I am writing to you to request that certain conditions of that Judgment be addressed because of the lack of compliance which currently exists. First of all, the developer has been required to deed to the City a 4. 1 acre parcel of land following the construction of soccer fields. Obviously, we do not want the parcel deeded over until the required improvements are completed. It would be advisable, though, to do the following: 1. Request that the developer submit a detailed site plan of the proposed improvements, including the fields, parking, and landscaping for review and approval; 2. Request that the developer, upon approval of the plan, , immediately begin to construct such improvements; and 3 . Request that the developer execute an agreement with the City specifying the timetable for the above steps. In addition, the site plan was reviewed and approved by the City, but the developer is now proposing changes in the approved plan. There are several site design alterations proposed which must be reviewed and approved again. In this regard, my specific concern relates to the proposed internal vehicular circulation system in which several improvements to provide adequate fire access have been eliminated. These changes should be addressed, and a final decision should be made regarding the adequacy of the altered plan. Finally, the developer is required to complete a neighborhood review process. Because of the above amendments to the plan, I believe that the developer should hold an additional. neighborhood meeting to review the current status of the project, and make certain that all concerns of the neighbors are fully addressed. This meeting should take place immediately. I would respectfully request that you require these issues to be resolved to our satisfaction immediately. Approval of the various sections of the conditions set forth lies with the various Boards and Departments as specified. The only reference to the Building Department being in Condition 2.0 which states that, "the City Planner shall submit a written statement, of satisfaction of all such conditions to the Building Inspector, City of Salem prior to the issuance of a Building Permit." In a letter dated October 21 , 1986 I was advised by the City Planner that all conditions of the Consent Judgement had been met and that permits could be issued. Based on this, permits requested were honored by this Department. In a follow-up letter, dated January 20, 1987, I was advised by the City Planner that, "certain conditions of the Judgement be addressed because of the lack of compliance which currently exists." On January 23, 1987 , a letter was hand delivered to Mr. Cris Stasinos,at the development site, outlining the City's concerns and advising the developer that "no further Building Permits will be issued for this project until these matters have been resolved to the satisfaction of the City of Salem." Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property is requesting a twenty four month extension on Condition 2(v) of a Consent Judgment that was entered into on August 18, 1986. The property is located in a BPD District. The extension is requested to allow the completion of the remaining units in the condominium project. The Board of Appeal , after carefully considering the evidence presented, makes the following findings of fact: 1 . All municipal services required by the Consent Judgment made on August 18, 1986 in Superior Court were installed within three (3) years from the date of approval of definitive plans. 2. Construction of all of the proposed condominium units has not been completed due to changes in economic conditions. 3. The petitioner acquired the property subject to the Consent Judgment and requests a twenty four (24) month time extension to comply with that Consent Judgment. 4. Several occupants and neighbors of the condominium complex spoke in favor of the petition, citing improvements made by the petitioner once he acquired an interest in the property. 5. A petition signed by ninety seven (97) individuals in favor of the extension was presented for the record. 6. The construction thus far completed, coupled with changing economic conditions, make this property unique within the zoning district and create a hardship for the petitioner if the time extension is not granted. Therefore, the Zoning Board of Appeal voted unanimously 5-0 to grant the 24 month extension on condition all other conditions of the Consent Judgment made on April 18, 1986 in Superior Court be complied with. To date we have no input as to the manner in which these beams are being assembled and their integrity. Revised drawings and engineered specs should be provided to us. 3. We have snre concern as to the headers at the end walls over the s arched windows on your type "A" buildings. In that this header carries a large lam beam and the entire roof fram, we were unable to determine their bearing to foundation or transfer of load. Same header description as found on sight (2x6 solid blocked, 2x10 hollow center) . Which is appropriate and have .the needed correction been made on all buildings of this design? 4. On inspection it was found that the straps which are required as support to the zero clearance fireplace chimneys where improperly nailed and or not nailed tightly. Have these straps been checked prior • to covering up. The report received does give us a mines eye picture of the current ! status but neglects to give grade and type of material used. This fact was brought out and discussed both with yourself and the manufactures representive Mr. Mabie at an earlier meeting. To date we have no input as to the manner in which these beams are being assembled and their integrity. Revised drawings and t engineered specs should be provided to us. 3. We have sane concern as to the headers at the end walls over the arched windows on your type "A" buildings. In that this header carries a large lam beam and the entire roof fram, we were unable to determine their bearing to foundation or transfer of load. Some header description as found on sight (2x6 solid blocked, 2x10 hollow center) . Which is appropriate and have the needed correction been made on all buildings of this design? 