A hearing on this petition was held on March 16,2005 with the following Board
Members present: Nina Cohen, Chairman,Richard Dionne,Nicholas Helides,Bonnie
Belier and Edward Moriarty. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in accordance
with Massachusetts General Laws Chapter 40A.
Petitioner request a Special Permit per Section 8-5 to alter an existing non-conforming
use to another non-conforming use for the property located at 1 I 1 Highland Avenue
located in an R-1 zone.
The provision of the Salem Zoning Ordinance which is applicable to this request for a
Special Permit is Section 5-3 (2) (8)which provide as follows:
Notwithstanding anything to the contrary appearing in this Ordinance,the Board of
Appeal may,in accordance with the procedure and conditions set forth in Section 8-6 and
9-4,grant Special Permits for alterations and reconstruction of nonconforming structures,
and for changes, enlargement,extension or expansion,of nonconforming lots, land,
structures,and uses,provided however,that such change, extension, enlargement or
expansion shall not be substantially more detrimental than the existing nonconforming
use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests, guided by
the rule that a Special Permit request may be granted upon a finding by the Board that the
grant of the Special Permit will promote the public health, safety, convenience and
welfare for the City's inhabitants.
A. Special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other lands,
buildings or structures in the same district.
B. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise,to the petitioner.
C. Desirable relief may be granted without substantial detriment to the public good
and without nullifying or substantially derogating from the intent of the district or
the purpose of the ordinance.

The Board of Appeal, after careful consideration of the evidence presented, and after
viewing the plans,makes the following findings of facts:
1. Petitioner Berroa is the owner and petitioner. He was represented by Attorney
Joseph M. Sano,Esq. of Lynn. Dr. Von Weiss is the prospective buyer of a
mixed use property at 111 Highland Ave.In zoning terms the property is an
existing non-conforming use;until recently, Mr. Berroa operated a used car sales
business on a portion of the site and used the other portion for a residence. The
property is non-conforming as to lot size (consisting of 13, 100 sf)and frontage
(approximately 48.5 ft.), and also violates the ordinance as to the number of
principal uses on one lot.
2. Dr. Von Weiss,who was represented by Attorney George Atkins, stated that he
sought permission to end the use as a car lot, and instead to employ the existing
buildings as an adjunct to his existing business as a dermatological clinic offering
skin care. His existing business,located since 1972 next door at 107 Highland
Avenue, will expand into the new space, and he will employ no more than 4 fill
time doctors at both clinics.
3. No changes in the footprint of the existing building will be required, although the
existing business will be fixed up a bit to house the clinic.No changes are
contemplated to the residential use either,which will continue to be rented to
tenants.Dr. Von Weiss undertook to add landscaping along the border between
the clinic and the residence,to improve the look of the residence and make it
more in keeping with the residential section along Willson Road.
4. Mr. Roger Hastings of 3 Willson Road endorsed the plan,provided that the
petitioner does make efforts to improve the look of the residence,which he said
recently had been somewhat neglected. Another neighbor,Mr. Bemand Caron of
108 Highland Avenue, spoke in support of the Special Permit, saying that Dr. Von
Weiss has been a good neighbor. Mr. Jean Pelletier, Ward Councillor for Ward 3,
also supported petitioner's request.
On the basis of the above findings of fact, and on the evidence presented at the
hearing,the Board of Appeal concludes as follows:

I. Literal enforcement of the provisions of the ordinance would involve substantial
hardship on the petitioner.
2. The relief requested can being granted without substantial detriment to the public
good and without nullifyor substantially derogating from the intent of the
district or the purpose of the ordinance.
3. The Special Permit granted can be granted in harmony with the neighborhood and
will promote the public health, safety, convenience and welfare of the City's
inhabitants.
4. Special conditions exist which especially affect the subject property, but not the
district in general.
On the basis of the above findings of fact,the Zoning Board of Appeal voted 5 in favor
and 0 in opposition to grant the Special Permit requested, subject to the following
conditions.
1. Petitioner shall comply with all city and state statues,code ordinances and
regulations.
2. All requirements of the Salem Fire Department relative to smoke and fire safety
shall be strictly adhered to.
3. Petitioner shall obtain a building permit prior to beginning any construction.
4. Petitioner shall obtain a Certificate of Occupancy.
5. Petitioner shall have no more than 4 full time employees.
6. Petitioner shall install landscaping to separate the clinic use and residential use.
7. Petitioner shall comply with the parking plan submitted and dated February 1,
2005.

