Planning Board Order of Project Conditions
Construction Practices
All construction shall be carried out in accordance with the following conditions as per City of Salem
Planning Board meeting April 14°h,2015:
1. Exterior construction work shall not be conducted between the hours of 5:00 PM and 8:00 AM the
following day on weekdays or at any time on Sundays or on holidays. Any interior work conducted
during these times will not involve heavy machinery which could generate disturbing noises.
2. All reasonable action shall be taken to minimise the negative effects of construction on abutters.
Advance notice shall be provided to all abutters in writing at least 72 hours prior,to commencement
of construction of the project.
3. Drilling,blasting,and rock hammering shall be limited to Monday-Friday between 8:00 AM and 5:00
PM. There shall be no drilling,blasting,or rock hammering on Saturdays,Sundays,or holidays.
Blasting shall be undertaken in accordance with all local and state regulations.
4. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt
and/or debris on surrounding roadways as they leave the site.
5. All construction shall be performed in accordance with the rules and regulations of the planning
board,and in accordance with any and all rules,regulations,or ordinances of the city of Salem.
6. All construction vehicles left overnight at the site must me located completely on the site.
7. A construction Management Plan and construction schedule shall be submitted by the contractor.
This plan shall include,but not be limited to,information regarding how the construction equipment
will be stored,a description of the construction staging area and its vehicles. The plan and schedule
shall be reviewed and approved by the city planner prior to the issuance of a building permit.
a. Daily tasks will be reviewed with all on site-employees;report will be written and signed at
the end of each work day by Project Manager.
b. All construction equipment shall be stored completely on the job site at all times. Heavy
equipment used for site excavation and backfilling will be stored in the far driveway of
Tropical Products at the location of the proposed addition. Smaller equipment needed for
steel erection,concrete cutting/pouring,and jobsite materials will be stored at the rear of the
jobsite behind the building where Tropical Products has moved trailers to clear space.
Dumpsters on site will be located either at the side driveway with the heavy equipment or
out back depending on the project phase and progress.
c. Staging areas for proposed project will occur at the front/left face of the building,project
area `A',for the duration of the roof replacement and exterior finishes. Primary means of
staging in this area will consist of pipe staging for interior work,and pump staging for
exterior work. Staging will also be needed for steel erection that will be provided by the steel
fabrication company as well as pipe staging for light gauge metal framework inside the
warehouse at project area`C'.
d. All construction employees will park personal vehicles at the rear of the jobsite to avoid

2. Transfer of Ownership
Within five (5)days of transfer of ownership of the site, the Owner shall notify the Board in writing of
the new owner's name and address. The terms, conditions, restrictions and/or requirements of this
decision shall be binding on the Owner and its successors and/or assigns.
3. Amendments
Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by
the City Planner, shall require approval by the Planning Board. Any waiver of conditions contained
within shall require the approval of the Planning Board.
4. Construction Practices
All construction shall be carried out in accordance with the following conditions:
a. Exterior construction work shall not be conducted between the hours of 5:00 PM and 8:00 AM the
following day on weekdays or at any time on Sundays or Holidays. Any interior work conducted
during these times will not involve heavy machinery which could generate disturbing noises.
b. All reasonable action shall be taken to minimize the negative effects of construction on abutters.
Advance notice shall be provided to all abutters in writing at least 72 hours prior to
commencement of construction of the project.
c. Drilling, blasting, and rock hammering shall be limited to Monday-Friday between 8:00 AM until
5:00 PM. There shall be no drilling, blasting, or rock hammering on Saturdays, Sundays, or
holidays. Blasting shall be undertaken in accordance with all local and state regulations
d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt
and/or debris on surrounding roadways as they leave the site.
e. All construction shall be performed in accordance with the Rules and Regulations of the Planning
Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem.
f. All construction vehicles left overnight at the site, must be located completely on the site.
g. A Construction Management Plan and Construction Schedule shall be submitted by the applicant.
This plan shall include, but not be limited to, information regarding how the construction
equipment will be stored, a description of the construction staging area and its location in relation
to the site, and where the construction employees will park their vehicles. The plan and schedule
shall be reviewed and approved by the City Planner prior to the issuance of a Building Permit.

h. All sidewalks, roadways, utilities, landscaping, etc. damaged during construction shall be replaced

that soil and ground water on the entire site meets the DEP standards for the proposed use.
c. The developer shall adhere to a drainage plan as approved by the City Engineer.
d. The developer shall employ a licensed pesticide applicator to exterminate the area prior to
construction, demolition, and/or blasting and shall send a copy of the exterminator's invoice to the
Health Agent
e. The developer shall maintain the area free from rodents throughout construction.
f. The developer shall submit to the Health Agent a written plan for dust control and street sweeping
which will occur during construction.
g. The developer shall submit to the Health Agent a written plan for containment and removal of

m. The developer shall provide a plan showing how grease in gray water is contained, prior to it
entering the city sewer system in developments with 10 or more units and in compliance with the
requirements of the City Engineer

a. If any new lighting is proposed,the applicant shall submit a plan for the proposed lighting to the
City Planner for review and approval prior to issuance of a building permit.
c. No light shall cast a glare onto adjacent parcels or adjacent rights of way.
d. After installation, any new lighting shall be reviewed and approved by the City Planner, prior to
the issuance of any Certificate of Occupancy.

