Dear Mr. Jennings,
Further to our meeting Monday March 24, 1997, I am attaching a copy of a Plot Plan for
1 Jefferson Avenue that you requested for your files. Please note the proposed addition
indicated on the drawing, which is approximately 65' x 70'.
• 1. I am asking for permission to remove the existing railroad siding tracks, ties and the
Dead Man at the termination of the tracks.
2. I am asking for permission to demolish the existing old wooden railroad platform and
existing roof above.
3. I am asking for permission to repair the existing loading dock and to construct a ramp
from that loading dock to ground level to facilitate the movement of a fork lift
between the existing building and the proposed addition.
4. I will, in the near future, be asking for permission to construct a steel warehouse
building on a poured, pile supported, concrete foundation. Drawings for the building
and foundation will be provided to you for your approval and comments when they are
completed.
Lastly, you requested a set of drawings for the existing.building indicating the various
rooms within the building including a list of tenants and their proposed uses. I submit
herewith those drawings for your review and comment. As work continues on the interior
of the building, I will keep you informed of what we are doing and seek your approval and
comments as that work progresses. Please feel free to contact me directly if you have any
comments, suggestions or instructions regarding our rehabilitation of this building.

Dear Mr. Stockwell :
This is to inform you and your tenant at the above-referenced
building, Northeast Provisions, Inc . , that on Monday, July 29 ,
1991, staff from the City' s Water Division, Department of Public
Services will, upon my instructions, disconnect the building at
1 Jefferson Avenue from the public water distribution system of
the City of Salem, unless any concrete action is evident by close
of business on Friday, July 26, 1991 at the site to comply with
the order (to cease wastewater discharge to the City' s storm
sewer) contained in my letter to you dated July 16 , 1991 .
As stated in that letter, discharges of fats, oil and grease (FOG)
and solid and putrescible residue from the chicken processing
operation of Northeast Provisions to public waterways of the
Commonwealth of Massachusetts and navigable waters of the United
States from this connection constitute a violation of State and
Federal laws, with substantial penalties for each such violation.
As the City of Salem could incur liabilities for such violations,
as the owner of the storm sewer, we cannot and will not allow such
discharge to continue.
Also as stated in the letter of July 16 , 1991, only industrial
cooling water or unpolluted process waters may be discharged to a
storm sewer or natural outlet, in accordance with Sec. 23-52 of
the Code of Ordinances of the City of Salem. Also, the permit un-
der which R.B. Hall Corporation, the previous tenant, operated as
a discharger to the South Essex Sewerage District (even though the
discharge did not actually occur) , is invalid for the current ten-
ant' s operation, and your facility would thus be in violation of
that permit as well .

In discussing this matter this morning with your attorney, I
learned that he has been unsuccessful in gaining your tenant' s
agreement to pursue the several permits that are necessary to al-
low the current operation to continue. I am, therefore, forced to
take the action stated above, after having duly notified both you
and your tenant, in my previous correspondence, of my intent so to
act.
To have to take this action is unfortunate, and I regret that the
lack of proper response by you or your tenant leave me no
alternative. However, as I stated in my letter of July 16, 1991,
the seriousness of the violation, and the resultant environmental
consequences of it, dictate that this action be taken.

Dear Mr. Stockwell :
This is to inform you and your tenant at the above-referenced
building, Northeast Provisions , Inc. , that on Monday, July 15,
1991 , staff from the City ' s Engineering Division, Department of
Public Services conducted dye tests at the building at 1 Jefferson
Avenue to determine the direction of flow of wastewater from the
industrial operation currently being conducted at the premises by
Northeast Provisions .
Based upon those tests , it was determined that, instead of being
connected to the sanitary sewer in Margin Street , the building
sewer is connected to a storm drain crossing the adjacent vacant
lot at the intersection of Margin Street and Jefferson Avenue,
which is the site of construction of the new Salem Police Head-
quarters building. The storm drain discharges , through a siphon
structure under the MBTA tracks , to the South River Channel under
Canal Street and, eventually, to Salem Harbor.
Discharges of fats , oil and grease (FOG) and solid and putrescible

sions to public waterways of the Commonwealth of Massachusetts and

tute a violation of State and Federal laws, with substantial

from said .connection must cease immediately upon your receipt of

this letter. If , within five (5) business days of your receipt of
this letter, we are not satisfied that such wastewater discharge
to the storm sewer has ceased, we will take whatever action we
deem necessary to physically remove said connection from the City
storm sewer .
You and your tenant are further advised that there are specific
permit application processes which must be followed by you to ob-
tain permission to effect a proper industrial wastewater connec-
tion to the City ' s sanitary sewer system, which is administered by
the Division of Water Pollution Control of the Massachusetts
Department of Environmental Protection -(DEP) and this office , as
well as to effect an industrial wastewater discharge to the sewer,
which is administered by the South Essex Sewerage District (SESD) .
The former permit process takes from 6 to 18 months for agency
review, hearing and action from the date of permit application
submittal .
To have to take this action is , indeed, unfortunate , and I regret
that the facts leave me no alternative. However, the seriousness
of the violation, and the resultant environmental consequences of
it, dictate that this action be taken, and that you act
immediately to comply with the order contained herein.
