Dear Bill:
As required by the Consent Judgement, I have reviewed the proposed
plans for the above—mentioned project and find that Mike Stasinos has
met the following conditions:
I . submittal of preliminary plans to the appropriate boards (d)
2. submittal of Environmental Impact Statement to the Board of
Appeal (f)
3. compliance with design standards for streets, easements, open
spaces and protection of natural features as set forth in
Sections IV & V of the Sub—division Regulations and approved by
the City Planner (h)
4. compliance with required improvements as set forth in Section IV
& V of the Sub—division Regulations as per review on Thursday,
Sept. 4th with Paul Niman, Bill Munroe, Bob Turner, myself and
Tom Rouleau (electrical plans still to be reviewed) ( i)

While some further issues need to be resolved, the cooperation we
have received to date from Mike Stasinos leads me to recommend that a
building permit be issued for a small percentage of the total project.
This permit would be granted with the understanding on Stasinos' s part
that he would comply with any changes that may be required at a later
date to meet the conditions of the Consent Judgement even if such
changes affect work already undertaken.

Dear Mr. Stasinos:
Due to the fact that several issues remain to be resolved regarding your
property located off 394 Highland Ave. (i.e. street names, neighborhood meeting,
- - etc. ) prior to the issuance of Building Permits, this office cannot issue the
permits presently applied for.
However, in view of your letter dated August 28, 1986 in which you state
that work undertaken prior to receipt of all necessary approvals will be done
at the risk of the developer, and City Planner, Gerard Kavanaugh's letter of
September 10, 1986 recommending that due to your cooperation, permits be issued
for a small percentage of the project, this office agrees to the following:
1 . Work may commence on the three thousand (3000) squar;g foot
building to be used as your construction office;
2. Work may commence on one (1 ) six (6) unit building.
I will again remind you that this work is undertaken at your risk and that
foundations for these buildings will not be backfilled without the approval of

Dear Bill:
Five months ago, a Consent Judgment was handed down by the Superior
Court regarding the so—called Stasinos project located at 394 Highland
Avenue. I am writing to you to request that certain conditions of that
Judgment be addressed because of the lack of compliance which currently
exists.
First of all, the developer has been required to deed to the City a
4. 1 acre parcel of land following the construction of soccer fields.
Obviously, we do not want the parcel deeded over until the required
improvements are completed. It would be advisable, though, to do the
following:
1. Request that the developer submit a detailed site plan of the
proposed improvements, including the fields, parking, and
landscaping for review and approval;
2. Request that the developer, upon approval of the plan, ,
immediately begin to construct such improvements; and
3 . Request that the developer execute an agreement with the City
specifying the timetable for the above steps.
In addition, the site plan was reviewed and approved by the City,
but the developer is now proposing changes in the approved plan. There
are several site design alterations proposed which must be reviewed and
approved again. In this regard, my specific concern relates to the
proposed internal vehicular circulation system in which several
improvements to provide adequate fire access have been eliminated.
These changes should be addressed, and a final decision should be made
regarding the adequacy of the altered plan.
Finally, the developer is required to complete a neighborhood
review process. Because of the above amendments to the plan, I believe
that the developer should hold an additional. neighborhood meeting to
review the current status of the project, and make certain that all
concerns of the neighbors are fully addressed. This meeting should take
place immediately.
I would respectfully request that you require these issues to be
resolved to our satisfaction immediately. If that cannot be done, I
would recommend that building permits be revoked.
Thank you for your cooperation in this matter.

It has been brought: to my attention that there has been a lack of compliance
with certain conditions of the Superior Court. Consent Judgement that effect 's
your property located at 394 Highland Avenue.
In order for this department to continue issuing Building Permits for your
project I must insist that you give the following your immediate attention.

