The proposed addition is located in an Entrance Corridor Overlay District. At a regularly scheduled meeting of the Planning Board held on April 20, 1995, the Board voted, by a vote of seven in favor, none opposed, to approve the application as complying with the requirements for the issuance of the permit with the following conditions: 1. Conformance With Plan Work shall conform with the following plans: a. "Proposed Bagel Shop, Certified Plot Plan-296 Highland Avenue, Salem, MA", dated January 9, 1995, revised February 17, 1995, containing one sheet, prepared by Otte & Dwyer, Inc., 196 Central Street, Saugus, MA. b. "Proposed Bagel Shop - 296 Highland Avenue", dated March 1, 1995, containing sheets No. A-2 and A-3, prepared by James Howland Ballou, 14 Cambridge Street, Salem, MA, 2. Amendments Any amendments to the Site Plan or waiver of conditions contained within shall require the approval of the Planning Board. 3. Utilities a. Utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. b. Drainage shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. 4. Site Lighting a. A lighting plan shall be submitted to the City Planner for review and written approval prior to the issuance of a Building Permit. b. All site lighting shall be installed and maintained in such a way so as to not reflect or cause glare on abutting properties, or which adversely affect safe vision of operators of vehicles moving on nearby streets. 5. Landscaping a. A detailed landscaping plan and planting schedule shall be submitted to the City Planner and approved prior to the issuance of a Building Permit. b. Trees shall be a minimum of 3 1/2" caliper. c. Sloped granite curbing shall be installed around the entrance radii to the site and in absence of a MHD requirement, the applicant shall install the sloped granite curbing along the property line. d. Concrete curbing shall be installed within the entire site. e. There shall be no change to current landscapiug on the slope behind the building. f. After all project landscaping is completed, and prior to the issuance of a Certificate of Occupancy, the applicant shall be required to add further landscaping if such is required by the City Planner. 6. Dumpster Enclosure A plan of the proposed dumpster enclosure shall be submitted to the City Planner for review and written approval prior to the issuance of a Certificate of Occupancy. 7. Signage-- Proposed i na e--Proposed signage shall be reviewed_and.approyed by the 8. Board of Health All Board of Health requirements shall be strictly adhered to. 9. Fire Department All requirements of the Salem Fire Department shall be strictly adhered to. 10. Underground Utilities Any new electrical service to the site shall be in the form of a pad-mounted transformer. 11. Noise Level Between 11:00 P.M. and 7:00 A.M. the noise levels as generated by the rooftop equipment at the closest residence shall be no greater than 40 db. 12. Roof Top Equipment All roof top equipment shall be properly screened. A detailed plan showing the location of any roof top equipment and the proposed screening shall be submitted to the City Planner prior to the issuance of a Building Permit. Such screening shall be reviewed and approved in writing by the City Planner prior to the issuance of a Building Permit. 13. Massachusetts Highway Department Applicant shall obtain all required permits from thc: hi:._sachusetts Highway Department and submit copies to the City Planner prior to the issuance of a Building Permit. 14. Clerk of Works A Clerk of Works shall be provided and paid for by the applicant as deemed necessary by the City Planner. 15. Maintenance a.The applicant shall employ an acceptable method or means for the holding and disposal of trash (rubbish) after site development with a copy of this method sent to the Planning Department and Health Department in writing for their approval. b.Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. c.Winter snow and ice maintenance process shall be approved by the City Engineer. d.Winter snow in excess of the snow storage areas on the site shall be removed off site. 16. Construction Practices All construction shall be carried out in accords nct: bbiut the following conditions: a. No work shall commence before 8:00 A.M. on weekdays and Saturdays. No work shall continue beyond 5:00 P.M. There shall be no work conducted on Sundays and holidays. Inside work of a quiet nature may be permitted at other times. