Please note that we have a court date for the eviction of Mr. Coffill in room 31 on Wednesday the 11th of July. There have been several incidents in the building since eviction proceedings were initiated. Last week the shower head in this bathroom was stolen. We replaced that. Then the floor drain was clogged and the bathroom flooded. The manager, Mr. Wyde unclogged the draln and cleaned up. Next, the drain in the tub and floor were clogged. A handyman, Mr. Espinrla, opened up the drains with a normal snake at 12 am on Thursday morning. On Saturday at 1 am the tenant in room 12 called that there was leaking in her unit. Saturday at 8 am we began repairs. We saw the inspector around 11 am after returning from Home Depot to buy a heavy duty snake for the drain and again at 1:30 pm. Mr. Coffill stopped by later around 2:30 pm and threatened myself and the handyman and also laughed and told me to keep spending money. After being threatened, the handyman left and a different plumber had to be called to come and finished the job. The residents have agreed to keep the bathroom closed until after the court date. Mr. Coffill uses the 3rd floor bathroom. LeBlanc,Trustee 42 Brookside Avenue Danvers,MA 01923 Dear Sir/Madam: Our office was contacted to report that during an electrical event this past weekend, the Emergency Lights and Exit lights at 10 Howard Street failed to operate. An inspection of these premises was conducted by David Greenbaum from the Health Department and myself. It was determined that the Emergency Lights and Exit Signs are not in proper working order, and must be repaired immediately, under the provisions of 780 CMR, Section 103 and 780 CMR, Section 1023. These repairs must be done immediately, and will be re-inspected within ten(10)days of your receipt of this letter,to insure your compliance with this order. Also found during this inspection and requiring your attention are the following: 1. The Fire Door at the top of the front staircase(3rd Floor)was being held open, these doors should remain closed, and your tennents should be advised of the same. 2. All fire extinguishers are tagged 10/2003, and need to be re-inspected and properly tagged to reflect such. 3. During a check of our records prior to this inspection it was noted that in December of 1997 you were ordered to remove the gas meters from the Fire Exits, this has still not been done, and needs your immediate attention. 4. Our files show that this property is listed as having 15 Rooms for Rent, but my count of the numbered doors shows that there are in fact 16 Rooms, this needs to be addressed as well. 5. At the Rear Fire Exit from the Second floor there seems to be a mop bucket stored behind the door, which is not allowed as it does not allow for a clear and safe exitway;this practice must be immediately stopped. You have ten(10)days to make the necessary repairs to this property, failure to comply may result in a complaint being sought against you in Salem District Court. Thank you for your help in this matter. Tremblay Public Property Department City of Salem One Salem Green Salem, MA 01970 Dear Mr. Tremblay: Please be advised that I represent Alan T. Howe who has asked me to respond to your letter of February 17 . Mr. Howe acknowledges that Section 108-1 of the Massachusetts State Building Code empowers you as the "local inspector" to "enforce all of the provisions" of Salem's ordinances and by-laws regarding the use of all buildings within the City. (Emphasis supplied. ) Mr. Howe further acknowledges that in your letter to him, you have accurately transcribed the definition of "Kennel" as it appears in M.G.L. Chapter 140, Section 136A. Mr. Howe further agrees with Paragraph 3 of your letter acknowledging that the City of Salem has no zoning ordinance, by-law, or any other regulation respecting the maintenance of four or more dogs, three months old or older, for non-commercial purposes. However, Mr. Howe takes very serious issue with your demanding that he must apply for and acquire a Variance for keeping (if in fact he is) four or more dogs at 10 Chestnut Street when there is absolutely no prohibition against his so doing. Mr. Howe is particularly offended by your threat to take legal action against him if he fails to apply for a Variance. If you intend to carry on with your intentions as stated in your letter of February 17, or to take any other punitive action against him, he will view your actions as being discriminatory and violative of his civil rights. In this regard, he will hold you, as well as the City of Salem, responsible to him for damages, as provided by law. Ver tr yO rs Fr k S.
