The parties in this matter appeared before the Court on this date and did report a modicum of
progress in seeking to bring the premises in.question into compliance with the law.
Based upon progress made to date,the following is now ORDERED:
1. The parties shall reappear before this Court at 9:00 a.m. on Monday,December 2, 2009.
2. Prior thereto the defendant shall have accomplished the following:
A. Obtained a valid state inspection sticker for a 1981 BMW 633 CSI including having a
necessary and defective light bulb replaced on said vehicle;
B. Obtained a valid inspection sticker for a Mitsubishi Eagle including having engine noise
associated with said vehicle remedied.
C. In the event either vehicle does not have a valid state inspection sticker affixed to it by
November 30,2009 said vehicle(s) SHALL be removed off of the premises at 8 Irving Street,
Salem, Massachusetts immediately thereafter by the defendant.
D. All used tires currently located on the premises shall have been removed and properly
disposed of by November 30, 2009.
E. All refuse and debris located in, on or about the wooden registered trailer currently on the
premises-shall have been removed and properly disposed of by November 30, 2009.

charges in this matter dismissed and any accrued fines remitted. Failing the same, fines shall

Findings and Order:
This matter has again come before the Court on status review.. As of this date,the city building
inspector reports that there remain some five(5)motor vehicles in question on or about the
defendant's property which are in violation of the city's ordinance,viz:
One vehicle is parked on the street with a dealer's.number plate affixed to it.
Three vehicles appear to be registered and insured but do not have valid inspection stickers
affixed to them.
One vehicle appears to be unregistered and uninsured and has no valid inspection sticker attached
to it.
At this time,the following ORDER is now issued:
V1. The building inspector shall have the owner of the vehicle which is parked on the street with a
dealer's number plate on it removed forthwith by contacting the party to whom the dealer's plate
is registered and advising that party to remove the vehicle at this time. Failing the same,the
vehicle shall be towed from the site by the Salem Police Department and placed in storage for
recovery by the owner or sale via mechanic's lien for failure to pay towing and storage charges.
The building inspector shall also conduct a general inspection of the exterior of the defendant's
property at 8 Irving Street, Salem,Massachusetts and report back to this Court any other obvious
building,zoning,health or fire code violations allegedly being maintained on the property by the
defendant.
2. The defendant SHALL by November 18,2009 have any and all vehicles located on premises at
8 Irving Street, Salem, Massachusetts duly registered, insured and inspected or otherwise housed
in compliance with Section 24-21 of the city of Salem's ordinance. Failing the same, fines shall

commence at a rate of fifty($50.00)dollars per day beginning on November 19,2009 for every f 1
day that each vehicle shall be stored at 8 Irving Street, Salem,Massachusetts by the defendant /
and in violation of the city's ordinance.

The purpose of this letter is to inform you that I feel aggrieved by the
notices and am responding as directed in one of them. I do this to request a
hearing to explain the facts concerning my collection of antique vintage classic
cars several of which are very rare examples of their marques.
Four of the vehicles range from 25 to 32 years old and are classified as
antique vehicles by the Massachusetts Registry of Motor Vehicles. Four of them
were constructed using acrylic( fiberglass like material) bodies. I belong to
several specific automobile owners clubs for my vehicles and I have complete sets
of monthly newsletters and national magazines relating to the various specific
marques. These contain articles on vehicle maintenance and owner experiences
with their vehicles and the solution of any service problems that might arise.
Among the various periodicals to which I subscribe is the bible of
vehicular collection"Hemmings Motor News" famous for offerings of thousands
of vehicles in hundreds of makes dating from 1900 until the present. At any
hearing I will copy the pages of advertising of the various makes showing the
relative offered price structure and detailed descriptions of vehicular condition
including mileage. As unbelievable as it may seem one of my vehicles has as few
as SIXTEEN HUNDRED(1,600)miles on it. I bought it from the dealer who
once sold the vehicles new had owned it since. I have never heard of an example
out of the total of four thousand ever produced in any of the three years they were
made with such low mileage. It is truly a rare thirty year old vehicle.
In July 2004 I underwent a spinal orthopedic back surgery procedure at
Salem Hospital and was unable to comfortably drive a manual shift everyday
vehicle which necessitated and required me to purchase automatic shift vehicles.
In the meantime my back pain has gradually improved to the extent that it is
possible to return to manual shift cars without severe discomfort. Several of my
daily transport automatic shift cars are for sale.
Please let me know the details of the hearing procedure so that I can amass
pictures, articles, descriptions newsletters and other material on my several cars.

Dear Sir.
1 thought It might be useful to give you some background Information
concerning my very long term Interest in automobiles. Before 1 was sixteen 1
had a friend who was restoring a'32 Ford coupe and 1 became interested In
cars and what made them run. When 1 turned sixteen and got my license 1 got
a two door 135 Ford rumbleseat roadster. Almost continually since then 1 have
owned one or more automobiles. Most of them were fairly plain machines
which provided not only as transportation but objects on which 1 was able to
Improve my mechanical skills. From flat head Fords to twin cam Cortlnas 1
found a hobby which for the most part kept me out of trouble.
Over the years 1 have accumulated a collection of tools which make the
work 1 attempt reasonably easy. I must admit to being a little overcome by all
the computerization now present in current motorcars. For that reason 1 have
concentrated on vehicles 25 years or older which are a little easier(especially
If you have a factory manual)to understand what Is going on inside them.
Among my vehicles aro two 35 year old Bricklins which were conceived
by Malcolm Bricklin based on American Motors (AMC) chassis and
mechanicals covered by an acrylic fiberglass type body which were
assembled in a plant in Nova Scotia. Only slightly over 4500 of those were
built most of which still survive today. They were priced ( some where around
$5000) to compete with the then current Corvettes and had a hard time
competing against General Motors. The Canadian Government which had
provided early financing decided not to continue with the project, and so the
production of one of the safest vehicles ever built came to an end. Because of
several safety features Including steel strengthening the Interior of the doors,
and crushable front and rear bumpers they were years ahead of the Industry.
They are so unusual that just recently a major TV Network carried a
sixteen week Saturday morning show on the restoration of a Bricklin from the
frame up. Because they used American Motors or Ford components of those
years parts are still available to restorers at reasonable prices.
1 have recently been cleaning out my garage with the objective of
working on one Bricklin and perhaps a smaller vehicle inside during the winter
months as well as a place to work on my vehicles.