Petitioners are requesting an Administrative Ruling in accordance with- Section
IX'"of,the Zoning Ordinance and MGL 40A. Section 7 relative to use of the
Premises and enforcement of Sections V-8 (2) and VIII-E(6) of the Zoning —
Ordinance with respect to said premises.
More specifically, the petitioners request the Board of Appeal to order the
Inspector of Buildings to enforce the Zoning Ordinance by prohibiting the

After hearing the evidence the Board of Appeal makes the following findings
of fact:
1 . The use of the property as a gas station has been abandoned for over
two years.
2. Permission of operate a used car lot has not been sought from the
Board of Appeal .
3. The current use is not permitted in an R-1 Zone.
Therefore, based on the above findings of fact and on evidence presented, the
Zoning Board of Appeal voted unanimously, 5-0, in favor of the petitioners
request for an Administrative Ruling and to direct the Inspector of Buildings
to enfprce provisions of the Salem Zoning Ordinance. 11

would be parking for 15 cars. The proposed hours of operation
would be from 10:00 a.m. to 10:00 p.m.

6. Several letters in opposition were submitted to the board.
Councillors Kevin Harvey, Scott McLaughlin and Joan Lovely
presented letters in opposition signed by 3 abutters of the
property. Mr. & Mrs. Guinta of 117 Highland Ave. , Mr. & Mrs .
Economides of 118 Highland Ave. and Bernard Caron of 108 Highland
Ave. There was also a petition presented opposed to the petition
signed by the following; Mr. Lavoie, 9 Cottage St. , hIr. Griffin of
7 Cottage St. , Mr. Volantv of 1 Willson St. , Mr. Genovese of 108
Highland Ave. , Mr. & Mrs. Von Veiss, 101 Highland Ave & Mr.
Pellitier of 6 Cottage St .
7 . Those present in opposition to the petition were Stanley Poirer of
8 Cottage St. and Joseph Marfongelli of 3 Willson Street.
S . All those in opposition addressed concerns of traffic being a
problem, odors and a possible rodent problems.
On the basis of the above findings of fact, and on the evidence
presented, the Board of Appeal concludes as follows:
1 . The Special Permit requested cannot be granted without
substantial detriment to the public good or without nullifying and
substantially derogating from the intent of the district or the
purpose of the ordinance.
2 . The granting of the Special Permit requested will not be in
harmony with the neighborhood and will not promote the public health,
safetv, convenience and welfare of the City's inhabitants .
Therefore, the Zoning Board of Appeal voted 0 in favor, and 5 in
apposition to the motion to grant the relief requested. Having
failed to garner the four affirmative votes required to pass, the
motion to grant fails and the petition for a Special Permit is
denied.

1. This is an action under M.G.L. c. 40A, §17 , appealing a
decision of the City of Salem Zoning Board of Appeals.
2 . The Plaintiff, Edward Zarohian, is the owner of the com-
mercial premises situated at and known as 111 Highland Avenue in
Salem, Essex County, Massachusetts (hereinafter "the Zarohian
Property" ) .
3. The Defendants, Steven and Lisa Mullins, are the resi-
dent owners of the single-family dwelling situated at 3 Wilson
Road in said Salem.
4 . The Mullins ' dwelling abuts the Zarohian Property.
5 . Both parcels are located in an R-1 residential zoning
district, as described in the City of Salem Zoning Map and
By-Law.
6 . At all times material hereto, the Defendant, James
Fleming was the Chairman of the Salem .Zoning Board of Appeals
and, on information and belief, he resides at 47 Buffam Street in
said Salem.
7 . At all times material hereto, the Defendant, John
Nutting, was a Member of the Salem Zoning Board of Appeals and,
on information and belief, he resides at 68 Moffat Road in said
Salem.
8 . At all times material hereto, the Defendant, Richard
Febonio, was a Member of the Salem Zoning Board of Appeals and,
on information and belief, he resides at 4C Arnold Drive in said
Salem.

