Our office received a complaint regarding your property located at 38 Hathorne Street,alleging
various building code and City ordinance violations. The most egregious of these violations is the
possible operation of a rooming house in a Residential District. (See Regulations below)
Rooming House Regulations (from Salem Zoning Ordinance)
1. Rooming Houses are not allowed anywhere in the City except in BI
and B2 Zones.(refer to Zoning Map for which zone your building is in)
Seepage 6 of Zoning Code attached
2. Two-family or Multi family dwelling units are defined on page 83 of
the zoning code attached. A landlord cannot rent a dwelling unit to
more than 3 unrelated people or to any number ofpeople not "living
together as a single non-profit housekeeping unit"
You are hereby directed to provide a signed and notarized affidavit stating the
individuals and their relationships that will be residing in the I"Floor Unit and a
separate list for the combined 2nd and 3`d floor apartment unit at the time of
inspection.
Per Mass State Building Code 780 C.M.R. Section R 104.1 and under the provisions of 780 CMR,
Section 104.6—Right of Entry, of the State Building Code, access to this property must be granted for
the purposes of this inspection. If this property has rental units, these tenants must be notified in
advance of this inspection, so that access to these spaces may also be accomplished.

If you feel you are aggrieved by this order, your appeal is to the Board of Buildings, Regulations and
Standards in Boston.

The Salem Police Department Community Impact Unit has received complaints concerning your property at 38
Hathorne Street,the second floor apartment of Erica Mendes and Rachel Clasby. Several neighbors have
expressed concerns of quality of life issues.The complaints center on loud parties, disturbances and domestic
disputes. The Salem Police Department has responded to this apartment"6"times since May 12, 2012. 1
have enclosed copies of the police reports for your review.
This letter is to inform you of the activity at your property that is affecting the quality of life of your neighbors.
We would ask that you work with the Police Department and the Community Impact Unit to resolve these
quality of life issues with your tenants. If this activity continues you as the owner of the property can be cited
under Salem City Ordinance as a, "Keeper of a Disorderly House." The fine for a violation is for the first
offense$200.00, second offense $250.00 and third offense$300.00. You could also be charged criminally in
district court as the"Keeper if a Disorderly House." The offense falls under the following criminal complaint
that carries a punishment of up to six months in the house of correction and/or a $200.00 fine. We will also be
notifying Erica Mendes and Rachel Clasby that they are subject to the same statute and can be cited and or
charged as, "Keepers of a Disorderly House" if this activity continues.

• The suspect completely or partially controls or manages the premises;and
• Knows that the place has become disorderly;
• Because of habitual.
Noise that disturbs the public peace of the neighborhood;and/or

Prostitution;and/or
Gatherings of"persons engaged in unlawful practices, thereby endangering the public peace and
corrupting good morals."