With this in mind 1 am writing you as well as copies to go to both the
chiefs of the Salem Police and Fire Departments as well as Janet Short at the
Board of Health Dept. in the hope of getting a variance as you suggested
might be available to get some relief from the number of vehicles which are in
violation of various Salem statutes.
I am looking forward to your potentially favorable decisions in this
matter.

In response to a Salem Fire Department action, I was called to your property this
morning. The concern of the Fire Department regarding this structure was that there was
an excessive fire load within this building, and that there had been some life/safety
equipment that was either in-operable, or out of service. Lack of working fire protection
equipment causes this property to be determined an unsafe structure.
Under the Building Code, 780 CMR, Section 121 this structure has been deemed
unsafe, and therefore any and all Occupancy Certificates have been revoked. In order to
bring this property into compliance, permits will need to be filed for any work that is to
be done. Inspections by all various inspectional services will need to be accomplished.
These include, but are not limited to; Fire Prevention, Health Department, Plumbing and
Gas. Upon the completion of this work, and the appropriate sub-trade inspections, please
call this office for a final inspection. Once this final inspection has been accomplished,
and this property has met the requirements of this code, then we will be able to issue the
Required Certificate of Occupancy for this property.

Fire Chief or Police Chief or their authorized designees.
If approved, the approval is far no more than one year.

After receiving complaints from your neighbors about the condition of your garage and
yard, I reinspected your property again on December 4, 2000.
Div. 2, Section 12-56 unsightly conditions, it shall be unlawful for any person owning, or
having charge of any property, to fail to remove any unsightly condition from said
property.
This ordinance shall carry a$50.00 fine first offense, $100.00 fine 2°d offense, and
$300.00 fine 3`d offense each day a problem is not rectified shall constitute a different
offense.
These fines are municipal and shall go against the property, as a lien to the City.
Chapter 24 of the Salem Ordinance Code Section, 24-21 states;
No person shall park, store, or leave or allow that there be parked any unregistered motor
vehicle, trailer or boat for a period of more than fifteen (15) days.
If your vehicles are,not removed within fifteen (15) days, the City of Salem shall tow
your vehicles at your expense:

After receiving complaints from your neighbors about the condition of your garage and
yard, I reinspected your property again on December 4, 2000.
Div. 2, Section 12-56 unsightly conditions, it shall be unlawful for any person owning, or
having charge of any property, to fail to remove any unsightly condition from said
property.
This ordinance shall carry a$50.00 fine first offense, $100.00 fine 2°d offense, and
$300.00 fine 3`d offense each day a problem is not rectified shall constitute a different
offense.
These fines are municipal and shall go against the property, as a lien to the City.
Chapter 24 of the Salem Ordinance Code Section, 24-21 states;
No person shall park, store, or leave or allow that there be parked any unregistered motor
vehicle, trailer or boat for a period of more than fifteen (15) days.
If your vehicles are not removed within fifteen (15) days, the City of Salem shall tow

3. Electrical system gets repaired as soon as possible.
4. Vehicles get registered and inspected.
5. Boats and trailers get cleaned away. You're allowed 1 boat, I pram. Boat must be
registered. Boat over 12' motor or not must be registered.
6. Continued cleaning in the house must resume.
7. Smoke detector at the bottom of stairs.
8. A weekly inspection on Tuesdays with Building and Fire Departments to make sure
progress is being made in this situation.

Dear Mr. Coolidge:
As a result of a joint inspection of 8 Irving Street with the Health and Fire Departments,
we have found numerous violations with health,building and fire codes. There were far
to many to mention all of them. Every room in the house that was visible to us was
totally cluttered with boxes,paper products, wood and flammable materials. The outside
of the house was similar, 3 unregistered vehicles,4 boats and unregistered trailer. The
garage was filled with clutter, including dozens of tires, rims and at least 3 full containers
of gas.
After discussion with the Health and Fire Department, we decided it is imperative to
condemn this house for the safety of the occupant, Mr. John Coolidge.
780 CMR, 121.2 of the Massachusetts State Building Code. It appears that such building
or structure would be especially unsafe in case of fire, it shall be deemed dangerous
within the meaning hereof, and the building official may affix in a conspicuous place
upon its exterior walls a notice of its dangerous condition, which shall not be removed or
defaced without authority from him.
Mr. Coolidge may not be able to resume residency at this house until the Health,Fire and
the Building Department are satisfied with the situation.

Building Code, Section 123. (Unsafe Structures) . Both buildings are open to
the weather and are a potential fire hazard and must be secured.
You have twenty-four (24) hours upon receipt of this letter to secure the
prenises. Failure to do so shall result in this office taking legal action
and a lein shall be placed on the property.