12. Pedestrian Access

two- (2) year period, from issuance of the Certificate of Occupancy.
c. Winter snow in excess of snow storage areas on the site shall be removed off site.
16. As-built Plans
a. As-built Plans, stamped by a Registered Professional Engineer, shall be submitted to the
Department of Planning and Community Development and Department of Public Services prior to
the issuance of any Certificate of Occupancy.
b. The As-built plans shall be submitted to the City Engineer in electronic file format suitable for the
City's use and approved by the City Engineer, prior to the issuance of any Certificate of
Occupancy.

A public hearing on the above Petition was opened on March 18, 2015 dose on that date pursuant to M.G.L
Ch. 40A, § 11 with the following Salem Board of Appeals members present: Ms. Curran (Chair), Mr. Duffy,
Mr. Copelas,Mr.Tsitsinos (alternate).
The Petitioner seeks Special Permits per Sec. 3.3.2 Nonconforming Uses to allow an extension of a non-
conforming use and a Special Permit from the provisions of Sec. 3.3.3 Nonconforming Struamns of the Salem
Zoning Ordinance.
Statements of fact:
1. In the petition date-stamped February 24, 2015, the Petitioner requested Special Permits per Section
3.3.2 Nonconforming Uses and Section 3.3.3 Nonconforming Structures to all the extension of a non-
conforming front setback dimension.
2. Attorney Atkins presented the petition.
3. The petitioner proposes to construct a 574 square foot addition to the first floor and a 3, 485 square
foot addition to the second floor on the front left side of the existing structure in accordance with
plans titled"220 Highland Avenue"A-1 through A4 and C-1 dated February 24,2015.
4. The requested relief, if granted, would allow the Petitioner to allow the extension of a non-
conforming front setback dimension.
5. At the public hearings no members spoke in favor or in opposition to the proposal.
The Salem Board of Appeals, after careful consideration of the evidence presented at the public heating,
and after thorough review of the petition, including the application narrative and plans, and the
Petitioner's presentation and public testimony, makes the following findings that the proposed project
meets the provisions of the City of Salem Zoning Ordinance:
Findings for Special Permit:
1. The board finds that the proposed expansion of this dimensionally non-conforming building is not
more detrimental than the existing structure to the impact on the social, economic or community
needs served by the proposal.
2. There are no impacts on traffic flow and safety,including parking and loading.

3. The capacity of the utilities is not affected by the project.
4. There are no impacts on the natural environment,including drainage.
5. The proposal conforms to the existing neighborhood character.

On the basis of the above statements of facts and findings, the Salem Board of Appeals voted four (4) in
favor (Ms. Curran (Chair), Mr. Duffy, Mr. Watkins, Mr. Copelas, Mr. Tsitsinos (alternate) and none (0)
opposed, to grant a Special Permit, to allow the extension of a non-conforming front setback dimension.,
subject to the following terms, conditions, and safeguards:

1. The Petitioner shall comply with all city and state statutes, ordinances,codes and regulations.

. . On Thursday, November 6, 1986, the Planning Board of the City of Salem
held a public hearing regarding the application of the Sunburst Fruit
Juices, Inc. , 220 Highland Avenue, Salem, for a Special Permit under
Section P, Wetlands and Flood Hazard Districts, of the Salem Zoning
Ordinance, with respect to the construction of a 21 ,000 square foot
addition and adjacent parking lot at 220 Highland Avenue. This Decision
is a modification of a plan approved on June 25, 1986. This Decision
supersedes the Decision of June 25, 1986.
At a regularly scheduled meeting of the Planning Board held on November

2. Sewer sizing calculations, including peak flows, shall be submitted
to the Engineering Department prior to issuance of a building permit.
3. A sewer profile indicating invert, rim, and grade elevations shall
be submitted to the Engineering Department prior to issuance of a
building permit.
4. . Surge control, subject to approval of the City Engineering
Department, for process water must be provided to avoid water hammer
problems in the City system.
5. Board of Health requirements- set forth in a letter dated June 12,
1986, shall be adhered to.
6. A landscaping plan for the site shall be reviewed and approved by
the Planning Department prior to issuance of a Certificate of Occupancy.

shall be the responsibility of the Applicant.

