In response to complaints,the Health Department has conducted an inspection of the property owned by you at 7
Harris Street. A large accumulation of trash, debris, and appliances have been observed at this property. These
items create a public health nuisance to the occupants and neighbors, creates a "junk yard" condition, and violate
the State Sanitary Code.
In accordance with Massachusetts General Laws, Chapter 111, Section 122, and the State Sanitary Code,
Chapter I, General Administration and Chapter II Minimum Standards of Fitness for Human Habitation, 105 CMR
410.602, you are hereby ordered to remove all refuse,trash, debris and appliances within 48 hours of
receipt of this letter.You are also ordered to place appliances at curbside for municipal collection in
accordance with the schedule provided by the Salem Department of Public Works.You are also ordered to
maintain the property free from refuse, trash, and debris. Failure to obey this order will result in continued
fines and a complaint being sought against you in district or housing court.
Should you be aggrieved by this order, you have the right to request a hearing before the Board of Health. A
request for said hearing must be received in writing in the office of the Board of Health within 7 Days of receipt of
this order. At said hearing, you will be given an opportunity to be heard and to present witness and documentary
evidence as to why this order should be modified or withdrawn. You may be represented by an attorney. Please
also be informed that you have the right to inspect and obtain copies of all relevant inspection or investigation
reports, orders, and other documentary information in the possession of this Board, and that any adverse party
has the right to be present at the hearing.
There are questions of possible zoning infractions, legal number of apartments and whether or not the residence
is being used for business. These matters are being refered to the Building Inspector, Leo Tremblay.

DECISION ON THE PETITION OF MADELINE GALPER, MURRAY P. GALPER, AND.JONAS,
GALPER, 7 HARRIS STREET (R-2 ZONE) TO DIVIDE A LOT RUNNING FROM 8 UPHA14 .,
STREET TO 7 `HARRIS STREET,`ICONTAINING 5,844 SQUARE FEET.
Hearing on this petition was held on October 19, 1976 with Chairman John M.
Gray, Sr., and members Jane T. Lundregan, William Abbott, Arthur LaBrecque
and Donald Eames present. Notices were duly mailed to abutters and others in
accordance with Massachusetts General Laws, Chapter 808.
Attorney Philip Litman represented the petitioner before the Board. He stated
that the lot, at present, contains two separate structures, owned by two
separate persons, and that a mistake in the deed was made when the conveyance
of the property at 8 Upham Street was made to Mark Phillips. By error the
deed encompassed both buildings. The dividing line was meant to be the
fence. The petitioner and Mr. Phillips reached an agreement whereby Mr.
Phillips gave the petitioner a quitclaim deed for the disputed property.
1 The Board voted unanimously to grant the petition requested. The Board found
the literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship to both parties. The Board found that the deed
was`•*given in error and that two separate buildings had existed on the property
before the Zoning Ordinance went into effect, therefore due to special
conditions effecting the particular parcel of land there is a hardship,
The Board felt also, that it could grant the relief requested without substantial
detriment to the public good, or without derogating from the intent of the
Zoning By-law.

THE MASSACHUSETTS GENERAL LA2S, CHAPTER 808, AND SHALL BE FILED 141THIN TI-ENTY
