A hearing on this petition was held October 20, 1999 with the following Board Members
present: Nina Cohen, Chairman, Stephen Harris, Michael Ward, Stephen Buczko and
Richard Dionne. Notice of the hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
The petitioner is requesting a Variance as to on-site parking for the property located at
73-75 Harbor Street located in a R-3- zone.
The Variances which have been requested may be granted upon a finding by this Board
that:
1.Special conditions and circumstances exist which especially affect the land, building or
structures involved and which are not generally affecting other lands, buildings and
structures involve.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioners.
3. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district of the
purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1. The petitioner, Mark F. Easley, is a Trustee of EAZ Realty Trust, the owner of the
property located at 73-75 Harbor Street. The petition was presented by Mark F.
Easley.
2. The subject property is located in a R-3 District.
3. The petitioner requests a variance as to on-site parking. The current nonconforming
and conforming uses of the structure do not conform with the parking provisions of
the Salem Zoning Ordinance.

4. On September 15, 1999, the Zoning Board of Appeal granted the petitioner a Special
permit to add a fourth commercial unit on the first floor, and to increase the licensed
amount of dwelling units on the second and third floors from 15 to 18.
5. In January of 1999, Eric Easley and Scott Galbert(owner of 71 Harbor St) purchased
65 Harbor Street, which was made into a parking lot. The parking lot provides 20
parking spaces. Mr. Easley and Mr. Galbert have divided the lot so that they each
have 10 spaces available for use.
6. Mr. Easley has a eight parking spaces available on the property at 73-75 Harbor St.
The total number of parking spaces available for 73-75 Harbor Street is 18.
7. Mr. Scott Galbert spoke in support of the requested variance at the September 15,
1999 Zoning Board of Appeals meeting.
8. No opposition to the requested Variance was presented.
On the basis of the above findings of fact, and on, the presented at the hearing, the
Zoning Board of Appeal voted unanimously, 5 in favor, to grant the variances requested,
subject to the following condition;
1. Petitioner shall comply with all city and state statues, ordinances, codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted.
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall
be strictly adhered to.
4. Petitioner is to obtain approval from any City Board or Commission having
jurisdiction including, but not limited to, the Licensing Board and the Planning Board.

Petitioner requests a Special Permit to add a commercial unit and increase the licensed
_ amount of dwelling units from 15 to 18 for the property located at 73-75 Harbor Street R3
The provision of the Salem Zoning Ordinance which is applicable to this request for a
Special Permit is section 5-3 Q), which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board of
Appeal may, in accordance with the procedure and conditions set forth in Section 8-6
and 9-4, grant Special Permits for alterations and reconstruction of nonconforming
structures, and for changes, enlargement, extension of expansion of nonconforming lots,
land, structures, and uses, provided, however, that such change, extension,
enlargement or expansion shall not be substantially more detrimental than the existing
nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests, guided by
the rule that a Special Permit request may be granted upon a finding by the Board that
the grant of the Special Permit will promote the public health, safety, convenience and
welfare of the City's inhabitants.
A. Special conditions and circumstances exist which especially affect the land, building
or structure involved and which are not generally affecting other lands, buildings or
stuctures in the same district.