9. At all times material hereto, the Defendant, Edward
Luzinski, was a Member of the Salem Zoning Board of Appeals and ,
on information and belief , he resides at 25 Hardy Street in said
Salem.
10. At all times material hereto, the Defendant, Arthur
LaBrecque, was an Associate Member of the Salem Zoning Board of
Appeals and, on information and belief, he resides at 11 Hazel
Street in said Salem.
11 . The commercial uses presently conducted at the Zarohian
Property, including the sale of used motor vehicles and the
repair and servicing of motor vehicles , constitute legal pre-
existing nonconforming uses of the parcel , under M.G.L. c. 40A,
§6, insofar as such uses were conducted on the site at and prior
to the effective date of those changes in the City of Salem
Zoning Map and Zoning By-Law, which currently prohibit such com-
mercial uses; and have continued, on an uninterrupted basis ,
since said effective date.
12 . A valid pre-existing nonconforming use of the premises ,
as a gasoline filling station, was abandoned by the Plaintiff ,
approximately two or three years ago.
13 . Notwithstanding the valid non-conforming status of the
Zarohian Property, the Defendants, Steven and Lisa Mullins , on or
about January 20 , 1989 , filed an enforcement request with the
City of Salem Building Inspector and Zoning Enforcement Officer,
pursuant to G.L. c. 40A, §7 , challenging the legality of any com—
mercial uses at the site . A true and accurate copy of said
enforcement request is annexed hereto and incorporated herein by
reference as Plaintiff ' s Exhibit "A" .
14 . On or around January 24 , 1989 , the Mullins enforcement
request was denied by the City of Salem Building Inspector and
Zoning Enforcement Officer. A true and accurate copy of the
Building Inspector ' s written demand is annexed hereto and incor-
porated herein by reference as Plaintiff ' s Exhibit "B" .
15 . On or about February 23 , 1989 , the Mullins filed a
petition with the Board of Appeals , appealing the Building
Inspector ' s refusal to take enforcement action against the com-
mercial uses of the Zarohian Property. A true and accurate copy
of the Mullins ' Petition is annexed hereto and incorporated
herein by reference as Plaintiff ' s Exhibit "C" .
16 . The Mullins , through their attorney, agreed to waive
the time restrictions under c. 40A, within which the Board was
required to act on the Mullins ' appeal . See Exhibit "D" annexed.

17. A public hearing was held on the Mullins Petition on
November 15, 1989 .
18 . On May 15 , 1990 , the Board of Appeals filed its written
decision on the Mullins ' Petition, with the Salem City Clerk,
wherein, by unanimous vote, the Board purported to overturn the
decision of the Building Inspector, by ordering said official to
take enforcement action against the continued use of the Zarohian
Property as a used car lot. A true and accurate copy of the
Board ' s written decision is annexed hereto and incorporated
herein by reference as Exhibit "E" .
19 . In acting on the Mullins ' Petition, the Board applied
an incorrect standard of review, ignored certain undisputed fac-
tual statements concerning the history of the Zarohian Property
and, otherwise, failed to make all necessary findings required by
law.
20 . The Board exceeded its authority in rendering its May
15, 1990 written decision on the Mullins ' Petition.
WHEREFORE, the Plaintiff prays that:
a . the May 15 , 1990 written decision of the Salem Zoning
Board of Appeals, concerning the Zarohian Property, be
annulled;
b, this' Honorable Court enter a declaratory judgment that
the Plaintiffs use of the subject premises for the pur-
poses of motor vehicle sales , services and repairs ,
j constitutes a valid pre-existing nonconforming use ;,i
the property under G.L. c. 40A, §6 ;
C . he be awarded his costs of suit; and
d . this Honorable Court enter whatever other and further
relief it deems meet and just herein.

Dear Mr. Munroe:
Please be advised that this office represents Steven and Lisa Mullins of
Three Willson Road, Salem, Massachusetts, an abutter to 111 Highiand Avenue, Salem,
Massachusetts.
The property at 111 Highland Avenue is located in an R-1 district. The
property was used as a gas station for a number of years which was apparently per-
mitted as an existing nonconforming use. However, the owner abandoned use of the
property as a gas station several years ago and as a result, abandoned the prior non-
conforming use. Since then, he has apparently operated a used car lot on the premises,
for which changed use he never obtained permission from the Zoning Board of Appeals.
It is our contention that any use of the property for anything but what is permitted
in an R-1 district is in violation of the zoning by-law of the City of Salem.
Demand is hereby made, in accordance with G.L. c.40A §7, that you investi-
gate the use of the premises at 111 Highland Avenue and enforce the zoning by-law of
the City of Salem with respect to said premises.

