The retaining wall at the front line (abutting sidewalk) of the property is in disrepair causing an unsafe structure and presents a threat to life and limb. The present condition of the wall is inadequate; a licensed Massachusetts's Registered Design Professional shall be required to review this situation. Under the provisions of Massachusetts State Building Code (780 CMR Section 116,780 CMR Section 107.6.2 and Massachusetts General Law's Chapter 143) Therefore,under the authority of the Mass Sate Building Code 780 C.M.R .,you are directed to hire a licensed individual to either begin repairs; or to remove this portion of the structure. Failure to comply with this order will result in further enforcement actions. You are hereby directed to immediately contact this office upon receipt of this letter. Failure to do so may result in further actions being brought against you,up to and including municipal fines and the filing of complaints at District Court. If you feel aggrieved by the Building Codes issues you have the right to appeal this order to the State Board of Building Regulations at One Ashburton Place,Boston, Ma. If you feel you are aggrieved by the Zoning decision of this order,your Appeal is to the Salem Zoning Board of Appeals.