1. The petitioner, Mark F. Easley is Trustee of EAZ Realty Trust, the owner of the
property located at 73-75 Harbor Street. The petition was presented by Mark F.
Easley.
2. The subject property is located in an R-3.
3. The current nonconforming use of the 7000 sq.ft. building located at 73-75 Harbor
Street is as follows; -
Vt Floor Commercial Space A—
Unit 1-A, 925 sq ft. retail or general office use, currently %i of space is rented to
"Maids" Cleaning Co
Unit 1 B, 925 sq. ft. retail or general office use, currently used by chiropractic
services.
Unit 1 —C—_725 sq. ft., restaurant/food establishment which does not serve
Alcoholic beverages.
2"d and 3rd Floors Residential
Currently are 16 rooms and 2 one-bedroom (current license states that only 15
units may be occupied at any one time).
4. The petitioner seeks a Special Permit to add a fourth commercial unit on the first
floor (Unit 1 D) so that an existing —450 sq. ft unit not currently rented could be
(Unit 1-D is comprised of the unrented portion of the current unit 1-A). The
petitioner also seeks to increase the licensed amount of dwelling units on the 2"d
and 3rd floors from 15 to 18 so that they may utilize all the units (16 rooms and 2
one-bedrooms).
5. A letter in support of the additional first floor commercial unit was submitted by
Mr. James T. Haskell, Executive Director, Salem Harbor Community
Development Corporation.
6. Mr. Scott Galber, an owner of the property on Harbor Street, spoke in support of
the requested Special Permit.
7. No opposition to the requested Special Permit was presented.
On the basis of the above findings of fact, and on the evidence presented at the hearing,
the Board of Appeal concludes as follows:
1. Special conditions exist which especially affect the subject property but not the
district in general.

3. The relief requested can be granted without substantial detriment to the public good
and without nullifying or substantially derogating from the intent of the district or the
purpose of the ordinance.
4. The Special Permit granted can be granted in harmony with the neighborhood and
will promote the public health, safety, convenience and welfare of the City's
inhabitants.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the relief
requested, subject to the following conditions:
1. Petitioner shall comply with all city and state statues, codes ordinances and
regulations.
2. All construction shall be done per the plans and dimensions submitted and approved
by the Zoning Enforcement Officer.
3. All requirements of the Salem Fire Department relative to smoke and fire safety
shall be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. A Certificate of Inspection shall be obtained.
6. A Certificate of Occupancy shall be obtained.
7. Petitioner is to obtain approval from any City Board or Commission having
jurisdiction including, but not limited to, the Licensing Board and the Planning Board.
8. Petitioner shall obtain proper street numbering from the.City of Salem Assessors
office and shall display said number so as to be visible from the street.

Legal Remedies for Tenants of Residential Housing
The following is a brief summary of some of the legal remedies tenants may use in order to get
housing code violations corrected :
1. Rent Withholding(Massachusetts General Laws, Chapter 239, section 8A): If Code Violations Are Not
Being Corrected you may be entitled to hold back your rent payments. You can do this without being evicted if:
You can prove that your dwelling unit or common areas contain code violations which are serious
enough to endanger or materially impair your health of safety and that your landlord knew about the
violations before you were behind in your rent.
You did not cause the violations and they can be"r'epaired while you continue to live in the
building.
You are prepared to pay any portion of the rent into court if a judge orders you to pay it. ( For this,
it is best to put the rent money aside in a safe place)
2. Repair and Deduct(Massachusetts General Laws, Chapter III, section 127L): The law sometimes allows
you to use your rent money to make the repairs yourself. If your local code enforcement agency certifies that
there are code violations which may endanger or materially impair your health, safety, or well-being, and
your landlord has received written notice of the violations,you may be able to use this remedy. If the owner
fails to begin necessary repairs(or to enter into a written contract to have them made) within five days after
the notice or to complete repairs within 14 days after notice, you can use up to four months rent in any year
to make repairs.
3. Retaliatory Rent Increases or Evictions Prohibited (Massachusetts General Laws, Chapter 186, section
18, and Chapter 239, Section 2A): The owner may not increase your rent or evict you in retaliation for
making a complaint to your local code enforcement agency about code violations. If the owner raises your
rent to try to evict within six months after you have made the complaint, he or she will have to show a good
reason for the increase or eviction which is unrelated to your complaint. You may be able to sue the landlord
for damages or if he or she tries this.
4. Rent Receivership (Massachusetts General Laws Chapter II, section 127 C-H): The occupants and/or the
Board of Health may petition the District or Superior Court to allow rent to be paid into court rather than to
the owner. The court may then appoint a"receiver"who may spend as much of the rent money as is needed
to correct the violation. The receiver is not subject to a spending limitation of four months'rent.
5. Breach of Warranty of Habitability: You may be entitled to sue your landlord to have all or some of your
rent returned if your dwelling unit does not meet minimum standards of habitability.
6. Unfair& Deceptive Practices (Massachusetts General Laws, Chapter 93A) : Renting an apartment with
code violations is a violation of the consumer protection act and regulations, for which you may sue an
owner.

