Dear Mr. Tremblay:
You have requested that I give my opinion on the legal status
of the number of units allowed at this building. My opinion
follows .
The zoning card as held by your department shows that the
house was built in 1914 . At that time the number of families
allowed in that house were 2 .
Pursuant to the provisions of Massachusetts General Laws,
Chapter 40A, Section 7, if a building permit is issued, a recipient
is afforded the protection of the laws so long as no action is
taken against him or her within 6 years following the date of the
issuance of the building permit . The same holds true for property
that has been modified without the benefit of a permit and that
expires 10 years from the completion of the work.
Even though there was a permit issued on April 29, 1977 for
remodeling of one of the units, my opinion is that the issuance of
the building certificate to whoever remodeled does not in fact
"grandfather" the third floor apartment .
The case of Benjamin R. Lord vs Zoning Board of Appeals of
Somerset, 30 Massachusetts Appeals Court, 226 , 567 NE2d 954 deals
with the issue of the number of units in a building in a zoning
district . In the Lord case the zoning district was an R1 District
and the use of Lord' s building was as a two family, even though it
had not been "grandfathered" by the statute . The argument was that
the limitations period applicable to the zoning violations under
Chapter 40A, Section 7 covers both structural and use violations .

The court went on to say that the statute (Chapter 40A,
Section 7) does not protect uses under the ten year provision. The
court went on to say that they refuse to interpolate the protection
also for uses into a ten year limitation. That being the case, the
court ruled that the Plaintiffs use of the house as a two family
dwelling is not protected under the provisions of Massachusetts
General Laws 40A, Section 7 .
It is my opinion that the property in question is a two family
and that for the owner to use it as a three family will require the
involvement of the Salem Board of Appeals .

We Frances and Frank J Vieira Sr . , have purchased a two
family house at 14 Hathorne St . here in Salem. There is on the
third floor , a four room apartment including a gas stove equip-
ped kitchen with a refrigerator and a full bath . For the past
20 years the previous owners have rented the aforementioned third
floor as an apartment .
We would like to turn the said apartment into a legally
zoned rental property . Because of the number of years the third
floor has been a rental property , we feel there or should be a
way , be it a grandfather clause and/or statute of limitations
that would enable us to receive approval for zoning to convert
this property at 14 Hathorne St . into a three family dwelling .