Consent' Judgment-
Your letter of January 23 , 1987 , was referred to
my office, resulting in a conference with Mr. Stasinos ,
the developer.
The matters set forth in your letter, needing an
answer, were discussed.
No major changes were made in the original plan sub-
mitted to the City Engineer and approved by all concerned
departments . The minor changes, not contravening the inte-
grity of the original plan, were to minimize the impact
of the necessary blasting to the neighborhood .
The developer intends to comply with said original
plan; and, he intends to proceed without any changes .
Therefore , no revised site plan is contemplated,
requiring a neighborhood meeting.
A copy of the approved general plan will be submitted

Ladies & Gentlemen:
In response to the Council .Order of January 27 , 1987 regarding the
Court Judgement for property located at 394 Highland Avenue, I respectfully
submit the following.
Approval of the various sections of the conditions set forth lies with
the various Boards and Departments as specified. The only reference to the
Building Department being in Condition 2.0 which states that, "the City
Planner shall submit a written statement, of satisfaction of all such conditions
to the Building Inspector, City of Salem prior to the issuance of a Building
Permit."
In a letter dated October 21 , 1986 I was advised by the City Planner that
all conditions of the Consent Judgement had been met and that permits could be
issued. Based on this, permits requested were honored by this Department.
In a follow-up letter, dated January 20, 1987, I was advised by the City
Planner that, "certain conditions of the Judgement be addressed because of the
lack of compliance which currently exists." On January 23, 1987 , a letter was
hand delivered to Mr. Cris Stasinos,at the development site, outlining the City's
concerns and advising the developer that "no further Building Permits will be
issued for this project until these matters have been resolved to the satisfaction
of the City of Salem." This order still stands and will remain in effect until
such time as I am advised by the City Planner that all conditions have been met.

Dear Mr. Stasinos:
I have been informed by the City Planner that you have submitted a
new Site Plan,for review and approval, to his office.
I would call your attention to Section 115.3 of the Massachusetts
State Building Code which states, in part, "A lot or site shall not be
changed from that shown on the official site plan unless a revised plan
showing such changes shall have been filed and approved."
Until this matter is resolved I .must insist all work on this project
cease immediately upon your receipt of this Order.
Failure to comply with this Order will leave me no alternative but
to initiate the appropriate legal action. Be advised that conviction of
violation of the Massachusetts State Building Code carries a fine, not to
exceed One Thousand dollars ($1 ,000) a day for each violation and each day
the violation continues is a separate offense.

A hearing on this petition was held September 19, 1990 with the following Board
Members present: Richard Bencal , Chairman; Joseph Correnti , Richard Febonio,
Edward Luzinski and Mary Jane Stirgwolt. Notice of the hearing was sent to
abutters and others and notices of the hearing were properly published in the
Salem Evening News in accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property is requesting a twenty four month extension on
Condition 2(v) of a Consent Judgment that was entered into on August 18, 1986.
The property is located in a BPD District. The extension is requested to allow
the completion of the remaining units in the condominium project.
The Board of Appeal , after carefully considering the evidence presented, makes the
following findings of fact:
1 . All municipal services required by the Consent Judgment made on August 18,
1986 in Superior Court were installed within three (3) years from the date
of approval of definitive plans.
2. Construction of all of the proposed condominium units has not been completed
due to changes in economic conditions.
3. The petitioner acquired the property subject to the Consent Judgment and
requests a twenty four (24) month time extension to comply with that
Consent Judgment.
4. Several occupants and neighbors of the condominium complex spoke in favor
of the petition, citing improvements made by the petitioner once he acquired
an interest in the property.
5. A petition signed by ninety seven (97) individuals in favor of the extension
was presented for the record.
6. The construction thus far completed, coupled with changing economic conditions,
make this property unique within the zoning district and create a hardship
for the petitioner if the time extension is not granted.
Therefore, the Zoning Board of Appeal voted unanimously 5-0 to grant the 24 month
extension on condition all other conditions of the Consent Judgment made on April
18, 1986 in Superior Court be complied with.