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction. Notification shall also be submitted to the Planning Department. c. Maintenance of all landscaping shall be the responsibility of the developer, his successors or assigns. ------------------------------------------------------------- d. All construction shall be performed in accordance with the Rules and Regulations of �the Planning Board, and in accordance with.any_and_all_rules,_regulations-and dinances_of_the-City-of Salem.j 17. FROM: Bob Thomson DATE: 27 July 88 RE: Meeting Notes from 27 July Meeting, Matt.Ga-r-rett' s--J I A meeting was held at Salem Green on 27 July to conduct a preliminary review-of the plans for Matt Garrett''s restaurant, to be located at the cgrner of Trader"s Way and Highland Ave. Thefollowingdecisions were made: 1. There is no requirement for the elevator to accomodate a stretcher. 2.. A one-hour wall and one-hour ceiling is required around the kitchen, since it will be treated as a high hazard area. Stairs between the floors which goe from the kitchen to the upper serving area do not have to be rated, since they won't be a means of egress. - - - -— _ - 3.. The elevator shaft will have to be of one-hour construction. 4. Bill Munroe will determine whether the upstairs restrooms need to have handicap facilities in addition to the downstairs restrooms. 5. The upstairs kitchen does not require one-hour walls around it, based on the assumption that there are no cooking requirements there. A steam -- . -- .- table and refrigeration units are fine. 6. Bill Munroe will also determine whether or not the openings between the first and second floors at the dining room are allowable. Answers to this and item 4 will be forthcoming by 710 -_ j 7. The occupancy load will be calculated 88. •based upon the square footage of space which is accessible to the customers. This includes halls and restrooms, but excludes the kitchens, storage, and office areas. An exact employee count will be used in those spaces. 8. Mr. LaPointe noted that Knox boxes and a graphic alarm panel would be required. He questioned where the kitchen hoods would be exhausted, but said he had no problem with them coming up through he kitchen roof as long as they were far enough away from the wall of the second floor. 9. The dumpster needs to be moved back so it' s even with the beer locker and the area leading to the dumpster needs to be paved for fire access. No fire lane is required around the other 3 sides of the building. J ' 27 July 88 Meeting Notes (cont) 10. The number and location of the exits was agreed upon, although Mr. Munroe reserved the right to resize the stairs after he had calculated the occupant load. 11. It was suggested that the Health Dept. (Robert Blankhorn) send a representative to future meetings. They would determine the requirement for employee restrooms in the kitchen and the suitability of the proposed finish materials in the kitchen areas. It was noted that some hand- washing facilities would be required in the downstairs kitchen area, but that it would probably be alright for employees to use the restrooms outside the kitchen. 12. Mr. LaPointe noted that fixed extinguishing systems would be required over some of the kitchen equipment. The structure was described as a wood framed building with some steel structural elements, having a plywood sheathed roof and asphalt/ fiberglass shingles. It was noted that there would be approximately 5500 SF on the first floor and 3000-SF-on the second-.- The -building will be fully sprinkled. There were no further comments. The parties agreed to meet again when the plans were developed to the prelminary HVAC, structural, and- electrical stages. THe large stone retaining wall between Building Units 25X and 26 appears to have been constructed properly. THa stone retaining walls at Building Units 32C and 320 were da(paged, according to the Project Superintendent, by the od$#ration of a back-hoe. Similar stone retaining walls in tMd area appear to be sufficient. In our opinion these two wAlis should be re-constructed from the base in the same fa*pion as the remaining stone retaining walls. THOV exterior cast-in-place concrete retaining walls have not uN14argone excessive rotation. The cold joint formed at the ec�Iae of the retaining wall and the building foundation is noi; a structural concern, however this joint should be sealed to prevent water infiltration and damage. CROCKETT/THOMPSON November 25 , 1988 Pg. 2 of 2 The cold joints formed in the cast-in-place concrete basement walls do not appear to provide any loss to their structural integrity if the walls have been doweled into their abutments. Again, these Joints should be cut-out and sealed to prevent water infiltration and damage. In general , the stone and cast-in-place concrete retaining walls should be monitored through the winter season for lateral movement and/or rotation. This morning (November 2) , when I returned for yet another inspection, I found the unit occupied. The occupant said they were told they could occupy the premises after 3 P.M. The unauthorized use of premises is a violation