I have viewed the above referenced location and do not believe that business is being conducted on City property. At the time of my visit all vehicles were parked on private property. The "hot top"sidewalk(5 ft.wide) required by the City is in good condition and does not need replacement. The City installed the curb cut (driveway), many years ago for parking when the building was used as a restaurant. I interpret you reference to a sidewalk to mean granite or hot top curbing which could be installed if requested, and paid for,by the owner. Please call if you require additional information. Also, the existing curbing appears to have been removed years ago when the property was being used to operate a restaurant to allow for additional off street parking spaces . Under the Salem Zoning Ordinance the existing curb cut exceeds the maximum opening allowed but is not enforceable because it existed prior to the change in use of the property and was not a condition of the change in use . If the Licensing Board wishes to set a condition to license for the curbing to be installed, then the request would need to be directed to City Engineer and paid for by the owner .