I have been contacted by William and Thomas Katsepetsis who have purchased the
rights to the twenty six (26) remaining condos at the former Stasino's proiect
at 394 Highland Avenue regarding finishing these units.
Six (6) of the units are almost complete and an inspection of these units will
be made by the Building, Plumbing and Electrical Departments on Monday, May 19
1990 to determine what permits will be necessary to complete them. (Building
Permits expire in six (6) months when work has stopped) .
The remaining twenty (20) units willrequire new building permits at a cost of
three hundred, thirty three dollars ($333.00) per unit .
Tom Katsepetsis has stated that he will re-apply for the twenty units the first
of the week as they are needed as collateral for the lender.
A little back-ground on the brothers:
They are currently building four unit sub division of medium priced houses on
Malone Drive. Served as construction supers for Stasinos and own "Ornimental
Iron Company", a metal pre fabrication Co. in Danvers.
Will keep you advised.

3. PARAGRAPH #3 - The headers on the end units, as framed,
are more than adequate for the respective spans , and further,
the headers do not carry the entire roof as you have stated
in your letter. They, at best, carry approximately 25% of the
roof load.
4 . PARAGRAPH #4 - The chimney hanger nailing has been
corrected. The hangers are being nailed with two 8d nails
as recommended by the manufacturer.
Verification of the strength of the concrete,
structural lumber and the roof shingles are being forwarded
to you under separate cover.

Dear Chris:
In reference to your questions about the use of our products in the above
referenced units:
1. Web stiffeners or fillers are not required at the supports of the ASI
23 and 24 x 14" floor joists which are supported by the 14" WMI
(masonry type) connectors.
2 Attaching the ASI 22 x 914" beams used as roof rafters to the sloped
bearing plztes with at least two nails at each bearing and four nails
connecting overlapping flanges at the roof ridge is adequate attach-
ment for typical installations of our product, assuming the building
construction incorporates diaphragm connections for transfer of lateral
loads.
3. Concerning the "B" type unit, substituting ASI 24 x 14" joists in lieu
of the originally specified ASI 23 x 14", and keeping the spacings, loads,
and spans the same, an increase in stiffness of approximately 157 can be
expected.

To date we have not received an updated drawing. This separation is
needed on all buildings.
2. On prior inspection by our depa_rtrrent we found that the rav' ^ Sir
manufactures installation guide for ASI beams suh-nitted to this office
is not being used in construction. This fact was brought out and
discussed both with yourself and the manufactures representive Mir. Mabie
at an earlier meeting. To date we have no input as to the manner in which
these beams are being assembled and their integrity. Revised drawings and
engineered specs should be provided to us.
3. We have snre concern as to the headers at the end walls over the s
arched windows on your type "A" buildings. In that this header carries
a large lam beam and the entire roof fram, we were unable to determine
their bearing to foundation or transfer of load. Same header description
as found on sight (2x6 solid blocked, 2x10 hollow center) . Which is
appropriate and have .the needed correction been made on all buildings of
this design?
4. On inspection it was found that the straps which are required
as support to the zero clearance fireplace chimneys where improperly
nailed and or not nailed tightly. Have these straps been checked prior
• to covering up.
The report received does give us a mines eye picture of the current
! status but neglects to give grade and type of material used. This

Unfortunatly you have neglected to answer questions and concerns brought to
to your attention in our letter dated 3/5/87. Your response is required
in that we feel because of the deviation as described in our letter from
the plans submitted on application, we at this time are unable to determine
wether or not the structures now standing are safe. Please make your
response in writing to us promptly.
Be aware that reports are needed on a by-weekly basis. Attached is a
copy of your agreement as signed by you. Also, you will find a copy of

This letter will serve to acknowledge your report of the above project
and to address points we feel need further review.

