Dear Mr. & Ms. Howe:
Please be assured that the property you referred to in you letter of
October 31, 1993 will revert back to its currently zoned use, with is
Residential Two Family (R-2) . The temporary use by the State will not
interfere.
You are quite correct in your understanding of the Zoning Ordinance
which states that if a use has been abandoned for two (2) years or more, it
reverts back to its existing zoning.
If I can be of any further assistance do not hesitate to contact me.

Dear Mr . Trembly,
As residents of Hubon Street , we would like to bring to your
attention that the parcel of land between Hubon and Thorndike
streets has lain vacant since February 1, 1991 . It is our
understanding, based upon a conversation that we had with a
member of your department in early 1991, that if this parcel of
land was not used as a construction storage yard for two years
that it would lose its zoning as such. It is our understanding
that it would then revert to the zoning determined in the 1960 "s,
which for this parcel of land would then be one or two family
house . We are writing to you now because it appears that the
State has rented this parcel of land to use for construction
storage for the building of the new bridge . We hope that at the
completion of the bridge project, or the State 's use of this
piece of land, the land will be used as zoned and not as a
construction yard .
Please accept our signatures as verification that this parcel of
land has lain vacant for more than two years .
Sincerely,
Catherine T . . Howe, Psy.D .

City/Town State Zip Code
The current exemption of "homeowners" was extended to include owner-occupied
dwellings of six units or less and to allow such homeowners to engage an in-
dividual for hire who does not possess a license, provided that the owner
acts as supervisor. (State Building Code Section 109. 1 . 1 )
DEFINITION OF HOMEOWNER:
Person(s) who owns a parcel of land on which he/she resides or intends to re-
side, on which there is, or is intended to be, a one to six family dwelling,
attached or detached structures accessory to such use and/or farm structures.
A person who constructs more than one home in a two-year period shall not be
considered a homeowner. Such "homeowner" shall submit to the Building Official ,
on a form acceptable to the Building Official , that he/she shall be responsible
for all such work performed under the building permit. Section 109. 1 . 1 )
The undersigned "homeowner" assumes responsibility for compiiance with the State
Building code and other applicable codes , by-laws, rules and reguiations.
The undersigned "homeowner" certifies that he/she understands the City of Salem
Building Department minimum inspection procedures and requirements and that
he/she will comply with said procedures and requirements.

NOTE: Three family dwellings 35,000 cubic feet, or larger, will be required
to comply with State Building Code Section 127.0. Construction Control .
w
HOME OWNER'S EXEMPTION
The Code states that: "Any Home Owner performing work for which a building
permit is required shall be exempt from the provisions of this section
(Section 109.1 .1 - Licensing of Construction Supervisors ) ; provided that is
a Home Owner engages a person(s) for hire to do such work, that such Home
Owner shall act as supervisor. "
Many Home Owners who use this exemption are unaware that they are assuming
the responsibilities of a supervisor (see Appendix Q, Rules and Regulations
for Licensing Construction Supervisors, Section 2. 15) . This lack of aware-
ness often results in serious problems, particularly when the Home Owner
hires unlicensed persons. In this case your Board cannot proceed against
the unlicensed person as it would with licensed Supervisor. The Home Owner
acting as supervisor is ultimately responsible.
To ensure that the Home Owner is fully aware of his/her responsibilities.
many communities require. as part of the permit application, that the Home
Owner certify that he/she understands the responsibilities of a supervisor.
On the last nage of this issue is a form currently used by several towns.
You may care to amend and adopt such a form/certification for use in your
community.