of Sect. 115.0, 119.1, and 121.4 of the State Code, punishable by a fine of up to $1,000. The purpose for this letter is not to seek punishment, but to acquaint you with facts sometimes overlooked by the Real Estate Department when they are pressed to occupy a building. This is particularly so when completion is down to the wire. In such a case, a major problem may be overlooked that could result in pain or damage, and perhaps unnecessary frustration or financial cost. The purpose of this visit was to review the as-built conditions of certain stone and cast-in- place concrete retaining walls and cast-in-place concrete basement walls. The Building Units and items reviewed are as follows: a. 25X Regency; Cast-in-place concrete retaining wall .' b . 25X Regency; Stone retaining wall between 25X and 26. c . 32C Long "L" ; Stone retaining wall . d . 320 Long "L" ; Stone retaining wall . e. 130 Regency; Cast-in-place concrete basement wall . f. 133 Regency; Cast-in-place concrete retaining wall . The large stone retaining wall between Building Units 25X and 26 appears to have been constructed properly. . The stone retaining walls at Building Units 32C and 32D were damaged , according to the Project Superintendent , by the operation of a back-hoe. Similar stone retaining walls in the area appear to be sufficient . In our opinion these two walls should be re-constructed from the base in the same fashion as the remaining stone retaining walls. The exterior cast-in-place concrete retaining walls have not undergone excessive rotation. The cold joint formed at the edge of the retaining wall and the building foundation is not a structural concern, however this Joint should be sealed to prevent water infiltration and damage. CROCKETT/THOMPSON , November 25, 1988 Pg. 2 of 2 The cold joints formed in the cast-in-place concrete basement walls do not appear to provide any loss to their structural integrity if the walls have been doweled into their abutments . Again, these joints should be cut-out and sealed to prevent water infiltration and damage. In general , the stone and cast-in-place concrete retaining walls should be monitored through the winter season for lateral movement and/or rotation. In connection with the buildings as shown on the plan, the following events took place: (1) A building permit was obtained and construction started and completed on a portion of the building as shown on the plan. In the process , all site preparation for the adjoining ° building was completed , all utility lines installed, all topographic work as shown on the plan was completed and a double foundation was poured between the two buildings. It would appear to me they did a substantial amount of work on this site. We could have probably obtained a foundation permit at that time. (2) I think all of this activity predates the site plan review ordinance which was passed later in 1985 but I think our work on the site qualifies us for the issuance of the building permit to complete the work as shown on the approved plan. The Appellant Indicated that the local Inspector had notified him that the construction violated Section 909 . 1 . 2 of the Building Code. The Appellant testified that the building was of 4B construction and should be classified a multiple, single family dwellings, side by side and as such should be separated by a one hour fire wall . The Appellant Indicated that he has complied with this requirement of the Building Code to the letter by providing the one hour rated wall between units . According to the Appellant , the local Inspector had objected to the configuration of the two end units In each building as each unit has a jog over a garage which is an separate floor from the main part of the unit . The Appellant testified that there are one hour walls separating all common walls whether on the first or second floors and that there Is two hour ceiling between the garage and the dwelling unit . The local Inspector testified that It was his opinion that Section 909 . 1 . 2 called for one hour walls from the foundation to the underside of the roof sheathing and that a situation such as this jog between the first and second floors does not meet the requirements of the Building Code. The Inspector agreed that the multiple, single family side by side classification was correct for this construction . Following testimony, the Board found that Section 909 . 1 . 