Petition of Habitat for Humanity Requesting a Variance c,
for the Property at 1 Harrison Avenue
City of Salem Zoning Board of Appeals
A public hearing on the above petition was opened on April 18, 2007 pursuant toCD
Massachusetts General Laws Ch. 40A, Sec. 11. The following members of the Salem
Zoning Board of Appeals ("Zoning Board of Appeals") were present: Bonnie Belair C-)T
Elizabeth Debski, Richard Dionne, Annie Harris and Robin Stein. Chairwoman Nirt'23 ?'
Cohen recused herself from the above referenced petition citing a potential conflict'6f
interest. Ms. Stein made a public disclosure that she does not have a potential conflict of
interest, but has volunteered for Habitat for Humanity projects unrelated to the proposed
project at 1 Harrison Avenue.
The petitioner, Habitat for Humanity ("petitioner"), sought a variance from parking
requirements and density requirements for real property located at 1 Harrison Avenue,
Salem, located within a three-family residential (R-3) zoning district.
The Zoning Board of Appeals, after careful consideration of the evidence presented at the
public hearing, and after though review of the petition submitted, submits the following
findings of fact:
1. Petitioner's property is located within a three-family residence district, and
currently consists of a basement and one story.
2. Petitioner proposes to convert the property at I Harrison Avenue to a
two-family residence, in which both dwelling units will be owner
occupied.
3. Petitioner sought a variance to reduce the minimum parking space
requirement of 1.5 spaces per dwelling unit under the existing zoning
ordinance to I space per dwelling unit.
4. Petitioner also sought a variance from the minimum density requirements
of 3,500 square feet per dwelling unit under the existing zoning ordinance
to 1,300 square feet per dwelling unit.
5. J. Michael Sullivan, architect for the Habitat for Humanity, explained that
one dwelling unit would consist of three (3) bedrooms, while the other
dwelling unit would consist of four (4) bedrooms.
6. Warren C. Sawyer was also present on behalf of Habitat for Humanity.
7. Mike Whalen of Salem Harbor CDC, Lucy Corchado (Ward One
Councillor) and Roberta Hussey (8 Crombie Street, Salem, MA), spoke in
favor of the petition.
8. Councillor Corchado also read a letter into the record on behalf of
Altagracia Gomez, President of the Point Neighborhood Association, in
support of the petition.
9. Previously granted zoning relief permitted the property to be used as a
community center.
On the basis of the above findings of fact, including all evidence presented at the public
hearing, including,but not limited to the Petition, the Zoning Board of Appeals concludes
as follows:
1. The petitioner's request for a variance does not constitute substantial
detriment to the public good, nor does the requested relief nullify or
substantially derogate from the intent or purpose of the zoning ordinance.
2. A literal enforcement of the zoning ordinance would create a substantial
hardship to the petitioner.
3. The proposed use presents a significantly less intense use of the property
than a community center and benefits the public by adding two additional
affordable ownership units to the neighborhood.
4. In permitting such change, the Zoning Board of Appeals requires certain
appropriate conditions and safeguards as noted below.
In consideration of the above, five (5) members (Belair, Debski, Dionne, Harris and
Stein) of the Salem Zoning Board of Appeals voted to grant the petitioner's request for a
variance, and zero (0)members voted to deny the petitioner's request for a variance,
subject to the following terms, conditions, and safeguards:
1. Petitioner shall comply with all City and State statutes, ordinances, codes
and regulations.
2. All construction shall be done as per the plans and dimensions submitted
and approved by the Building Commissioner.
3. All requirements of the Salem Fire Department relative to smoke and fire
safety shall be strictly adhered to.
4. Petitioner shall obtain building permit prior to beginning any construction.
5. A Certificate of Occupancy shall be obtained.
6. Petitioner shall obtain proper street numbering from the City of Salem's
Assessors Office and shall display said number as to be visible from the
street.
7. Petitioner is to obtain approval from any City Board or Commission
having jurisdiction including,but not limited to the Planning Board.
8. Unless this decision expressly provides otherwise, any zoning relief
granted does not authorize Petitioner to demolish or reconstruct any
structures(s) on the property to an extent greater than 50% of the structure
as measured by floor area or replacement cost. If a structure on the
property is demolished by any means to an extent of more than fifty
percent of its replacement cost or more than fifty percent of its floor area
at the time of destruction, it shall not be reconstructed except in
conformity with this Ordinance. D

DECISION ON THE PETITION OF SALEM POINT RENTAL PROPERTIES
REQUESTING A SPECIAL PERMIT FOR THE PROPERTY LOCATED AT ONE
HARRISON AVENUE R-2
A hearing on this petition was held on February 18, 2004 with the following Board
Members present: Nina Cohen, Chairman, Richard Dionne, Stephen Harris, Nicholas
Helides and Bonnie Belair. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioner requests a Special Permit to change existing non-conforming use to allow the
construction of a Community Center for the property located at 1 Harrison Avenue
located in a R-2 zone.
The provision of the Salem Zoning Ordinance which is applicable to this request for a
Special Permit is section 5-3 (2) (8), which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board of
Appeal may, in accordance with the procedure and conditions set forth in Section 8-6
and 9-4, grant Special Permits for alterations and reconstruction of nonconforming
structures, and for changes, enlargement, extension of expansion, of nonconforming
lots, land, structures, and uses, provided however, that such change, extension,
enlargement of expansion shall not be substantially more detrimental than the existing
nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests, guided by
the rule that a Special Permit request may be granted upon a finding by the Board that
the grant of the Special Permit will promote the public health, safety, convenience and
welfare of the City's inhabitants.
A. Special conditions and circumstances exist which especially affect the land, building
or structure involved and which are not generally affecting other lands, buildings or
stuctures in the same district.
B. Literal enforcement of the provisions of the Zoning Ordinance would involve
Substantial hardship, financial or otherwise, to the petitioner.
C. Desirable relief may be granted without substantial detriment to the public good and
Without nullifying or substantially derogating from the intent of the district or the
purpose of the ordinance.

