Field organization that the
Surrette Storage Battery Co. Inc., Jefferson Avenue, Salem, is having trouble
securing a license to rebuild their plant which was partially destroyed by
fire.
I understand this company employs approximately 40 people and has a yearly
payroll of over $100,000. We are informed that if the license is not granted
this company will not only move from Salem, but out of Massachusetts.
We have recently completed a survey which showed that at the end of 1949 there
were 60,000 less factory workers on Massachusetts payrolls than at the beginning
of the year. This represents approximately a 10 percent reduction in employ-
ment during the twelve-month period. 16,000 jobs were lost permanently through
liquidation and migration, and 44,000 were lost through reduced employment.
It is our primary purpose to keep Massachusetts an industrial state by retaining
all our present industries, and by encouraging as many new industries to come
here as possible. Industry pays two-thirds of the taxes of Massachusetts, and
95 percent of the primary payroll in the Commonwealth is from industry.
We feel it very important, therefore, when a situation arises in any of our
cities as has occurred in your city in regard to the Surrette Battery Company,
to urge that every possible step be taken to preserve this industry, these
40 jobs and this $100,000 payroll not only for the City of Salem, but for the
Commonwealth of Massachusetts.
We trust you will keep these facts in mind when considering this matter and do
everything within reason to help out this company.

Dear Sir;
In reply to your request for a rulimg relative
to the status of a building permit to the Surrette Storage
Battery Company , Salem . This permit was refused by you
and was then sent to the Board of Appeal . The Board of
Appeal by a vote of 4 in the affirmative and 1 in the
negative voted to annul your action .
It is my opinion that this vote is sufficient to
annul youra.ction and that a permit should issue. to the
SurretteeStorage Battery Company. I also su"�est that
a stipulation be entered into by you and. the Surrette
Storage Battery Company embodying the terms that the
Company will adopt recommendations of the Division of
Occupational Hygiene aimed at preventing odors emanating
from the plant .
This is an application for a permit to repair as the
result of a fire and the law in many decisions has made
a. distinction between reapirs and construction, altera—
tions and. reconstruction. As this building was less that
1011"o destroyed there appears to be no question that the
application falls into the repair classification .
The abutting landowners of the Company or one who
can prove injury are not without tleir rights and may

A hearing on this petition was held March 30, 1988 with the following Board
Members present: James Hacker, Chairman; Messrs. , Bencal, Fleming, Luzinski and
Strout. Notice of the Hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
The petitioner, represented by Attorney Phillip T. Durkin, is requesting a
Variance to allow service type uses on the second level of the property at 10
Jefferson Avenue. The property is currently utilized as a small shopping plaza
by virtue of the grant of a previous Special Permit by Board of Appeal. The
property is located in an R-2 zone.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would in-
volve substantial hardship, financial or otherwise, to petitioner;
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing and after viewing the plans, makes the following findings of fact:
1 . The petitioner has operated the shopping plaza since 1979 with
minimal impact of the abutting residential zone;
2. The petitioner has complied with most of the twelve ( 12) restrictions
contained in the 1979 Special Permit, and will immediately comply
with the remainder of those restrictions;
3. The concerns of the neighbors present at the hearing will be addressed
by the petitioner.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject
property but not the district generally;
2. Literal enforcement of the provisions of the Ordinance would involve
substantial hardship on the petitioner;

3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted 4-1 , Mr. Bencal opposed, to grant the
Variance requested, subject to the following conditions:
1 . All the twelve ( 12) restrictions contained in the Special Permit of June
15, 1979 remain in full affect and be complied with immediately;
2. Dumpsters to be located as per plans submitted and revised and shall be
enclosed with a masonry structure forthwith;
3. The compressor at the rear of the building shall be vented entirely
towards the Winthrop Street side of the property;
4. Petitioner shall obtain a building permit for any new work done at
the property;
5. All construction/alteration must comply with the Massachusetts Building
Code and the requirements of the Salem Fire Department.
The Board of Appeal, at its meeting of April 20, 1988, voted unanimously, 4-0,
to amend the above decision for the purpose of an administrative correction and
clarification, as follows:
DELETE: 3. The compressor at the rear of the building shall be vented
entirely towards the Winthrop Street side of the property.
ADD: 3. Petitioner is granted variances to allow all B-1 uses for the
second level as defined in Section V (4) of the Salem Zoning
Ordinance, with the exception of:
4e. stores selling liquor, beer, and wine for consumption off
the premises.
4s. restaurants and other eating places which do not serve
alcoholic beverages consumed on the premises ; and including
drive-in snack shops.

Dear Ms. Defrancesco:
Based on the plan review held at this office on July 23, 1990 regarding the
proposed food establishment at 10 Jefferson Ave. , the Health Department makes the
following comments in accordance with 105 CMR 590.000; State Sanitary Code,
Chapter X, "Minimum Sanitation Standards for Food Establishments". The following
was noted and/or discussed:
-Walls, floors and ceilings in food preparation, food storage warewashing areas,
and all walk-in refrigerators, dressing rooms, toilet rooms shall be constructed
of smooth non-absorbent easily cleanable surfaces. An example is stainless
steel, "glassboard" or equivalent material.
-You stated that the floor is to be covered with quarry tile and serviced by
floor drains.
-All equipment and utensils to be constructed of stainless steel or an equivalent
smooth easily cleanable material. Equipment to be installed with adequate
space surrounding it to allow for regular, effective cleaning.
-Accessible wall-hung handwashing sink(s) with liquid soap and paper towel.
dispensers to be installed in each food preparation and warewashing area.
Sinks used for food preparation or for warewashing shall not be used for washing
of hands or for any other purpose.
-In new establishments at least one (1) service sink or curbed cleaning faci_fity
with a floor drain shall be provided and used for the cleaning of mops or
similar cleaning tools and for the disposal. of mopwater. Handwashing or ware-
washing facilities or food preparation sinks shall not be used for this purpose
under any circumstances.
-The installation of exposed horizontal utility service lines and pipes on the
floor is prohibited. Exposed utility service lines and pipes shall be installed
in a way that does not obstruct or prevent cleaning of the walls, floors and
ceilings.

In accordance with the provision of Chapter 337 of the Acts of 1985 and Chapter 110, Section 3. of Mass.