A hearing on this petition was held January 21 , 1987 with the following Board
Members present: James Hacker, Chairman; Messrs. , Fleming,Luzinski and Strout.
Notice of the hearing was sent to abutters and others and notices of the hearir,_
were properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
The petitioner is requesting a Variance to encroach on side yard setbacks and
a Special Permit to extend nonconforming use in this R-1 district.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board
of Appeal may, in accordance with the procedure and conditions set forth in
Section VIII F and IX D, grant Special Permits for alterations and reconstruction
of nonconforming structures, and for changes, enlargement, extension or expansion
of nonconforming lots, land, structures, and uses, provided, however, that sucr.
change, extension, enlargement or expansion shall not be substantially more
detrimental than the existing nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health:,
safety, convenience and welfare of the City's inhabitants.
The Variance which has been requested may be granted upon a finding of the Board
that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and wn: ch are not generally
affect other lands, buildings or structures it .ne same district;
b. literal enforcement of the provisions of the Zoning Ordinance would is:clve
substantial hardship, financial or otherwise, to the petitioner;
3. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal. after careful consideration of the evidence presented at the
hearing, makes the following findings of fact:
1 . There was major neighborhood opposition;
2. It was determined that the project in its current plan would be
detrimental to neighboring property values;
3. Petitioner failed to meet his burdon of proof with regards to
hardship.

On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . The proposed plan would not be in harmony with the district and would not
promote the health, safety, convenience and welfare of the City's
inhabitants;
2. Special conditions do not exist which especially affect the subject
property and not the district generally;
3. Literal enforcement of the provisions of the Ordinance would not involve
substantial hardship to the petitioner;
4. The relief requested cannot be grantedwithoutsubstantial detriment to
the public good or without nullifying or substantially derogating fro-: the
intent of the district and the purpose of Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously, 4-0, against granting
the requested Variance and Special Permit.

The District has been made aware of a proposed Jiffy Lube being constructed
at 111 Highland Avenue in the City of Salem.
Chapter al; Section 21, of the General Laws states "Any person who builds
or expands a business, residential, or other facility intending to utilize
an existing access or a new access to a State highway so as to generate a
substantial increase in or impact on traffic shall be required to obtain
a permit under this section prior to constructing or using such access.
Said person may be required by the Department to install and pay for,
pursuant to a permit under this section, standard traffic. control devices,
pavement markings, Channelization, or other highway improvements to facilitate
safe and efficient traffic flow, or such highway improvements may be
installed by the Department and up to one hundred per cent of the cost of
such improvements may be assessed upon such person."
We are requesting that no building permits be issued until such time as the
proponent contacts the District Permits Engineer and the actual access
permit is issued to them.

1. This is an action under M.G.L. c. 40A, §17 , appealing a
decision of the City of Salem Zoning Board of Appeals.
2 . The Plaintiff, Edward Zarohian, is the owner of the com-
mercial premises situated at and known as 111 Highland Avenue in
Salem, Essex County, Massachusetts (hereinafter "the Zarohian
Property" ) .
3. The Defendants , Steven and Lisa Mullins, are the resi-
dent owners of the single-family dwelling situated at 3 Wilson
Road in said Salem.
4. The Mullins ' dwelling abuts the Zarohian Property.
5 . Both parcels are located in an R-1 residential zoning
district , as described in the City of Salem Zoning Map and
By-Law.
6 . At all times material hereto, the Defendant, James
Fleming was the Chairman of the Salem .Zoning Board of Appeals
and, on information and belief , he resides at 47 Buffam Street in
said Salem.
7 . At all times material hereto, the Defendant , John
Nutting, was a Member of the Salem Zoning Board of Appeals and,
on information and belief, he resides at 68 Moffat Road in said
Salem.
8 . At all times material hereto, the Defendant , Richard
Febonio, was a Member of the Salem Zoning Board of Appeals and,
on information and belief , he resides at 4C Arnold Drive in said
Salem.

