Kitchen Exhaust Dear Mr. Barbeau: In your letter dated March 5, 2008 to the Fairweather Apartments–Go MB Management, concern was raised over the failure of MB Management to maintain an existing mechanical system in prOWWOrking fashion, as required in the State Building Code, 780 CMR, Section 103. The mechanical system in question relates to a kitchen area exhaust system. During renovations several years ago, new kitchen cabinets were installed in apartments. In some apartments, the back of the cabinets partially obstructed the intake grilles to the kitchen area exhaust system. This condition has been brought to the attention of the Building Inspector, as part of the inspection process for the current, ongoing renovations at the Fairweather apartment building. As required under the State Building Code 780 CMR 1205.2, natural or mechanical ventilation shall be provided for each habitable room and an exhaust system shall be required for each bathroom. Each apartment is 77 Sommer s r r e e t provided with 60 cfm of intermittent bathroom exhaust air. Each apartment has operable windows with an open area equal to at least 4e% of the floor area. These ventilation levels meet the minimum standards set by The Massachusetts State Building Code 780 CMR 1209.1, as further defined by BOCA 1993 Table 1604.3 paragraph: Private Dwellings. As such, the kitchen ventilation system is not required to meet the ventilation code. Massachusetts State Building Code 780 CMR 103.1 states that all service g o s t e n , MA 0 2 1 1 0 equipment required by 780 CMR shall be maintained. Since the kitchen ventilation system is not required by 780 CMR, the existing modifications to this system do not violate 780 CMR 103.1. The mechanical system in question relates to a kitchen area exhaust system. During renovations several years ago, new kitchen cabinets were installed in apartments. In some apartments, the back of the cabinets partially obstructed the intake grilles to the kitchen area exhaust system. This condition has been brought to the attention of the Building.lnspector, as part of the inspection process for the current, ongoing renovations at the Fairweather apartment building. As required under the State Building Code 780 CMR"1205.2,natural or mechanical ventilation shall be provided for each habitable room and an exhaust system shall be required for each bathroom. These ventilation levels meet the minimum standards set by The Massachusetts State Building Code 780 CMR 1209.1, as further defined by BOCA 1993 Table 1604.3 paragraph: Private Dwellings. As such, the kitchen ventilation system is not required to meet the ventilation code. Please know that because this current method of having our residents be responsible for their own rubbish removal, and our installation of dumpsters with sliding doors in two central locations, is an approved method in apartment buildings and complexes throughout Massachusetts, we must forward your citation to our lawyers. Mr. Blenkhorn, I think the key words here are apartment buildings/complexes. We are not a nursing home, nor are we equipped to offer special services to the infirm. We are simply an apartment building offering low cost housing for persons over sixty two years of age. We understand that one of the reasons for your citation is because of pressure brought by several government agencies. Something you must know is that in fact there may be several residents who are too infirm to remove their own daily rubbish. However, in the same manner they have groceries brough in or their apartment cleaned, they can arrange for their rubbish removal. We often find that government agencies come after us because it's easier than dealing with the real issues. The real issue is that there may be several infirm people in our building who not only should not be living alone, but because of their particular habits, pose a serious threat to the health and safety to other residents. Ironically, the woman who started our recent fire was asked by both doctors and family to enter the hospital to treat her many physical and other problems. Not only did she refuse treatment, she refused to leave the apartment. We, as the management, are literally helpless in a situation like this. When we turn to these government agencies, although they are sympathetic, they tell us they can do "nothing" because they cannot force treatment due to the "rights of an individual." We ask you, Mr. Blenkhorn, what about the "rights ' of all of the other residents who are at the mercy of these few who are unable to care for themselves and refuse any help. We, as management, have positively no help or support (only sympathy), if the time comes that these people must be removed to the environment where their specific needs will be addressed by the properly trained providers. Page 2 Robert E. Blenkhorn, Health Agent May 24, 1985 These issues are swept under the rug by agencies who find the problem of a person needing help but refusing it, too dificult to deal with. We have found no agency or organization that clearly addresses this issue of how to deal with residents who no longer can care for themselves in an apartment setting, but refuse help. However, we must deal with this situation everyday with residents who pose a serious hazzard to the health and safety of our other residents. Again, it is important to note that we are an apartment building and not