' 1. On prior inspection by our department we found that no fire
walls separation was in place between chimney pipes within the ccanmon
• chimney boxes on building Rl and .'2. Has this probiem been corrected? `
To date we have not received an updated drawing. This separation is
needed on all buildings.
2. on prior inspection by our depot-nent we found that the rtv'
manufactures installation guide for ASI beams submitted to this office
is not being used in construction. This fact was brought out and
discussed both with yourself and the manufactures representive Mr. Mabie
at an earlier meeting. To date we have no input as to the manner in which
these beams are being assembled and their integrity. Revised drawings and
t engineered specs should be provided to us.
3. We have sane concern as to the headers at the end walls over the
arched windows on your type "A" buildings. In that this header carries
a large lam beam and the entire roof fram, we were unable to determine
their bearing to foundation or transfer of load. Some header description
as found on sight (2x6 solid blocked, 2x10 hollow center) . Which is
appropriate and have the needed correction been made on all buildings of
this design?
4. on inspection it was found that the straps which are required 01)
as support to the zero clearance fireplace chimneys where improperly
q nailed and or not nailed tightly. Have these straps been checked prior
to covering up.

Dear Bill:
At our meeting of department heads on Tuesday, March 24, 1987,
regarding the Stasinos condominium project, we reviewed a revised plan
(1A) . The major changes from Plan 1 to Plan IA were reviewed at that
time, and the following department head concerns with these changes were
defined as follows:
• 1 . The water line should be looped, but is not looped in the
revised plan;
2. Drive E should be provided with a hammerhead turnaround, as
previously defined; and
3 . Drives F and G should not include the turnaround spurs as
shown. _
T To address these concerns,- Mr. Stasinos has 'submitted another new
,'plan(1B). On this plan, the concerns of department heads are addressed
as follows: 1) The water main is once again looped; 2) a hammerhead
turnaround has been installed at the,end of Drive E; and 3) the
turna`rou'nd spurs previously shown 'on drives F and G have been
eliminated. The appropriate department heads including Paul. Niman, the
Director of Public Services, and Captain Robert Turner of the Fire
Prevention Bureau have reviewed this plan and agree that it satisfies
their concerns.

Dear Bill:
Five months ago, a Consent Judgment was handed down by the Superior
Court regarding the so—called Stasinos project located at 394 Highland
Avenue . I am writing to you to request that certain conditions of that
Judgment be addressed because of the lack of compliance which currently
exists.
First of all, the developer has been required to deed to the City a
4. 1 acre parcel of land following the construction of soccer fields.
Obviously, we do not want the parcel deeded over until the required
improvements are completed. It would be advisable, though, to do the
following:
1 . Request that the developer submit a detailed site plan of the
proposed improvements, including the fields, parking, and
landscaping for review and approval;
2. Request that the developer, upon approval of the plan,
immediately begin to construct such improvements; and
3 . Request that the developer execute an agreement with the City
specifying the timetable for the above steps.
In addition, the site plan was reviewed and approved by the City,
but the developer is now proposing changes in the approved plan. There
are several site design alterations proposed which must be reviewed and
approved again. In this regard, my specific concern relates to the
proposed internal vehicular circulation system in which several
improvements to provide adequate fire access have been eliminated.
These changes should be addressed, and a final decision should be made
regarding the adequacy of the altered plan.
Finally, the developer is required to complete a neighborhood
review process. Because of the above amendments to the plan, I believe
that the developer should hold an additional neighborhood meeting to
review the current status of the project, and make certain that all
concerns of the neighbors are fully addressed. This meeting should take
place immediately.
I would respectfully request that you require these issues to be
resolved to our satisfaction immediately. If that cannot be done, I
would recommend that building permits be revoked.

