Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner request a Special Permit, Per Section 8-5 to allow operation of a used car business for the property located at 296 Highland Avenue located in an B-2 zone. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section 5-3 (2) (8)which provide as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section 8-6 and 94, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion, of nonconforming Iots, land, structures, and uses, provided however,that such change,extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is,when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety,convenience and welfare for the City's inhabitants. A. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings or structures in the same district. B. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. C. Petitioner Gary Nadeau presented the petition and represented the following; a. He presently operates a Bagel Business at the premises. Business has declined to the point that he wishes to operate a used car business from the premises. b. Mr. Nadeau has another use car business in the city at the present time,A- 1 Auto on Essex Street. c. Mr.Nadeau presented a plan showing 27 lined parking spaces on the premises with room for more. d. The proposed use will reduce the traffic to the site from its present use. e. Inventory will be 30 used cars. f. An application to the Licensing Board will be made subsequent to the Zoning Board decision. g. There will be one handicap parking space. h. No automotive repair will take place on this site. i. There will be 2 employees on site. j. The existing building is 4, 500 square feet. k. Petitioner will line an additional 7 parking spaces on the site. 2. Jim Fleming spoke in favor of the petition. 3. Councillor O'Leary spoke in favor of the petition and indicated that there was neighborhood support for the petition. On the basis of the above findings of fact, and on the evidence presented at the hearing,the Board of Appeal concludes as follows: 1. Literal enforcement of the provisions of the ordinance would involve substantial hardship on the petitioner. 2. The relief requested can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the ordinance. 3. A lighting plan shall be submitted to the City Planner for review and written approval prior to the issuance of a Building Permit. b. Landscaping a. A detailed landscaping plan and planting schedule shall be submitted to the City Planner and approved prior to the issuance of a Building Permit. b. Trees shall be a minimum of 3 1/2" caliper. c. Sloped granite curbing shall be installed around the entrance radii to the site and in absence of a MHD requirement, the applicant shall install the sloped granite curbing along the property line. d. Concrete curbing shall be installed within the entire site. e. There shall be no change to current landscaping on the slope behind the building. f. After all project landscaping is completed, and prior to the issuance of a Certificate of Occupancy, the applicant shall be required to add further landscaping if such is required by the City Planner. 6. Dumpster Enclosure A plan of the proposed dumpster enclosure shall be submitted to the City Planner for review and written approval prior to the issuance of a Certificate of Occupancy. 7. Signage Proposed signage shall be reviewed and approved by the City Planner. 8. Board of Health All Board of Health requirements shall be strictly adhered to. 9. Fire Department All requirements of the Salem Fire Department shall be strictly adhered to. 10. Undereround Utilities Any new electrical service to the site shall be in the form of a pad-mounted transformer. 11. Noise Level Between 11:00 P.M. and 7:00 A.M. the noise levels as generated by the rooftop equipment at the closest residence shall be no greater than 40 db. 12. Roof Top Equipment All roof top equipment shall be properly screened. A detailed plan showing the location of any roof top equipment and the proposed screening shall be submitted to the City Planner prior to the issuance of a Building Permit. Such screening shall be reviewed and approved in writing by the City Planner prior to the issuance of a Building Permit. 13. Massachusetts Highway Department Applicant shall obtain all required permits from th_ N, 4a sachusetts Highway Department and submit copies to the City Planner prior to the issuance of a Building Permit. 14. Clerk of Works A Clerk of Works shall be provided and paid for by the applicant as deemed necessary by the City Planner. 15. Maintenance a.The applicant shall employ an acceptable method or means for the holding and disposal of trash (rubbish) after site development with a copy of this method sent to the Planning Department and Health Department in writing for their approval. b.Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. c.Winter snow and ice maintenance process shall be approved by the City Engineer. d.Winter snow in excess of the snow storage areas on the site shall be removed off site. 16. Construction Practices All construction shall be carried out in accordance �x ii the following conditions: a. No work shall commence before 5:00 A.M. on weekdays and Saturdays. No work shall continue beyond 5:00 P.M. There shall be no work conducted on Sundays and holidays. Inside work of a quiet nature may be permitted at other times. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction. Notification shall also be submitted to the Planning Department. c. Maintenance of all landscaping shall be the responsibility of the developer, his successors or assigns. d. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. 17. As-Built Plans As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be submitted to the Planning Department and Engineering Department prior to the issuance of a Certificate of Occupancy. 18. Violations Violations of any condition may result in revocation of this permit by the Planning Board.
