I was able to inspect all three units . The units are one on each floor and mirror each other as a traditional triple decker. The unusual item is the construction.The building appears to be made of cast in place concrete. j The building has been vacant for several years and all utilities have been cut from the building. A few years back the site fell victim to copper thieves who removed most of the piping in the basement. This Department has had to have the building secured several times. The building has suffered from roof leaks for a sustained period and as a result very little of the interior walls, wiring,plumbing and mechanicals are able to be salvaged. In the trade this would be referred to as a major gut/renovation. On the exterior,the rear porches are gone and they are part of the required means of egress. The roof needs to be replaced as well as most of the cedar shake shingles.The porches and failure to prevent water infiltration are Building Code Violations and need to be corrected. Additional Building Code items are the lack of a working Fire detection system and Carbon Monoxide detectors.. In conclusion,the building is sound but all of the mechanical systems need to be replaced. If further information is required,please let me know. By stipulation of the parties, a view of the subject premises was ordered for December 20, 2002, said premises being a multi family dwelling located at 12 Hazel Street in Salem,Massachusetts. Upon a view of the premises conducted by the court on December 20, 2002 in the company of an assistant clerk magistrate, deputy chief court officer, the city of Salem's Building Inspector, the city of Salem's Health Inspector, the defendant and his attorney, numerous state sanitary code;,_ and state building code violations were observed upon the premises.The premises now has three units occupied with residents. It is a non owner occupied, three family building with a detached garage. Having viewed the condition of said premises and in consideration of the health, welfare and safety of the occupants of the property and the public at large, the following pre trial order is entered in this matter at this time: 1. By January 6, 20002 the city of Salem's Building and Health Inspectors shall conduct a full inspection of the premises and issue a written report back to this court with copies of the same to the District Attorney's Office and defense counsel regarding all code violations determined by them to be found upon the premises. 2. In particular, and among other state sanitary and building code standards, said inspectors shall determine whether or not the premises are in compliance with entry/egress provisions of said codes, smoke/heat detection provisions of said codes, structural integrity provisions of said codes and minimum standards of fitness for human habitation. 3. In the event, while said inspections are being conducted, the city of Salem acting through its code inspection officers determines that the condition of the buildings is such that they present an imminent threat of harm to the occupants or the public, requiring that said premises be condemned and vacated, said inspectors shall take the necessary steps to have the premises -two- vacated and secured until repairs/improvements can be made to remove said dangers. 4. In carrying out the provisions of this pre trial order and for the safety and welfare of others, the defendant shall reasonably cooperate with city inspectors and provide them with reasonable access to said premises. 5. As of March 14, 2003 the City of Salem's Building Department and Fire Department each report satisfaction by the defendant of the acceptable minimum standards of code enforcement and fire safety regulations upon the premises with the following exception: - The city's building inspector again reports no progress as to the structural safety of the garage located to the rear of the premises. The garage is by order of this court unoccupied and has`been cordoned off by yellow caution tape and posted"no trespassing". Those conditions shall continue in effect until further order of court. Nevertheless,the issue of the garage's safety has been one of longstanding duration and this court agrees with the city's building inspector that the time has come to either repair or raze the garage. The following is therefore ORDERED at this time: 1. The Salem Building Inspector shall forthwith confirm that the written repair proposal for the garage prepared by R.A. Speranza and Son(a copy of which is attached hereto)is in fact legitimate and that the contractor is properly licensed and intends to undertake the work as described in the writing on or before April 15,2003 (weather permitting). 2. In order to further accomplish the same,on or before the close of business on Thursday, March 20, 2003,the defendant shall pay into court the amount of eight thousand four hundred forty ($8,440.00) as called for under the R.A. Speranza& Son proposal. Said amount shall be paid over to the Clerk Magistrate of this court by that date and shall be held in escrow by said clerk magistrate as is typically done by him with monies paid into court and under court order. 