9. At all times material hereto, the Defendant, Edward
Luzinski , was a Member of the Salem Zoning Board of Appeals and ,
on information and belief , he resides at 25 Hardy Street in said
Salem.
10 . At all times material hereto, the Defendant, Arthur
LaBrecque, was an Associate Member of the Salem Zoning Board of
Appeals and , on information and belief, he resides at 11 Hazel
Street in said Salem.
11 . The commercial uses presently conducted at the Zarohian
Property, including the sale of used motor vehicles and the
repair and servicing of motor vehicles , constitute legal pre-
existing nonconforming uses of the parcel , under M.G.L. c. 40A,
96 , insofar as such uses were conducted on the site at and prior
to the effective date of those changes in the City of Salem
Zoning Map and Zoning By-Law, which currently prohibit such com-
mercial uses ; and have continued, on an uninterrupted basis ,
since said effective date.
12 . A valid pre-existing nonconforming use of the premises ,
as a gasoline filling station, was abandoned by the Plaintiff ,
approximately two or three years ago.
13 . Notwithstanding the valid non-conforming status of the
Zarohian Property, the Defendants, Steven and Lisa Mullins, on or
about January,. 20 , 1989 , filed an enforcement request with the
City of Salem Building Inspector and Zoning Enforcement Officer,
pursuant to G.L. c. 40A, §7 , challenging the legality of any com
mercial uses at the site. A true and accurate copy of said
enforcement request is annexed hereto and incorporated herein by
reference as Plaintiff ' s Exhibit "A" .
14 . On or around January 24 , 1989 , the Mullins enforcement
request was denied by the City of Salem Building Inspector and
Zoning Enforcement Officer. A true and accurate copy of the
Building Inspector' s written demand is annexed hereto and incor-
porated herein by reference as Plaintiff ' s Exhibit "B" .
15 . On or about February 23 , 1989 , the Mullins filed a
petition with the Board of Appeals , appealing the Building
Inspector ' s refusal to take enforcement action against the com-
mercial uses of the Zarohian Property. A true and accurate copy
of the Mullins ' Petition is annexed hereto and incorporated
herein by reference as Plaintiff ' s Exhibit: "C" .
16 . The Mullins , through their attorney, agreed to waive
the time restrictions under c. 40A, within which the Board was
required to act on the Mullins ' appeal . See Exhibit "D" annexed.

17. A public hearing was held on the Mullins Petition on
November 15, 1989 .
18 . On May 15 , 1990 , the Board of Appeals filed its written
decision on the Mullins ' Petition, with the Salem City Clerk,
wherein, by unanimous vote, the Board purported to overturn the
decision of the Building Inspector, by ordering said official to
take enforcement action against the continued use of the Zarohian
Property as a used car lot. A true and accurate copy of the
Board ' s written decision is annexed hereto and incorporated
herein by reference as Exhibit "E" .
19 . In acting on the Mullins ' Petition, the Board applied
an incorrect standard of review, ignored certain undisputed fac-
tual statements concerning the history of the Zarohian Property
and, otherwise, failed to make all necessary findings required by
law.
20 . The Board exceeded its authority in rendering its May
15 , 1990 written decision on the Mullins ' Petition.
WHEREFORE, the Plaintiff prays that:
a . the May 15 , 1990 written decision of the Salem Zoning
Board of Appeals , concerning the Zarohian Property, be
annulled;
b, this' Honorable Court enter a declaratory judgment that
the Plaintiffs use of the subject premises for the pur-
poses of motor vehicle sales , services and repairs ,
constitutes a valid pre-existing nonconforming use of
the property under G.L. c. 40A, §6;
C . he be awarded his costs of suit ; and
d . this Honorable Court enter whatever other and further
relief it deems meet and just herein.

A hearing on this petition was held November 15, 1989 with the following Board
Members present: James Fleming, Chairman; John Nutting, Richard Febonio, Edward
Luzinski and Associate Member Arthur LaBrecque. Notice of the hearing was sent
to abutters and others and notices of the hearing were properly published in
the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A.
Petitioners are requesting an Administrative Ruling in accordance with_6ea0on_=
IX'—Of—the Zoning Ordinance and MGL 40A. Section 7 relative to use of'ttie
premises and enforcement of Sections V-B (2) and VIII-E(6) of the Zoning
Ordinance with respect to said premises.
More specifically, the petitioners request the Board of Appeal to order the
Inspector of Buildings to enforce the Zoning Ordinance by prohibiting the
continued unauthorized use of thesite as a used car lot.
After hearing the evidence the Board of Appeal makes the following findings
of fact:
1 . The use of the property as a gas station has been abandoned for over
two years.
2. Permission of operate a used car lot has not been sought from
Board of Appeal . -=—
3. The current use is not permitted in an R-1 Zone.
Therefore, based on the above findings of fact and on evidence presented, the
Zoning Board of Appeal voted unanimously, 5-0, in favor of the petitioners
request for an Administrative Ruling and to direct the Inspector of Buildings
to enforce provisions of the Salem Zoning Ordinance. )

As per your request I have investigated the possibility of
a zoning violation at the above referenced address.
The active file in the City of Salem Licensing, Board Office
indicates an auto dealer license has been issued annually up to and
including the current 1989 calender year for this property.
Although these active files only go back to 1981 , people more
familiar with property than I am suggest the license was obtained
many years prior to that, back to when the gas station was active
on the site.
In view of the above it would appear that no violations
exist at this time.

