Dear Mr. Tremblay:
The proposed rip rap slopes, as shown on the plans and as specified in the specifications Will
provide a stable slope at 1:1. There is no need for a retaining wall in those areas. In fact, the
typical detail shown on the plans is in accordance with the requirements of the Massachusetts
Highway Department for rip rap slopes. Rip rap slopes do not act as retaining walls and,
therefore, are not covered in the Massachusetts Building Code, which is why there is no reference
to them.

As a requirement for obtaining our Certificate of Occupancy for the above referenced project,Pep
Boys agrees to install a sidewalk along Highland Avenue if at some point in time it becomes a resolution of
the City of Salem that sidewalks are required along Highland Avenue.
It is understood that a sidewalk was not required for this property during plan approval. It is
further understood that upon receipt of this letter that Pep Boys will be issued a full Certificate of
Occupancy for this project. -

Dear Leo,
As we finalize the site design before the Planning Board for the proposed Pep Boys
development, we are in need of a clarification of the Zoning ByLaws regarding retail "storage"
space and also"parking spaces". This has led us to two questions we would like you to address
for us:
1. Sec, 7,3 (g) - Retail Business "Storage Area" definition
We have several areas restricted to employees only. These include:
1. Receiving Area
2. Service Area & Misc storage rooms
3. Portions of the Retail area accessed only by Employees, containing parts
bins and such.
Can we us the test of "Employees Only", to define these "storage areas?
2. Sec. 7.3 (f) -"Off Street Parking Area" definition.
Can we allow the 12 proposed service bays to count to as parking areas? The idea is
that many of the customers will be there for service and their cars will be parked in the
bays. If not all 12, then any?
Please consider these two issues. We would like to have your response In writing prior to our
next June 1st Planning Board meeting. Please feel free to call me to discuss these issues.