3. Upon the commencement of work to repair the garage in question by April 15, 2003, the clerk magistrate shall pay over to R.A. Speranza and Son said monies in two (2) equal installments as -two- authorized by the Building Inspector of the City of Salem upon certification by him that the work has commenced satisfactorily and has been fifty(50%) percent complete upon the first payment by the Clerk Magistrate and that said work is one hundred(100%)percent complete upon the second payment by the Clerk Magistrate. No funds shall be disbursed from said escrow by the Clerk Magistrate except upon certification by the city's building inspector that satisfactory progress/completion of work has been accomplished on site by the contractor and according to law. In the event either the defendant or contractor shall fail, neglect or refuse to cooperate in good . faith with this order in timely fashion and in compliance with all building and zoning laws of the City of Salem and the state building code then,the Commonwealth upon motion shall be heard either for an order of demolition utilizing funds held in escrow by the clerk-magistrate, an order of demolition together with perfection of a lien upon title to the premises by the City of Salem or an application for contempt against the defendant. Upon the Commonwealth's motion in open court today, the Clerk Magistrate shall now assign a trial date to this case and notify the parties of the same. The city's building inspector has today produced communication dated January 6: 2003 directing the defendant to undertake certain actions to address code violations said to be maintain_ed upon the premises.(copy of said correspondence is attached hereto) Iri'addition,the building inspector has today confirmed his intention to re inspect the premises today to confirm that a number of the items set out in the city's January 6, 2003 correspondence have been complied with. The court has today addressed with the defendant, his attorney, the District Attorney and the building inspector an immediate schedule of tasks that SHALL be adhered to by the defendant as follows: 1. Within 48 hours of today's hearing the defendant SHALL obtain a permit from the city's electrical inspector to begin installation of hard wired smoke detectors in all common hallways of the premises (building inspector's 1/6/03 letter, item #2). That work shall begin immediately after the electrical permit is issued by the city. 2. Within one week of today's hearing the defendant SHALL have engaged the services of a licensed building contractor who shall meet with the building inspector to discuss work to be done to shore up and make safe the garage on the premises. Thereupon, that work shall begin immediately,weather permitting as determined by the building inspector. 3. Pending#2 above,the defendant SHALL immediately stake with yellow caution tape and post the garage in question "no trespassing"to the reasonable satisfaction of the city's building inspector. -two- 4. No other electrical work shall be undertaken upon the premises by the defendant or any tenant or other third party unless the same is authorized by proper permits issued by the city of Salem and duly inspected and approved by the city's wire inspector. 5. Squibb, Defendant Second Pre Trial Order: These matters were the subject of a pre trial order issued by this court on December 20, 2002 regarding health and safety issues as found upon premises located at 12 Hazel Street, Salem, Massachusetts. That order remains outstanding and the parties are now due back in court on February 6, 2003, regarding these pending criminal cases. In the interim,under the oversight of the City.of Salem's code enforcement officers, on going work is being done upon the premises and pursuant to the court's December 20, 2002 order. On January 16, 2003 pursuant to process issued by the court at the defendant landlord's request, tenants upon the premises were ordered to remove personal property allegedly improperly stored within a garage upon the premises so that remedial work there can be done by the defendant as ordered by the City of Salem. The tenants have appeared in court and have complied with that order. At that hearing,the defendant landlord again requested a pre trial order from this court seeking to enforce a prohibition as to personal property stored in common areas of the building by tenants, especially on stairways and landings which must be kept clear for purposes of emergency entrance into and exit from the building. In addition,any such personal property owned by tenants stored in the building's basement or attic spaces which may constitute a fire or other hazard as determined by the City of Salem properly should and will be made part of such an order by this court again, for the health and safety of tenants upon the premises and the public at large. Accordingly,the following is ORDERED at this time as a second pre trial order in these cases: All tenants upon the premises shall REMOVE at this time personal property stored at 12 Hazel Street, Salem,Massachusetts and found on or in stairways, stairway landings or common areas used for entry into and exit from the building and as directed by the City of Salem.
