This letter will serve to acknowledge receipt of your building permit
application to demolish a dwelling located at 4 High Street.
Due to the following, your permit request cannot be honored at this time.
1 . I have been advised by the Health Department that the effectiveness
of the extermination report, dated October 2, 1985, has long expired.
A new extermination of the building must be done and in place two
(2) week's prior to the start of demolition.
2. Due to the apparent fact that High Street will be blocked off during
demolition I must insist that you contact Sergeant Audrey Sullivan,
Police Traffic Division at 744-1212 and Fire Marshall Robert Turner
at 745-7777 and advise them as to dates and time, and have them,
inturn, contact me.
3. The permit application does not indicate whether the cellar hole
will be filled with clean fill, or enclosed with fencing as required.
This must appear on the application.

Both this office and the Health Department are again receiving complaint's
regarding the fire damaged building owned by you and located at 4 High St.
The Building received damage from two (2) seperate fires in early 1985,
January 2, and March 28, and despite attempts to secure the building it
- has been used as a place to congregate by unknown person's.
Because of the hazardthisbuilding poses to the safety and welfare of
the neighborhood as well as to your property which abuts it, I must insist
that you contact this office, in writing, by March 2, 1987 with immediate
plans to demolish or repair the building.
If your response is not received by this date it is my intension to request
that the City Council declare the building a hazard to the welfare of the
public, and order this department to proceed with it' s demolishion.

Dear Mr. Munroe:
I have reviewed the plans for the proposed addition by Mr. Stephen Ingemi
atJ#4 High Street'—and request that the following be placed on record:
1. The size of the present building is approximately 6, 120 square feet,
and the proposed addition is approximately 3,600 square feet, for a
total gross square footage of approximately 9,720 square feet. Under
the provisions of Chapter 148, Section 26G, Massachusetts General
Laws, when a building of less than 7,500 square feet receives an
addition of any size which brings the total combined square footage of
the building and addition over 7,500 square feet, the building must be
protected with sprinklers.
2. The plans submitted by Mr. Paul Tremblay, the General Contractor, show
only the addition and not the entire building after the addition is
built. In order to correctly approve such plans, I will require the
following:
A. Plans for the installation of the sprinkler system in the entire
building.
B. Plans indicating the location of a manual fire alarm system as
required by Section 1216.4 of the Massachusetts State Building
Code.
I have returned the plans to Mr. Tremblay until such time as adequate
plans are submitted.

FIRE DEPARTMENT CERTFICATE OF APPROVAL FOR BUILDING PERMIT
In compliance with provisions of Section 113 . 5 of the Mass. State
Building Code; and under guidelines agreed upon by the Salem Bldg.
Inspector and the Salem Fire Chief; the applicant for a building
permit, shall obtain the Certificate of Approval (see reverse side)
and stamped plan approval from the Salem Fire Prevention Bureau.
Said application and approval is required before a building permit
may be issued. The Mass. State Building Code requires compliance
approval of the Salem Fire Department, with reference to provisions
of Article #4 and Article #12 of the Building Code, the. Salem Fire
Code, Mass. General Laws and Mass. Fire Prevention Regulations.
The applicant "shall submit this application with three (3 ) sets of
plans, drawn in sufficient clarity and detail, to obtain stamped
approval of the Salem Fire Department. This applies for all new
construction; substantial alterations; change of use and/or occupancy;
�. i and any other approvals required by the Mass. General Laws and the
Fire Codes.
Exception: Plans will not be required for structural work, when the
proposed work to be performed under the building permit,
-will not; in the opinion of the Building Inspector, require
a plan to show the nature and character of the work to
be performed.
NOTICE: Plans are normally required for fire supression systems; fire
alarm systems; tank installations; and fire code requirements.
NOTICE: Under provisions of Article #22, of the Mass. State Bldg. Code ;
certain proposed projects may not require submission of plans,
nor complete compliance with new construction requirements. In
these cases, provisions of Article #22, Appendix T, and Tables
applicable shall apply. This section shall not however, super-
sede the provisions outlined in Salem Fire Prevention Bureau
Regulations; Chapter 148, M.G.L. ; or the Mass. Fire Prevention
Regulations. i.e. all permits for fire code use and/or occupancy
shall apply for the entire structure; fire alarm and/or smoke
detector installation, shall apply to the entire structure, based
on new A.C . (hardwired) units for all new construction, but the
existing structure may comply with regulations applicable for
existing structures.
NOTICE: Sub-contractors may also be required to file individual appli-
cations for a fire department certificate of approval, covering
their area of work. Said sub-contractors shall file for Fire
Department application to install, prior to commencing any work.

M.G.L. c.148 §26G covers fire suppressant and sprinkler
systems in buildings or additions of more than 7500 gross square
feet. The statute is effective July 1, 1983 and grants the city
or town a local option. If accepted by the local community, the
statute requires every non residential building or addition
within that community to be protected with an adequate system of
automatic sprinklers if the "building or addition is more than
7500 gross square feet."
You have requested an opinion as to whether or not the•
statute contemplates the application of the 7500 square foot
requirement to the addition itself or to the entire building. In
order to interpret this statute, I believe that several factors
must be considered. First, the statute uses the words "building
or addition.." The use of the word "building" is significant. A
building which later receives an addition is still a building.
The addition becomes part of the building. Clearly, the building
and addition should not be considered separate entities.
I believe that the legislature intended that when a building
of less than 7500 square feet receives an addition of any size
which brings the total combined square footage of the building
and addition over 7500 square feet, than that building must be
protected with sprinklers. To decide otherwise would be absurd,
because to do so would mean that a building of 7,499( square feet
to which an addition of 7, 499 square feet is added would not be
covered by the statute, even though the combined footage would be
14, 998 square feet. This would render the 7500 square feet
requirement meaningless. Therefore, the 7500 square feet
requirement must be read to mean a building of more than 7500
square feet before any addition, or a building of less than 7500
squre feet to which an addition is added that raises the combined
footage to at least 7500 square feet. ,
One must read this statute as well as all others under c.148
as having a direct public safety impact. I believe that this
lends further significance to interpreting the 7500 square feet
requirement as meaning the building plus addition. The choice of
7500 square feet as the threshold would seem to infer that only
this size building or greater would create the public safety
threat to require legislative initiative. This is also
consistent with the sections under c.148 where arbitrary criteria
has been established. See §26A, buildings of over 70 feet, §26C,
apartment houses of six or more units, and numerous provisions
under §26E. Reading the 7500 square feet requirement to mean the
building plus any additions is entirely consistent with this
legislative scheme.
Concerning §26G, line 4 which states "No such sprinkler
system shall be required unless sufficient water and water
pressure exists, " I believe that this sentence would not require
an owner of a building to bring in sufficient water or pressure
if it did not previously exist even if the building exceeds 7500
square feet. This decision is based on the use of the work
"exists" in the sentence. Had the Legislature intended all
buildings of over 7500 square feet to be included, the sentence
under discussion would not have been included. This exception
clearly has been carved out where the water or water pressure may
present an economic hardship.