2 does not require that the one hour separation be vertical from foundation to ceiling . The Code does required that all common walls must be a fire separation and be of a one hour fire rating , but the Code does allow situations such as this where one portion of the living quarters is separated from the main portion of the STATE BUILDING CODE APPEALS BOARD Docket w87-93 Date: August 20, 1987 unit so long as there are one hour fire separations wall where that wall Is a common wall . ADD 1.4 The rigid insulation specified in detail B/A-9 may not be exposed styrofoam. The selected product must have a maximLun flame spread of 25 and smoke development of 50 when tested per ASTM E-84. Sprayed on insulation with the same performance characteristics may be used at the contractor's option. ADD 1.5 The combustion chambers of all gas-burning appliances in the furnace rooms of Type B units must be 18" above the floor. This may be achieved by setting the units on concrete masonry blocks laid to the proper height, as required. I . GENERAL: The building, as designed, is approximately 262,000 square feet on the ground floor with full perimeter access around the outside of the building, (780 CMR s. 306.2 - Exhibit "A" ) ; proposed to be fully • sprinkled (780 CMR 306. 3 - Exhibit "A" ) ; and is to be used as a distribution center classified as a moderate hazard storage use (Si ) as defined in 780 CMR 210.2 (Exhibit "B) . Table 305 (Exhibit "C" ) allows for 2 stories or 30 feet in height and 8400 square feet per floor for a type 2C constructed building; 4 stories or 50 ' feet in height and 13, 125 square feet per floor for a type 2B constructed building and 5 stories or 65 feet in height and 19,950 square feet for a type 2A constructed building; that a type "2" building is noncombustible as defined in 780 CMR s 216.0 (Exhibit "D" ) , and the proposed use is to be serviced by automated equipment resulting in a low density occupancy. • II . PROBLEM: The building, as described above, may be constructed without regard to any limited area as allowed by 780 CMR s. 307.1 (Exhibit "E" ) because the exitway facilities comply with the provisions of Article 6, an automatic fire suppression system will be provided complying with 780 CMR B. 1202.0 and the building is isolated as specified in 789 CMR s. 3072 and Table 307. • • PAUL J. MORIARTY AND ASSOCIATES A. MEZZANINE : The architect and tenant are desirous of including within the cube of the building envelope formed by walls and a flat roof, an upper level of 92,000 square foot area. Of this 92,000 square foot area, approximately 49,000 square feet is proposed as the tenants headquarters office. This office area is to be enclosed • by construction rated for the appropriate occupancy separation. The remaining 43,000 square feet is proposed to be used as a merchandise marking area which is to be open below, the distribution center. The entire space below the 92,000 square foot upper floor level is to be utilized for the distribution center ' s open receiving and shipping areas. The 43,000 square foot portion could meet the definition of a mezzanine by definition outlined in 780 CMR s. 201.1 (Exhibit "F" ) . Since a mezzanine by definition is not a story but an intermediate level between the floor and ceiling of the story, the appellant may be permitted to use the unlimited area provisions of the code. The 49,000 square foot portion of the building that is at the other • end is itself less than 1/3 of the area below, and is completely separated as a separate building. This level could be interpreted as complying with the requirements of a mezzanine, since there appears to be no prohibition in designating more than one area above the story as a mezzanine(s) . B. COMMUNICATING FLOORS: 780 CMR s. 616.10 (Exhibit "G" ) allows for communicating floors and nowhere in this section does the code address these levels as stories, but as floors and levels. It is therefore possible to address this office level as a communicating floor, however it is • a moderate hazard use not "ordinary hazzard occupancy" . C. SPECIFIC CODE PROVISIONS : a. Matters Not Covered: 780 CMR s. 101 .3 (Exhibit "H" ) allows the building official to accept other requirements not specifically. covered .by the code. An automated storage use building with a low occupancy is not specifically covered by the code and it is felt that the appellant should be allowed to build his proposed building of • Type 2C construction under the provisions of the code dealing with unlimited areas. • -2- • PAUL J. Accepted Engineering Practices : 780 CMR s. 110.2 (Exhibit "I" ) allows the acceptance of regulations , specifications and standards listed in the appendexes, if not specified in the building code. An automated storage use building with a low occupancy is not specifically covered by the code and it is felt that the appellant should be allowed to build his proposed building of Type 2C construction • under the provisions of an unlimited area. c. New Materials and Methods of Construction: 780 CMR s. 110. 