1. Petitioner Salem Point Rental Properties seeks a Special Permit to convert an 3�
existing nonconforming one story building at One Harrison Avenue from a factory
to a Community Center for the Salem Community. Petitioner, a subsidiary of the
non-profit Salem Harbor Community Development Corporation, Salem Harbor
CDC, plans to renovate the facility to create a locust for social service
programming, meeting of community organizations and youth services such as
arts and cultural activities, education and jot training. Petitioner's presentation
was made by Attorney William Quinn, James Haskell, Executive Director of
Salem Harbor CDC and Mark Meche, principal of Winter Street Architects, which
designed
2 Petitioner states that the proposed community center will be owned and operated
by Salem Harbor CDC, which will maintain a full-time director onsite during
operating hours. No off street parking is currently available at the site, nor was
any provided during the 25 years that it was used as a manufacturing facility with
25-30 employees. The community center projects daily use to be about 30
adults and 30 children.
3. Many members spoke in support of the proposed community center. Among
proponents were Leoncido Sobiel Taino, President of the Point Neighborhood.
Association, Georgiane Callen, representing St. Andrew's Church which provided
a grant-loan package of $20,000.00 toward the acquisition of the property. Lucy
Corchado, Ward 1 Councillor, Heather Picard, a Director of North Shore
Community Action Program which seeks to run programs for Salem residents at
the community center, Domingo Dominguez, a business owner, Nestor Grullo,
President of VOCES job training organization, Victoria Gonzales, a NSCAP
Board Member, David Ramsay, a neighborhood landlord, Ivan Penn, a Salem
State College student, Rocco Canitillo, a parent, Marcus Ortiz, an employee of
Salem Harbor CDC and Point resident Juan Carlor Hernandez Vega, Director of
Salem Cyberspace which officers computer instruction for teens at a site on
Congress Street, Tano Rosario, a teen coordinator from the Beverly YMCA, and
residents Alcie Maria, Miichelle Meyer, Yoleny Inca, Jose Rodrigues, Alex
Baptista, Yiscleim Santos and Linda Locke. At a prior meeting held in January,
the project was supported by longtime resident and volunteer Jean Gastrnguary
and by Art McDonald of 193 Lafayette Street. A petition signed by 550 residents
in support of the proposal was submitted to the Board.
4. Speaking in opposition to the proposed use were Lola Eanes, owner of the
abutting property at 3-5 Harrison Ave., John Martin, 28 Leavitt St. and Raymond
St. Pierre of 58 Salem Street. Opponents supported the notion of a community
center but not the proposed location. Concerns of opponents centered around
three issues: lack of parking facilities, traffic difficulties caused by increased use
of the building and noise. Jean Martin of 28 Leavitt St provided the Board with
an impact study estimating the number of off-street parking spaces needed in the
area around the property.
5. Proponents secured verbal permission for the use of a parking lot at St. Joseph's
Church during afternoon and evening hours
when the lot is not needed for services, church functions or bingo, and they
agreed to post a police notice on

On the basis of the above findings of fact,and on the evidence presented at the hearing,
the Board of Appeal concludes as follows;

Therefore, the Zoning Board of Appeal voted 4 in favor and 1 in opposition, to grant the
relief requested, subject to the following conditions:

Dear Chair and Members:
I represent Salem Point Rental Properties Corporation. On Feb. 18, 2004 your
Board granted my client a Special Permit to renovate and use the building there as a
Community Center. A copy of that decision, which will expire one year from your vote,
on Feb. 17, 2005, is attached.
To date, my client has not sought a building permit because it has been unable to
comply with condition#9 of the approval, which requires that it obtain and submit a
letter from the Archdioceses indicating permission to use the St. Joseph's Church lot for
parking during afternoon and evening hours for purposes specified in the decision. As
you know,the Archdioceses of Boston has now closed St. Joseph's Church, and the
future ownership and uses of that land are most uncertain.
The extension of time we seek is necessary to give the applicant additional time
needed to ascertain whether such parking will be allowed by the present or any future
user of the church property.
I have attached a copy of MGL Ch. 40A sec. 10, which allows the Board to grant
such an extension in its discretion, and only requires public notice and a new hearing if
that is not accomplished before the original one-year period expires. Please therefore add
this request to an agenda for your January meeting.

Dear Sir. :
In response to your request for a Certificate of Inspection., this
Department inspected 1 17arrison Avenue on March 8, 1977. The
following violations were noted :nd will require correction
prior to the issuance of a Certificate of Inspection.
1 . Dead bolts and locks must be removed from required
egress doors and one motion hardware installed.
2. Adequate emergency lights must be installed to
light paths of egress and egress doors.
3• "Exit" si&ms must be installed to designate egress
doors. These signs° will be installed as per oral
izlstructions to i:3. Piemonte.
4. Storage under basetaent stairs must be discontinued
and the area blocked off,
5. The boiler room must be enclosed, ceiling, and walls,
with two (2) hour fire rated partitions.
A building pormit will. be required for the boiler room oncloeuro.
A reinspection will be made in thirty (30) days to assure compliance.