4. on inspection it was found that the straps which are required 01) as support to the zero clearance fireplace chimneys where improperly q nailed and or not nailed tightly. Have these straps been checked prior to covering up. I The report received does give us a mines eye picture of the current ,P status but neglects to give grade and type of material used. I am writing to you to request that certain conditions of that Judgment be addressed because of the lack of compliance which currently exists. First of all, the developer has been required to deed to the City a 4. 1 acre parcel of land following the construction of soccer fields. Obviously, we do not want the parcel deeded over until the required improvements are completed. It would be advisable, though, to do the following: 1 . Request that the developer submit a detailed site plan of the proposed improvements, including the fields, parking, and landscaping for review and approval; 2. Request that the developer, upon approval of the plan, immediately begin to construct such improvements; and 3 . Request that the developer execute an agreement with the City specifying the timetable for the above steps. In addition, the site plan was reviewed and approved by the City, but the developer is now proposing changes in the approved plan. There are several site design alterations proposed which must be reviewed and approved again. In this regard, my specific concern relates to the proposed internal vehicular circulation system in which several improvements to provide adequate fire access have been eliminated. These changes should be addressed, and a final decision should be made regarding the adequacy of the altered plan. Finally, the developer is required to complete a neighborhood review process. Because of the above amendments to the plan, I believe that the developer should hold an additional neighborhood meeting to review the current status of the project, and make certain that all concerns of the neighbors are fully addressed. This meeting should take place immediately. I would respectfully request that you require these issues to be resolved to our satisfaction immediately. Approval of the various sections of the conditions set forth lies with the various Boards and Departments as specified. The only reference to the Building Department being in Condition 2.0 which states that, "the City Planner shall submit a written statement of satisfaction of all such conditions to the Building Inspector, City of Salem prior to the issuance of a Building Permit." In a letter dated October 21 , 1986 I was advised by the City Planner that all conditions of the Consent Judgement had been met and that permits could be issued. Based on this, permits requested were honored by this Department. In a follow-up letter, dated January 20, 1987, I was advised by the City Planner that, "certain conditions of the Judgement be addressed because of the lack of compliance which currently exists." On January 23, 1987, a letter was hand delivered to Mr. Cris Stasinos,at the development site, outlining the City's concerns and advising the developer that "no further Building Permits will be issued for this project until these matters have been resolved to the satisfaction of the City of Salem." Such a contribution shall be made with the approval of the City Planner according to a formula designed such that all developments within the surrounding geographical area shall fairly share such costs . 1 ) The Plainitff shall be required to reserve a strip of land to be defined by the City, along Highland Avenue, for the future widening of the roadway if deemed necessary by the Comprehensive Traf- fic Study now being undertaken . m ) The Petitioner, Mike Stasinos , amend his deed to the real property located at 399 Highland Avenue , Salem, Massachusetts , and said amendment to be a covenant not to build on any portion of said real es- tate , other than on that portion utilized for 190 condominium units and 3 , 000 square foot building . Said amendment is to be approved in form by the City Solicitor . n ) That all exterior building designs , b�ui4lding locations , lighting , landscaping, infrastructure , and site planning and design el-ements of the proposed development shall be subject to the review and approval of the Board of Appeal and City Planner , City of Salem. o ) That a buffer zone of 200 feet along the -.eastern boun- dary of the property shall be created so that the abutters of Pyburn Avenue and Madeline Avenue not be adversely impacted ; and , that in order to eliminate any visual impact of the development upon the ab- utting neighborhood , the proposed landscaping to screen buildings from the residencese of the above avenues shall be revi-ewed and ap- proved by the City Planner . The Plaintiff shall also provide that there be no other access to the parcel other than from Highland Ave- nue , prohibiting any access to said parcel from Appleby Road , Made- line Avenue , Pyburn Avenue , Ravenna Avenue , or Sophia Road or any other accepted public way. That upon such assessment, the Plain- tiff shall make any necessary improvements , at his costs , if re- quested by the City Planner and Director of Public Services . If it is deemed that improvements are necessary, and attributable to the project, to upgrade the existing wastewater pump station on Ravenna Ave. said improvements shall be implemented by and at the cost of the Plaintiff . t ) If required by the State Department of Public works , the Plaintiff shall contribute the demanded funds for drainage improvements proposed in the vicinity of Rich ' s Department Store , Highland Avenue , Salem, in ah effort to eliminate drainage pro- blems found in the geographical area . U ) That the City Planner shall submit a written state- ment of satisfaction of all such conditions to the Building In- spector, City of Salem prior to the issuance of a building per- mit. V ) That the Plaintiff shall complete all cosntruction and install all required municipal services within three ( 3 ) years from date of approval of the definitive plans ; and , he shall provide that the proposed construction will be in five ( 5 ) phases , all as provided for in the definitive plan to be submitted for approval . 1 .