Please be advised that this office represents Steven and Lisa Mullins of
Three Willson Road, Salem, Massachusetts, an abutter to 111 Highland Avenue, Salem,
Massachusetts.
The property at 111 Highland Avenue is located in an R-1 district. The
property was used as a gas station for a number of years which was apparently per-
mitted as an existing nonconforming use. However, the owner abandoned use of the
property as a gas station several years ago and as a result, abandoned the prior non-
conforming use. Since then, he has apparently operated a used car lot on the premises,
for which changed use he never obtained permission from the Zoning Board of Appeals.
It is our contention that any use of the property for anything but what is permitted

City of Salem Zoning Board of Appeals
Petition of EMAD S. YOUNAN, M.D., requesting a Special Permit to
change a currently nonconforming use (adjunct to a dermatological
clinic) to another nonconforming use (physician's office) for the
structure on the property located at 111 HIGHLAND AVENUE, Salem,
MA in the Residential One-Family (R-1) Zoning District.
A public hearing on the above Petition was opened and closed on May 21, 2009 pursuant
to Mass General Law Ch. 40A, § 11. The following Zoning Board of Appeals members
were present: Robin Stein (Chair), Rebecca Curran, Richard Dionne, and Beth Debski,
and Jimmy Tsitsinos (alternate).
Petitioner seeks a Special Permit pursuant to Section 5-36) of the City of Salem Zoning
Ordinances.
Statements of fact:
I. The owner of the property is Hans Von Weiss. The petitioner, Emad S. Younan,
M.D., is under agreement to purchase the property.
2. Attorney George Atkins represented the petitioner, at the hearing. Mr. Von Weiss
was also in attendance.
3. The property at 1 11 Highland Avenue is currently an adjunct to a dermatological
clinic, a nonconforming use in the Residential One-Family district.
4. In a petition dated April 24, 2009, the applicant requested a Special Permit to
change one nonconforming use (adjunct to a dermatological clinic) to another
(physician's office).

5. The petitioner stated in his application that improvements to the structure and
landscaping are planned. No proposed exterior alterations were submitted to the
Board that required zoning relief.
6. Several members of the public spoke in favor of the petition, stating that they had
had concerns relating to traffic and landscaping, but that after meeting with the
petitioner, they were satisfied with solutions the petitioner agreed to.
The Board of Appeal, after careful consideration of the evidence presented at the public
hearing, and after thorough review of the plans and petition submitted, makes the
following findings:
1. The petitioner's request for a special permit does not constitute substantial
detriment to the public good, as the changes proposed would result in
significant improvements to the property at 111 Highland Avenue;
2. The requested relief does not nullify or substantially derogate from the
intent or purpose of the zoning ordinance; .
3. In permitting such change, the Zoning Board of Appeals requires certain
appropriate conditions and safeguards as noted below.
On the basis of the above findings of fact and all evidence presented at the public hearing
including, but not limited to, the Plans, Documents and testimony, the Zoning Board of
Appeals concludes:
1. A Special Permit is granted to allow the change from one nonconforming use
(adjunct to a dermatological clinic) to another(physician's office).
In consideration of the above, the Salem Board of Appeals voted, five (5) in favor(Stein,
Curran, Dionne, Debski and Tsitsinos) and none (0) opposed, to grant petitioner's
requests for a Special Permit subject to the following terms, conditions, and
safeguards:
1. Petitioner shall comply with all city and state statutes, ordinances, codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted to and
approved by the Building Commissioner.
3. All requirements of the Salem Fire Department relative to smoke and fire safety
shall be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. A Certificate of Occupancy is to be obtained.

6. Petitioner will install "No Left Turn" and "No Entry" signage at the Wilson Street
driveway and curbing as shown on the plans submitted.
7. Petitioner shall plant six (6)-foot shrubbery as per the plan submitted, prior to
issuance of a Certificate of Occupancy.
8. Petitioner shall submit plan showing snow removal and storage areas to the
Building Inspector prior to issuance of a building permit.