On Thursday, November 6, 1986, the Planning Board of the City of Salem
held a public hearing regarding the application of the Sunburst Fruit
Juices , Inc. , 220 Highland Avenue, Salem, for a Special Permit under
Section R, Site Plan Review, of the Salem Zoning Ordinance, with respect
to the construction of a 21 ,000 square foot addition and adjacent
parking lot at 220 Highland Avenue . This proposal is a modification of
a plan approved on June 25 , 1986. This Decision .supercedes the Decision
of June 25, 1986.
At a regularly scheduled meeting of the Planning Board held on November
20, 1986 , the Board voted, by unanimous vote, to approve the application
as complying with the requirements for the issuance of a Special Permit,
subject to the following conditions:
1 . Work shall conform to plan entitled, "Site Plan of Land, Salem, MA,
prepared for Sunburst Fruit Juices", by Carter and Towers
Engineering Corp. , dated April 11 , 1986, revised October 30, 1986 .
2. All utility installation shall be reviewed and approved by the
Engineering Department.
a. A compaction test , subject to review and approval of the
Engineering Department , shall be performed. prior to
installation of proposed drainage system to ensure proper
bedding of drainage pipes.
3 . Board of Health requirements set forth in a letter dated June 12 ,
1986 , shall be adhered to.
4. Landscaping shall conform to plan entitled, "Planting Plan for
Sunburst Fruit Juices, Inc.", dated November 4, 1986 , revised
November 17 , 1986.
a. Maintenance of landscaping shall be the responsibility of the
developer.
b. Proposed berm on perimeter of parking lot to direct drainage
flows shall be constructed of a material approved by the City
Planner.
c. Vertical granite curbing shall be installed along
Highland Avenue the length of the property line with the
exceptions of proposed curb cuts.

There shall be no work on Sundays or holidays.
b. All reasonable action shall be taken to minimize the negative
effects of construction on abutters.
c. Drilling and blasting shall be limited to Monday — Friday
between the hours of 8:00 a.m. and 4:30 p.m.
7. Board of Appeal decision dated May 28, 1986 shall be strictly
adhered to.
8. Signage for the building shall be reviewed and approved by the City
Planner prior to issuance of Certificate of Occupancy.
9. Exterior design plans shall be reviewed and approved by the City
Planner prior to issuance of a Building Permit.
10. A lighting plan shall be reviewed and approved by the City Planner
prior to issuance of Certificates of Occupancy.
11 . All construction shall be in accordance with the Rules and

4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply:
(a) the work is a maintenance dredging project as provided for in the Act;or
(b) the time for completion has been extended to a specified date more than three years, but less than
five years,from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill,containing no trash,refuse, rubbish or de
bris, including but not limited to lumber, bricks,piaster,wire,lath, paper,cardboard,pipe,tires,ashes,

in accordance with said conditions and with the Notice of Intent referenced above.To the extent that the fol- �.
lowing conditions modify or differ from the plans, specifications or other proposals submitted with the Notice
of Intent,the conditions shall control.
General Conditions
1. Failure to comply with all conditions stated herein,and with all related statutes and other regulatory meas-
ures,shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges;it does not authorize any injury
to.private property or invasion of private rights:
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal,state or local statutes,ordinances,by-laws or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply
(a) the work is a maintenance dredging project as provided for in the Act;or
(b) the time for completion has been extended to a specified date more than three years,but less than
five years,from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any rill used in connection with this project shall be clean fill,containing no trash, refuse,rubbish or de-
bris,including but not limited to lumber,bricks,plaster,wire,lath,paper,cardboard,pipe,tires,ashes,
refrigerators,motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or,if
such an appeal has been filed,until all proceedings beforet`e Department have been completed.
8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land.
Court for the district in which the land is located,within the chain of title of the affected property.In the
case of recorded land,the Final Order shall also be noted in the Registry's Grantor Index under the name
of the owner of the land upon which the proposed work is to be done.In the case of registered land,the
Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done.The recording information shall be submitted to the cammi ssi an
on the form at the end of this Order prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size
bearing the words, "Massachusetts Department of Environmental Quality Engineering,
File Number 64-132
10.Where the Department of Environmental Quality Engineering is requested to make a determination and
to issue a Superseding Order,the Conservation Commission shall be a party to all.agency proceedings
and hearings before the Department.
11. Upon completion of the work described herein,the applicant shall forthwith request in writing that a
Certificate of Compliance be issued stating that the work has been satisfactorily completed.

from Carter & Towers Engineering Corp. (see enclosed) , this department strongly
recommends that this facility be connected to the common sanitary sewer.
We would like to bring your attention to the State Environmental Code, Title 5 -
"Minimum Requirements for the Subsurface Disposal of Sanitary Sewage", Regulation
2. 12:
Connection to Common Sanitary Sewer. The Board of Health may require the
owner or occupant of an existing building or buildings, wherever a common
sanitary sewer is accessible in an abutting way, to cause such building or
buildings to be connected with the common sanitary sewer.
In conclusion we wish to thank all parties for their involvement and look forward
to seeing this matter corrected in the most environmentally safe and efficient

We are seeking a permit for the construction of an
additional silo to accommodate our plastic blowmolding
operation. We are planning to erect this silo so that
deliveries to it can be made by using our main driveway and
parking area rather than the small silo driveway area. This
should decrease the number of times the small driveway area is
utilized for deliveries , thus improving traffic conditions on
Highland Avenue.
We need the additional silo in order to allow purchases of
plastic resin from more than one manufacturer at a time. The
economics of the situation make this an important business
decision for us .
