This condition is a violation of the International Building Code. 1014.2 Egress through intervening spaces.Egress through intervening spaces shall ... not pass through adjoining or intervening rooms or areas,except where such adjoining rooms or areas and the area served are accessory to one or the other... . The Ice Machine also impinges on the means of egress pathway. 1017.2 Aisles in Groups B and M.In Group B and M occupancies,the minimum clear aisle width shall be determined ...for the occupant load served,but shall not be less than 36 inches. 1018.2 Corridor width.The minimum corridor width shall be ... not less than 44 inches. Inc., Jefferson Avenue, Salem, is having trouble securing a license to rebuild their plant which was partially destroyed by fire. I understand this company employs approximately 40 people and has a yearly payroll of over $100,000. We are informed that if the license is not granted this company will not only move from Salem, but out of Massachusetts. We have recently completed a survey which showed that at the end of 1949 there were 60,000 less factory workers on Massachusetts payrolls than at the beginning of the year. This represents approximately a 10 percent reduction in employ- ment during the twelve-month period. 16,000 jobs were lost permanently through liquidation and migration, and 44,000 were lost through reduced employment. It is our primary purpose to keep Massachusetts an industrial state by retaining all our present industries, and by encouraging as many new industries to come here as possible. Industry pays two-thirds of the taxes of Massachusetts, and 95 percent of the primary payroll in the Commonwealth is from industry. We feel it very important, therefore, when a situation arises in any of our cities as has occurred in your city in regard to the Surrette Battery Company, to urge that every possible step be taken to preserve this industry, these 40 jobs and this $100,000 payroll not only for the City of Salem, but for the Commonwealth of Massachusetts. The Variance which has been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would in- volve substantial hardship, financial or otherwise, to petitioner; c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing and after viewing the plans, makes the following findings of fact: 1 . The petitioner has operated the shopping plaza since 1979 with minimal impact of the abutting residential zone; 2. The petitioner has complied with most of the twelve ( 12) restrictions contained in the 1979 Special Permit, and will immediately comply with the remainder of those restrictions; 3. The concerns of the neighbors present at the hearing will be addressed by the petitioner. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1 . Special conditions exist which especially affect the subject property but not the district generally; 2. Therefore, the Zoning Board of Appeal voted 4-1 , Mr. Bencal opposed, to grant the Variance requested, subject to the following conditions: 1 . Dumpsters to be located as per plans submitted and revised and shall be enclosed with a masonry structure forthwith; 3. The compressor at the rear of the building shall be vented entirely towards the Winthrop Street side of the property; 4. Petitioner shall obtain a building permit for any new work done at the property; 5. All construction/alteration must comply with the Massachusetts Building Code and the requirements of the Salem Fire Department.
