DECISION ON THE PETITION OF ACQUISITION 1987 TRUST FOR
VARIANCES AT 74 HIGHLAND AVE. (R-2)
A hearing was held on this petition November 23, 1987 with the following Board
Members present: James Hacker, Chairman; Mr. Strout and Associate Members Dore
and Labrecque. Notice of the hearing was sent to abutters and others and notices
of the hearing were properly published in the Salem Evening News in accordance
with Massachusetts General Laws Chapter 40A.
Petitioners, owners of the property, are requesting variances to allow the
property to be used for a parking area. Property is located in an R-2 district.
The Variances which have been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner; and
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . There was no opposition;
2. Neighborhood appeared to be in favor;
3. A severe parking problem currently exist and this additional parking
will help to remedy this situation.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property
but not the district generally;
2. Literal enforcement of the Ordinance would work a substantial
hardship on the petitioner;
3. The relief request can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously, 4-0, to grant the
Variance requested, subject to the following conditions:
1 . A demolition permit be obtained prior to the commencement of the
actual demolition;
2. Removal of asbestos, if any, be done according to all state and local
regulations;
3. Parking be installed as per plans submitted, including green space
and plantings;
4. Eighteen (18) parking spaces be maintained;
5. Positively no access directly to Highland Avenue from the parking
lot.

SECTION 116.0 DEMOLITION OF STRUCTURES
a 116.1 Service connections: Before a building or structure can M
be demolished or removed, the owner or agent shall notify all
utilities having service connections within the building or struc-
ture, such as; water, electric, gas, sewer and other connec-
tions. A permit to demolish or remove a 'building or structure
shall not be issued until a release is obtained from the utilities,
stating that their respective service connections and appurten-
ant equipment, such as; meters and regulators have been re-
moved or sealed and plugged in a safe manner.
116.2 Lot regulation: When a building or structure has been
demolished or removed and a building operation has not been
projected or approved, the vacant lot shall be filled with non-
organic fill, graded and maintained in conformity with adjacent A
grades. The lot shall be maintained free from the accumulation ;
of rubbish and all other unsafe or hazardous conditions which (� •'
endanger the life or health of the public; provisions shall be
kL made to prevent the accumulation of water or damage to any w .
foundations on the premises or the adjoining property; and the
necessary retaining walls and fences shall be erected in accord-
ance with the provisions of Article 13.

If demolition is planned please be aware of regulations with reguards to the
removal and disposal of asbestos and other hazardous materials .
Before issuance of demolition permit have a licensed pest control firm submit
a service invoice to this office.

Dear Attorney Raymond:
As the result of numerous complaints regarding rodent activity, an on-site
inspection was conducted 4 F
at�7ligh'land Avenue2 yard and garage/shed
structure, property owned by El-izabeth'Lendall .
The structure is in disrepair - is rotted and decayed. The area has an
overgrowth and constitutes a health, safety and fire hazard , and the
overgrowth of grass, weeds and shrubs is conduisive to the breeding and
harborage of rodents, insects and other animals.
Will you as Attorney for Elizabeth Lendall kindly take immediate corrective
action to correct these violations of State Sanitary Code, 105 CMR 410.602,
and notify this department of the same.

Dear Attorney Raymond:
On August 14, 1986, this department wrote to you relative to property owned
by Elizabeth Lendall at 74 Highland Avenue in Salem, and managed by you.
The letter cited the disrepair of the garage structure, overgrowth of weeds,
shrubs, grass, etc.
You did not respond to our report.
Today, October 9, 1986, a reinspection was conducted of this property and the
following still remains to be corrected:
Garage structure in disrepair, roof has large holes, door leading
inside is partially open allowing for the harborage and breeding of
rodents, insects, etc.
There is overgrowth of grass , weeds, shrubs to left of garage structure
as well as metal pieces, bottles, tree branches and clippings.
To the right of the garage there are pieces of metal , as well as overgrowth
which is also on the side of this building.
There is no, protective railing or ballusters on the stairs on the left
hand side of the house and there are no ballusters on the right hand side.
Again we reiterate that the above are in violation of the State Sanitary Code
Chapter II and 105 CMR 410.602.
You are hereby ordered to make corrections as stated above within 15 days of _.
receipt of this order. Failure to do so may result in legal action being
necessary.

said hearing, you will be given an opportunity to be heard and to present witness
and documentary evidence as to why this Order should be modified or withdrawn. You
may be represented by an attorney. Please also be informed that you have the right
to inspect and obtain copies of all relevant inspection or investigation reports,
orders and other documentary information in the possession of this Board, and that
any adverse party has the right to be present at the hearing.
