Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioners, owners of the property, are requesting variances to allow construction of an addition which will encroach on the rear of this property which is located in an R-1 district. The Variance which has been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the Land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner; and c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented and after viewing the plans, makes the following findings of fact: 1 . There was no opposition to the petition. 2. The proposed addition is to provide additional living space for a parent. On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: 1 . Special conditions exist which especially affect the subject property but not the district generally; 2. Literal enforcement of the Ordinance would work a substantial hardship on the petitioners; m 3. The 22' x 16' addition must be constructed in accordance with revised plans submitted June 6, 1989• 2. All requirements of the Salem Fire Department must be adhered to. 3. A Building Permit must be obtained. 4. A Certificate of Occupancy must be obtained. 5. The exterior of the proposed addition must be compatible with the existing building. VARIANCE GRANTED Peter A. This committee is making great s rides in making our City's neighborhoods safe,clean and attractive. The Health Department has received complaints regarding property a 11 Intervale Road, Salem, regarding an overgrowth of weeds and brush. Generally, this is consi ealth offense" unless there is also trash,waste and other debris in the overgrowth, there is an obstruction of the sidewalk,or the Fire Department considers it a fire hazard. However, such overgrowth may detract from the overall appearance of the neighborhood. We are also alerting the Building Inspector that there is evidence that wildlife may be entering the premises.