3 (Exhibit "I" ) states that the code as written is not intended to prohibit the use of any material, system or method of construction not specifically prescribed by the code. An automated storage use building with a low occupancy is not specifically prescribed by the building code and it is felt that the appellant should be allowed to build his proposed building of Type 2C construction under the provisions of the code dealing with unlimited areas. • D. ARTICLE 22 - REPAIR, ALTERATION, ADDITION AND CHANGE OF USE OF EXISTING BUILDINGS : a. Applicability: Should this building be constructed without the proposed second levels (office) , it appears that five years after occupancy (780 CMR s. 2200. 3.1 - Exhibit "J" ) these second levels would be permitted to be constructed since the height and/or area of the existing building would not exceed the provisions of Table 305 • and sections 305 and 306 ( 780 CMR s. 2200. 3.5 - Exhibit "K" ) . b. Compliance Alternatives: 780 CMR s. 2206.1 (Exhibit "L" ) provides for alternate means of construction where compliance with the provisions of the code for new construction is impractical because of structural or construction difficulties or regulatory conflicts. The appellant proposes an alternative means of construction by using Type 2C for an unlimited area building. C. Hazard Index: • In Article 22 of the code there appears a table which was carefully compiled using all available fire and miscellaneous data in order to classify various uses of buildings from the highest to the lowest hazards. Although this table was expressly put together for purposes of allowing or disallowing change of uses in existing buildings, it nevertheless is helpful in determininghow the code is applied at the various occupancies by a hazard classification. This of course is useful in determining the type of construction needed, and separations, • -3- • PAUL J. MORIARTY AND ASSOCIATES exposures etc. This Table is known as the Hazard Index and is found as Table 2204 (Exhibit "M" ) . Table 2204 classifies an S1 Use (Storage-Moderate Hazard) in an index of "3" on a scale of "1" to "8" . The only index lower is Business ( "2" ) , Hotels and Motels ( "2") , Multi-family ( "2" ) , one and two family ( "2" ) and Storage - low hazard ( "l" ) . Factory and mercantile are the only two uses also classified as a "3" in the Hazard Index. It is • felt that a "3" in the Hazard Index is relatively a low hazard when you realize that a "3" is in a scale of "1" to "8" . Further, an analysis of the accompanied "Hazard Index Modifiers" for Table 2204, indicates that no addition or subtraction is used for a Type 2C constructed building. It is believed important since certain types of construction requires the adding a "one" to the Hazard Index ( 3C or 4B) . E. MISCELLANEOUS : 780 CMR s. 305.4 (Exhibit "N" ) allows that buildings two (2) • stories or less in height may be built to the same area limits provided in Table 305 (Exhibit "D" ) . Since section 307.1 (Exhibit "F" ) modifies Table 305, it is suggested that section 305 .4 allows the use of section 307.1 to permit unlimited areas for buildings two stories or less in height. F. CONCLUSION: The proposed building is to have a low density occupancy because of the complete automation in the storage area in which rails and conveyors will be used and controlled by computers. It is clear that • as a one story building it could be built of Type 2C construction. If it is determined that the proposed building is a two story building in several parts of the structure, and if section 307.1 is interpreted to apply only to one story buildings, this building can not be constructed as proposed. The proposed Type of construction will not result in any compromise to public safety. There appears to be several provisions of the code that may allow for an interpretation that .alternatives may be employed :to allow the construction as proposed. There appears to be several provisions of the code that may allow for • an interpretation that this building may be constructed as proposed without the use of alternative provisions or variances. As an alternative the board could allow variances/modification due to the practical difficulties of complying with the strict provisions of the code all as allowed by 780 CMR S. 110.6 (EXHIBIT "0" ) . • -4- • PAUL J. Accepted engineering practice: That which conforms to accepted princi- ples, tests or standards of nationally recognized technical or scientific authorities. Exceptions: 1. Unless specifically provided otherwise in this code, all exist- ing buildings and structures shall meet and shall be pre- sumed to meet, the provisions of the applicable laws, codes, rules or regulations, by-laws or ordinances in effect at the time such building or structure was erected or substantially altered. • 2. In cases where applicable codes, rules or regulations, by- laws or ordinances were not in use at the time of such erection or substantial alteration, the provisions of Section 104.0 of this code shall apply. 