deck flooring are missing and/or incorrectly secured at multiple locations. This occurs at

Question Asked: Did the common owner of the above captioned parcels need to seek a variance
from the Board of Appeals prior to dividing this property?
ShortAnswer: No.
Inspector Tremblay:
It does appear that the Planning Board was within its statutory power to endorse the plan dividing these
two parcels "Approval Under Subdivision Control Law Not Required." (See copy attached and dated
3.27-97). The Planning Board's Decision was filed with the City Clerk on April 9, 1997. The Plan is
also recorded with the Registry of Deeds.
In this case, the Planning Board could not withhold this endorsement (Mass. Gen L. Ch. 41, § 81P —
commonly referred to as an "81P" endorsement) as the statute provides that such an endorsement
SHALL NOT be withheld unless such plan shows a subdivision. By definition (Mass. Gen. L. Ch. 41, §
81 L)this plan does not show a subdivision and is entitled to the endorsement.
The division of a tract of land on which two or more"buildings"were "Standing" (on the effective date of
the subdivision control law) into separate lots on each of which one of such buildings remains is not a
"subdivision," and an applicant submitting a plan showing such a division is entitled to an 81P
endorsement as a matter of law. See Citgo Petroleum Com. v. Planning Bd. of Braintree, 24 Mass.
App. Ct. 425, 426 (1987). The applicant deserves the 81 P endorsement under this exemption even if
one of the lots created by the submitted plan violates provisions of applicable zoning regulations.
Smalley v. Planning Bd. of Harwich, 10 Mass. App. Ct 599, 602-04 (1980). Caselaw is dear that the
Planning Board may not withhold an 81P endorsement based on nonconformity to zoning
requirements. See Duhaime v. Planning Bd of Medway, 12 Mass.App. Ct. 907,908 (1981).
