Dear Inspector Strout: Attorney Kevin Daly has contacted me regarding his client's intended use of this parcel as a used car facility. Specifically, Attorney Daly's questions stem from concerns raised by Ward Three Councilor Joan Lovely. The questions relate to the appropriateness of this site for such a use. As you know, the parcel is in the B-4 District. 8-4 District: Wholesale and automotive business districts are intended to be those areas which serve the wholesale and automobile business needs related to the central development district. Appropriate Use in the District: Clearly, a used car dealership fits in the B-4 district. Such a use is permitted by right. See Salem Zoning Ordinance Art. V., Sec. 5-2(f)(2)(automobile, trailer and boat sales and service). , Parking Lot Regulations: Councilor Lovely asks about the applicability of Salem Code of Ordinances, Sec. 38-62 (Parking Lots). This provision requires a plan to be submitted to the Building Inspector and DPW for a lot to be used as a "parking lot for the accommodation of more than two vehicles." There is no definition of"parking lot" in either the Salem Code or the Zoning Ordinance. Not surprisingly, Webster's Dictionary defines it as "an area used for the parking of motor vehicles." More significant Webster's Dictionary defines park, "to leave temporarily on a public way or in a parking lot or in a garage." (emphasis added). Such a definition is consistent with the inference drawn from Section 38-62 which further addresses adequate entry and exit provisions. Although an owner of a used car lot would certainly like to have his cars sell that fast, I do not believe that such a situation Page Two of Two January 5, 2001 Inspector Strout RE: 108 Jackson Street relates to "park" in the sense of parking lot for vehicles —temporarily. Thus, it is my opinion that Section 38-62 is inapplicable. Multi-business Use of Parcel& Parking: I am not aware of restrictions in the Zoning Ordinance restricting the use of this building by more than one business. Councilor Lovely, however, raises the most important concern regarding multiply use —that of appropriate parking for both employees and customers. I am not aware of the nature of the other business(es) sharing this parcel. Adequate parking should be in accordance with the Salem Zoning Ordinance, Art. VII., Sec. 7-3. Although used cars is not a specifically defined use, the off-street parking provision does require the following for an automobile sales establishment, subject to the approval of the plans therefor by the city engineer: (1) Such area, where subject to wheeled traffic, shall be treated with bituminous concrete or equivalent surfacing and shall have appropriate bumper or wheel guards where needed. (2) A solid wall or fence or compact evergreen screening five (5) feet high shall be erected along all property lines abutting residential uses. (3) Any light used to illuminate said parking area shall be so arranged as to reflect light away from adjoining premises and streets. See Salem Zoning Ordinance, Art. VII., Sec. 7-3(i) Sidewalk Maintenance: The Code of Ordinances specifically requires that sidewalks be kept in repair by the director of public services at the expense of the city. See Salem Code of Ordinances, Section 38-165. Certainly, no cars ought to be parked on the area designated as the sidewalk. Hopefully, this information is helpful to you. Equipment to be installed with adequate space surrounding it to allow for regular, effective cleaning. -Salad unit to be placed between 3-compartment sink and hand sink. Should be relocated or barrier to be installed to effectively prevent cross contamination. -Ceiling and walls in mop room to be finished with smooth easily cleanable surfaces.