3. In cases where the provisions of this code are less stringent than the applicable codes, rules or regulations, by-laws or ordinances in force at the time of such erection or sub- stantial alteration, the applicable provisions of this code shall apply, providing such application of these provisions does not result in danger to the public as determined by the building official. • 101.2 Zoning restrictions: When the provisions herein speci- fied for structural strength, adequate egress facilities, sanitary conditions, equipment, light and ventilation, and fire safety conflict with the local zoning by-laws or ordinances, this code shall control the erection or alteration of buildings. 101.3 Matters not covered: Any requirements essential for structural, tireor sanitary safety of an existing or proposed building or structure, or essential for the safety of the occu- pants thereof, and which is not specifically covered by this code, shall be determined by the building official. The State • Building Code Commission and the Department of Public Safety shall be notified in writing within seven (7) working days of any action taken under this section. 2 9/1/80 y • • ES!IIH111, " 7 780 CMR: STATE BUILDING CODE COMMISSION 109.2 Amendments and promulgation of rules: Any person may propose amendments to this code. Public hearings shall be held in the city of Boston in May and October of each year, and at such other times and places as the Commission may determine, to consider petitions for such amendments. The building official shall accept appro- vals of the Commission on all new materials, systems or methods of construction proposed for use which are not specifically pro- vided for in this code. 110.4 Used materials and equipment: Used materials, equip- ment and devices which meet the minimum requirements of this • code for new materials, equipment and devices shall be permit- ted; however, the building official may require satisfactory proof that such materials, equipment and devices have been reconditioned, tested, and/or placed in good and proper work- ing condition prior to approval. 110.5 Research and investigations: Wherever there is insuffic- ient evidence that any material, system or method of construc- tion conforms to the requirements of this code or there is in- sufficient evidence to substantiate claims for alternative mater- ials, systems or methods of construction, the building official may require tests meeting the functional requirements of this code (see Sections 800.0, 802.0, and 803.0) and such test shall • be conducted by a laboratory and/or personnel approved by the Commission. In consideration of this fact our argument runs as follows : For the sake of discussion, consider the Distribution Center without either a Mezzanine or an Office Area . Under the "Unlimited Area" provision of the Code the building could be designed to meet Type 2C-unprotected construction requirements. Type 2C avoids the extensive fire resistant construction required under 1B. Into this large , single story building of Type 2C construction we add a self-contained enclosed "Mezzanine Level Office" with complete fire separation between it and the Warehouse . Has the fire risk within the Warehouse increased as a result of adding the offices? Does the addition of the office warrant upgrading the Construction Type of the entire building to 1B? We think not. Since you expressed some reservations about our interpretation , and we could not feel comfortable certifying code compliance in the affidavit process without official approval , we feel it would be best to request a ruling from the State Building Code Commission. To assist us in the appeal process we spoke with Paul Moriarty our code consultant who suggested that we approach the SBCC with a written opinion from you office denying our interpretation of the code. In that vein, please consider this letter a formal request for a written ruling regarding the interpretation of 2C Construction Requirements with regard to "Unlimited Area" , and how they impact this project. The persons selected would sign off the various phases of construction, acting on the behalf of the department involved but would not be a full time employee, nor be eligible for City benefits. 3. I would feel that these would be part-time positions, not to exceed. twenty (20) hours a week and that the compensation would be the same as the hourly rate for full-time inspectors with a transportation allowance of two dollars ($2.00) a day. The present hourly rate for inspectors range from approximately twelve dollars ($12.00) per hour to sixteen dollars ($16.00) per hour, depending on the department. 2.
