DECISION OF THE PETITION OF THOMAS MCAULIFFE REQUESTING A VARIANCE
FROM THE PROPERTY LOCATED Ay 333 HIGH�D AVENUE B2�
A hearing on this petition was held April 21, 1999 with the following Board Members
present: Nina Cohen, Chairman, Richard Dionne, Michael Ward, Stephen Buczko and
Paul Valaskagis. Notice of the hearing was sent to abutters and others and notices of
the hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
The petitioner is requesting a Variance from side setback requirements in order to add
an addition to the existing building for the property located at 333 Highland Avenue.
The Variances which have been requested may be granted upon a finding by this Board
that:
1.Special conditions and circumstances exist which especially affect the land, building or
structures involved and which are not generally affecting other lands, buildings and
structures involve.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioners.
3. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district of the
purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1. The petitioner represented himself and presented plans of the addition.
2. This addition will house an elevator shaft and an additional 900 sq. ft. of office space.
3. A letter was sent in favor of the petition.
4. There was no opposition to the petition.

On the basis of the above findings of fact, and on, the presented at the hearing, the
Zoning Board of Appeal voted unanimously, 5 in favor, to grant the variances requested,
subject to the following condition;
1. Petitioner shall comply with all city and state statues, ordinances, codes and
regulations
2. All construction shall be done as per the plans and dimensions submitted.
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall
be strictly adhered to.
4. Petitioner shall obtain building permit prior to beginning any construction.
5. Exterior finishes of the new construction shall be in harmony with the existing
structure.
6. A Certificate of Occupancy is to be obtained.
7. Petitioner is to obtain approval from any City Board or Commission having
jurisdiction including, but not limited to, the Planning Board.

Massachusetts General Laws Chapter 40A, and shall be filed within 20 days after the
date of filing of this decision in the office of the City Clerk. Pursuant to
Massachusetts General Laws Chapter 40A, Section 11. The Variance or Special
Permit granted herein shall not take effect until a copy of the decision bearing the
certificate of the City Clerk that 20 days have elapsed and no appeal has been filed,
or that, if such appeal has been filed, that is has been dismissed or denied is
recorded in the South Essex Registry of Deeds and indexed under the name of the
owner of record or is recorded and noted on the owner's Certificate of Title.

On this day I inspected the progress of the work at the above site and the
following is a report of my observations and comments.
1. Project is estimated at 95% complete.
2. On this day, carpet was being installed and the carpenters were working on
the door by the reception desk.
3. All rough and finish carpentry items have been completed with the following
exceptions:
A. Hang doors and Hardware
B. Install counter top, superstructure and windows at reception desk.
C. Install cabinets at toilets and exam rooms.
D. Wood shelves and closet pole.
E. Coat hooks in reception area.
4. All finishes have been installed with the following exceptions:
A. Corridor and reception carpet
B. Baseboard
5. Electrical rough and finish work has been completed.
6. HVAC has been completed.
7. Plumbing fixtures have not yet been installed.

On this day I inspected the progress of the work at the above site an`—
the following is a report of my observations and comments.
1 . Concrete floor has been poured.
2. Metal stud framing of interior partitions should be completed today.
3. Partitions are properly braced to structure above. Approximately
90ro of gypsum board finish has been installed, with seams in the
process of being finished. Soffits over glass block exterior windows
have been framed out.
3• On site personnel were directed to raise the height of the window as
shown on Elevation A/sheet A3. Attention is also made to the contrac-
tor to verify the framing of Door No. 102 to include glass block side-
light.
4. Rough plumbing has been installed.
5. Rough electrical has been installed including the electrical panel.
6. HVAC ducts are being installed. Supply ducts are insulated.
7. Partitions will be ready for priming by the end of this week;
finished ceiling is scheduled for middle of next week.