It has been brought to my attention that there has been a lack of compliance
with certain conditions of the Superior Court. Consent Judgement that effect's
your property located at 394 Highland Avenue.
"In order for this department to continue issuing Building Permits for your
project I must insist that you give the following your immediate attention.
1 . Submit a detailed site plan of the proposed soccer field's improvements

2. Immediately upon approval of the plan's, start construction on these
improvements.
3. That an agreement with the City of Salem must be executed specifying

Ladies & Gentlemen:
In response to the Council .Order of January 27, 1987 regarding the
Court Judgement for property located at 394 Highland Avenue, I respectfully
submit the following.
Approval of the various sections of the conditions set forth lies with
the various Boards and Departments as specified. The only reference to the
Building Department being in Condition 2.0 which states that, "the City
Planner shall submit a written statement of satisfaction of all such conditions
to the Building Inspector, City of Salem prior to the issuance of a Building
Permit."
In a letter dated October 21 , 1986 I was advised by the City Planner that
all conditions of the Consent Judgement had been met and that permits could be
issued. Based on this, permits requested were honored by this Department.
In a follow-up letter, dated January 20, 1987, I was advised by the City
Planner that, "certain conditions of the Judgement be addressed because of the
lack of compliance which currently exists." On January 23, 1987, a letter was
hand delivered to Mr. Cris Stasinos,at the development site, outlining the City's
concerns and advising the developer that "no further Building Permits will be
issued for this project until these matters have been resolved to the satisfaction
of the City of Salem." This order still stands and will remain in effect until
such time as I am advised by the City Planner that all conditions have been met.

Dear Mr. Stasinos:
I have been informed by the City Planner that you have submitted a
new Site Plan,for. review and approval, to his office.
I would call your attention to Section 115.3 of the Massachusetts
State Building Code which states, in part, "A lot or site shall not be
changed from that shown on the official site plan unless a revised plan
showing such changes shall have been filed and approved."
Until this matter is resolved I :must insist all work on this project
cease immediately upon your receipt of this Order.
Failure to comply with this Order will leave me no alternative but
to initiate the appropriate legal action. Be advised that conviction of
violation of the Massachusetts State Building Code carries a fine, not to
exceed One Thousand dollars ($1 ,000) a day for each violation and each day .
the violation continues is a separate offense.

Defendant Board of Appeal be amended and that its decision be
entered granting a variance with the following conditions :

subsequent petition presently before the Defendant Board of Ap-
peal , with prejudice , upon final approval of this Agreement for
Consent Judgment by this Court.

of the subject project , shall meet all required improvements , as set
forth in Section IV and V, sub-division Regulations , City of Salem.
j ) That a neighborhood review process shall be initiated
between the Plaintiff , neighborhood residents and the City Planning
Department , City of Salem, through which a neighborhood meeting shall
be held to review the project and its components and necessary changes
and alterations to such plans shall be made as requested within the
parameters of the approved variance .
.k ) The Plaintiff shall contribute to any and all proposed
traffic improvements on the Highland Avenue-Swampscott Road area , as
defined by the City through its ComprehensiveTraffic Study now being
undertaken. Such a contribution shall be made with the approval of the
City Planner according to a formula designed such that all developments
within the surrounding geographical area shall fairly share such costs .
1 ) The Plainitff shall be required to reserve a strip of
land to be defined by the City, along Highland Avenue, for the future
widening of the roadway if deemed necessary by the Comprehensive Traf-
fic Study now being undertaken .
m ) The Petitioner, Mike Stasinos , amend his deed to the real
property located at 399 Highland Avenue , Salem, Massachusetts , and said
amendment to be a covenant not to build on any portion of said real es-
tate , other than on that portion utilized for 190 condominium units and
3 , 000 square foot building . Said amendment is to be approved in form by
the City Solicitor .
n ) That all exterior building designs , b�ui4lding locations ,
lighting , landscaping, infrastructure , and site planning and design
el-ements of the proposed development shall be subject to the review
and approval of the Board of Appeal and City Planner , City of Salem.
o ) That a buffer zone of 200 feet along the -.eastern boun-
dary of the property shall be created so that the abutters of Pyburn
Avenue and Madeline Avenue not be adversely impacted ; and , that in
order to eliminate any visual impact of the development upon the ab-
utting neighborhood , the proposed landscaping to screen buildings
from the residencese of the above avenues shall be revi-ewed and ap-
proved by the City Planner . The Plaintiff shall also provide that
there be no other access to the parcel other than from Highland Ave-
nue , prohibiting any access to said parcel from Appleby Road , Made-
line Avenue , Pyburn Avenue , Ravenna Avenue , or Sophia Road or any
other accepted public way.
P ) That there will be no attempted closure of the median way
on Highland Avenue , at the entrance of Ravenna Avenue by the develop-
er or Condominium Association .