a nursing home. When an apartment is vacated, we fill it with a healthy individual who is well able to care for themselves and their needs, as witnessed by the fact that even though we have a storage rack for lawn chairs several feet from our back door lawn area, the majority of our residents prefer to keep their lawn chairs in their apartment and take them outside daily to the front of the building to sit on, even though benches are provided. Although we insist upon and encourage independence in our residents, we still take into account that anyone, regardless of age, may at some times have a bad day or health infirmity of short duration that requires our help in rubbish removal. They have only to ask any of our staff, and we are only too glad to help out. In addition, we had also planned to reassess the situation in winter months. Mr. Blenkhorn, we hope that you will allow us a period of time to try our method of rubbish removal before you take any further action. In response to your letter, Items 1 and 2, these buildings were constructed without the elevators connected to the emer- gency power generator and it is our understanding that there is no requirement for buildings of this size and height to have the elevators powered during loss of normal electrical .. 3 power. , Item 3 indicated that stairwell egress was limited due to in- adequate lighting. This reduced lumens situation existed only on.the fourth and fifth floor levels of the center stairwell and was caused by the loss of a portion of electrical service . Only one "leg" of the transformer failed with remaining power available at some locations within the building and not enough i iv ai< of a loss to ,cause the emergency generator to activate. As I understand the reason for dim bulbs, this condition is caused by "feedback" into the internal wiring by the remaining oper- ating sections of the transformer. Item 4 stated that the emergency generator is either inadequate or in need of maintenance. The generator, a Kohler 5 kw, oper- ated by gas, is tested each Monday and operated for a fifteen to thirty minute period to allow all emergency lighting to be inspected . Recent testing by E.R.Sullivan Electric of Lynn, Registration #5942-A, has shown that the total operating load is 2.1 kw. Furthermore, an additional 4 kw load was added to the equipment for a total of 6 . 1 kw, a 22% overload and the equipment continued to function normally. We appreciate your concerns and comments . It is our belief that the Fairweather Apartment building meets all of the provisions of the Salem Fire code and Massachusetts State Building Codes. Notes: Recommendations were made re dead locks on outside doors (even though not used, they should be removed from the doors or redesigned). The building does comply with the standards under which the building was constructed, as the Fire Department. report indicates. Upon his investigation , he found numerous fixtures on each of the six floors with water inside them . In- spector Giardi notified the Building Superintendent Richard Talbot and made reference to the fact that he should notify the maintenance electri - cian for this building . He then did so . Mr . Steve Minahan from B &`"M Electric and Wire Inspector John Giardi had a discussion relevant to what proceedings should be followed . At that time , Mr . Giardi asked that Mr . Minahan ' s Company perform the following services mentioned below and file an electrical permit and a written report as to what the damages were and the necessary work to be performed as follows : a . Check out fire alarm system for any malfunctions . b . Remove all light fixtures and smoke detectors and assess for dam- ages and to replace if necessary . C . Remove panel covers and check for any water that might have en- tered in the panels . Upon finishing the work specified , Mr . Mina- han , also brought to the attention of Wire Inspector Giardi and Building Superintendent Talbot , that the aluminium feeder cable 's in the apartments have to be re-tightened . d . The present trash disposal method consists of the tenants of the seven story building carrying the contained waste through the build- ing and depositing it in one of two dumpsters located outside the building. Again , this method of handling and disposal of residential waste is totally unacceptable to this department . Referring to 105 CMR 410 . 600 Storage of Rubbish and Garbage , Section C of the State Sanitary Code II the owner of the dwelling is responsible for pro- viding a receptacle for the storage of garbage and rubbish which is conveniently located for the tenant . Upon receipt of your response dated May 24 , 1985 we reiterate , as so stated in our letter of May 22 , 1985 , that the present trash disposal method outlined in the notice of May 10 , 1985 to the residents is unacceptable and not to be •implemented at this time . Also , an alternate method of disposal must be submitted in writing to the Board of Health for approval. It was noted during the site observation that a storage room pre- viously used for the storage of garbage and rubbish is located on each floor of the building. Possibly this room could meet the requirements of the State Sanitary Code II and the Board of Health . We are forwarding all correspondence to Mr. Howard Wensley of the State Public Health Office for his opinion and assistance in this matter , and to Michael E .