The. Radiation Control Program is of the opinion that the submitted
shielding design is drawn in conformance with modern radiological
health practice and hereby approves it .
Compliance with 105 CMR 120 . 000 the Massachusetts Regulations for
the Control of Radiation, requires in section 120.025 (A) and (B)
that each person that intends to maintain a facility or acquire a
source of ionizing radiation shall apply to the Massachusetts
Department of Public Health' s Radiation Control Program to register
the facility prior to acquiring, installing or commencing to
maintain the facility.

RE: Appendix A
A) Normal focal film distance will be 40 or 72. X-Ray beam will be vertical except for
minimal uptilt required for cervical AP film. There will be no windows , door
locations, operator's booth and control panel as per design. Please see attached
B) The structural composition and lead lining of walls and x-ray booth partition is as
noted on enclosed room diagram. I have been advised that either solid core wood or
20 gauge steel doors should be used. Our plan does not currently call for the addition
of lead to the floor or ceiling because the space below the office is a locked basement
for which we have the key. The ceiling has three levels, the first level is 2 hour fire
rated sheet rock located 9 feet 9 inches above the floor level, The second ceiling is 3
feet 1 I inches above the first ceiling and is composed of tin covered wood flooring,
approximately 9 inches above this ceiling is the final layer composed of wood. I
believe that this will be adequate for the rooming above since the primary x-ray beam
will never be angled more than 10-15 degrees in the upward direction for the filming
of AP cervical spine.
C) The submitted plan is to scale of 1\4 inch to the foot.
D) Walla currently not in use but proposed usage will be as an office suite or store.

THAT ARE UANNIN MODIFICATION
Registration of x-ray units in the Commonwealth of Massachusetts is
mandatory. Each person who owns or possesses and administratively
controls a radiation machine facility shall apply for registration with
the Radiation Control Program. The facility shall possess a valid
Certificate of Registration pr- or to operation of a radiation machine
facility.
If the facility is npw follow this procedure :
1. Prior to construction, a shielding plan shall be submitted to
the Radiation Control Program for review and approval. The plan
shall meet the requirements of Appendices "A" , and "C" unless
an exemption is specifically requested. These appendices are
included in this packet .
2 . An application for registration is included in this packet. The
shielding design will not be reviewed unless the application
for registration is submitted with the shielding design. After
the application for registration is reviewed by the Radiation
Control Program and assigned a number, an invoice will be sent
to the facility. A Certificate of Registration will be issued
to the facility by the Radiation Control Program upon payment
of the required fee. Each facility shall possess a valid
Certificate of Registration prior to operation of such
facility.

Return the completed application with the shielding design. The
shielding plan bail not be reviewed unless the application for
registration, is'AkretUrned with the shielding design. it is
=erative that you put your radiation control number on the
right top corner of the application, and put your RCN on your
submitted shielding design. Your radiation control number can
be found on your Certificate of Registration. The application
shall include all the current information about your facility.
Inclusion of your radiation control number will prevent your
facility from being registered as a new facility.
The Radiation Control Program encourages persons to submit their own
shielding designs. However, the services of a qualified expert may be
utilized. A list of health physics consultants is included if you would
like to contract for their services .

Radiation Shielding and Safety Requirements
In order for the Radiation Control Program to provide an
evaluation, and official approval on shielding requirements for a
radiation installation, the following must be submitted. The
plans shall, show as a minimum the following:

(A) The normal location of the x-ray system' s radiation port,
the port ' s travel and transverse limits, general
direction(s) of the useful beam; locations of any windows
and doors; the location of the operator' s booth and the
location of the x-ray control panel .
(B) The structural composition and thickness or lead
equivalent of all walls, doors, partitions, floor and
ceiling of the room(s) concerned.
(C) The dimensions of the room(s) concerned.
(g) The type of occupancy of all adjacent areas inclusive of
space above and below the room (s) concerned. If there is
any exterior wall, show distance to the closest area (s)
where it is likely that individuals will be present .
(E) The make and model of the x-ray equipment .
(F) The typical type of examination (s) and treatment (s) which
will be performed with the equipment.
(G) Information on the anticipated workload of the x-ray
system(s) .
(H) An interlock and/or warning light shall be installed at
all egresses . For diagnostic x-ray installations, the
warning light shall be wired to the rotor of the x-ray
system.
(I) All basic assumptions used to determine the shielding
requirements in developing these plans shall be submitted
with these plans .