o ) The Plaintiff shall relinquish the foundation and build-
ing permits , as issued by the City of Salem currently existing for

r ) That all water , sewer and drainage improvements on the
site shall be subject to the review and approval of the City Plan-
ner and Director of Public Services , City of Salem ; and , that all
issues and concerns regarding drainage and wetlands shall be re-
viewed and approved by the Conservation Commission, City of Salem.
s ) That an assessment of impact of the proposed project
on existing infrastructure services , including water , sewer and
drainage , shall be made by the City Planner and Director of Pub-
lic Services , City of Salem. That upon such assessment, the Plain-
tiff shall make any necessary improvements , at his costs , if re-
quested by the City Planner and Director of Public Services . If
it is deemed that improvements are necessary, and attributable
to the project, to upgrade the existing wastewater pump station
on Ravenna Ave. said improvements shall be implemented by and at
the cost of the Plaintiff .
t ) If required by the State Department of Public works ,
the Plaintiff shall contribute the demanded funds for drainage
improvements proposed in the vicinity of Rich ' s Department Store ,
Highland Avenue , Salem, in ah effort to eliminate drainage pro-
blems found in the geographical area .
U ) That the City Planner shall submit a written state-
ment of satisfaction of all such conditions to the Building In-
spector, City of Salem prior to the issuance of a building per-
mit.
V ) That the Plaintiff shall complete all cosntruction
and install all required municipal services within three ( 3 )
years from date of approval of the definitive plans ; and , he
shall provide that the proposed construction will be in five
( 5 ) phases , all as provided for in the definitive plan to be
submitted for approval .
1 . That , in the work to be done on said pro-
ject , the General Contractor and all sub-contractors shall
restrict the performance of the work between the hours of
7 : 00 A. M. and 6 : 00 P.M. , Monday through Friday , excluding
work of a quiet nature . The hours for blasting shall be de-
termined by the Salem Fire Marshall .
2 . `'That the By-Laws' of the Condominium Assoc-
iation , to be executed and administered by the Condominium
Association , shall provide that all costs of trash collec-
tion and snow removal shall be paid for .by the Association .

the Definitive Plan with the Board of Appeal , shall also file

plans for the above—mentioned project and find that Mike Stasinos has

date to meet the conditions of the Consent Judgement even if such
changes affect work already undertaken.

Dear Mr. Stasinos:
Due to the fact that several issues remain to be resolved regarding your
property located off 394 Highland Ave. ( i.e. street names, neighborhood meeting,
etc. ) prior to the issuance of Building Permits, this office cannot issue the
permits presently applied for.
However, in view of your letter dated August 28, 1986 in which you state
that work undertaken prior to receipt of all necessary approvals will be done
at the risk of the developer, and City Planner, Gerard Kavanaugh's letter of
September 10, 1986 recommending that due to your cooperation, permits be issued
for a small percentage of the project, this office agrees to the following:
1 . Work may commence on the three thousand (3000) squar,g foot
building to be used as your construction office;
2. York may commence on one (1 ) six (6) unit building.
I will again remind you that this work is undertaken at your risk and that
foundations for these buildings will not be backfilled without the approval of
this department, as well as electrical and plumbing departments if services are
to be concealed by these foundations.