Design Reauirements for an Operator' s Booth
(A) Space Requirements
(1) The operator shall be allotted not less than 7 . 5
square feet (0 . 697 m2) of unobstructed floor space in
the booth.
(2) The operator' s booth may be any geometric
configuration with no dimension of less than two feet
(0 . 61 m) .
(3) The space shall be allotted excluding any encumbrance
by the x-ray control panel, such as overhang, cables
or other similar encroachments .
(4) The booth shall be located or constructed such that
unattenuated direct scatter radiation originating in
the examination table or at the wall cassette shall
not reach the operator' s station in the booth.
(B) Structural Requirements
(1) The booth walls shall be permanently fixed barriers of
at least seven feet (2 . 13 m) high.
(2) When a door or movable panel is used as an integral
part of the booth structure, it must have an
interlock which will prevent an exposure when the
door or panel is not closed.
(3) Shielding shall be provided to maintain exposure
inside the booth equal to or less than two mR per
week.
(c) X-Rav Control Placement . The x-ray exposure switch for
the system shall be fixed within the booth and;
(1) Shall be at least 40 inches (1 . 02 m) from any open
edge of the booth and;
(2) Shall allow the operator to use the majority of the
available viewing windows .

(D) Viewing Syste Requirements.
(1) Each booth shall have at least one viewing device
which will :
(a) Be so placed that the operator can view the
patient during any exposure; and,
(b) The device should be so placed that the operator
can have full view of any occupant of the room
and..should be so placed that the operator can
view any entry into the room. If any door that
allows access to the room cannot be seen from the
booth, then that door must have an interlock
controlling the exposure, which will prevent the
exposure if the door is not closed.
(2) When the viewing system is a window, the following
requirements also apply:
(a) The viewing area shall be at least one square
foot (0 . 0929 m2) .
(b) The design of the booth shall be such that the
operator' s expected position when viewing the
patient and operating the x-ray system is at
least 18 inches (0 .457m) from the edge of the
booth.
(c) The material constituting the window shall have
at least the same lead equivalence as that
required in the booth' s walls in which it
is mounted.
(3) When the viewing system is by mirrors, the mirrors)
shall be so located as to accomplish the general
requirements of 105 CMR 120 .421 : Appendix B section
4 . (A) .
(4) When the viewing system ,is by electronic means :
(a) The camera shall be so located as to accomplish
the general requirements of 105 CMR 120 . 421 :
Appendix B section 4 . (A) ; and,
(b) There shall be an alternate viewing system as a
backup for the primary system.
(c) Means shall be provided for the operator to be
able to orally communicate with the patient at
all times .

A hearing on this Petition was held December 17, 1997 with the following Members present: Gary Barrett,
Chairman: Richard Dionne, Paul Valaskagis,Nina Cohen and Albert Hill.Notice of the hearing was sent to abutters
and others and notices of the hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws chapter 40A.
Petitioner, represented by Attorney George Atkins, is requesting a Special Permit for a Change in Use/also
Variance/Special Permit from parking requirements for the property located at 73-75 Harbor Street.
The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is section 5-
30), which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance,the Board of Appeal may, in accordance with
the procedure and conditions set forth in Section 8-6 and 9-4, grant Special Permits for alterations and reconstruction
of nonconforming structures,and for changes,enlargement,extension or expansion of nonconforming lots, land,
structures,and uses, provided,however,that such change,extension,enlargement or expansion shall not be
substantially more detrimental than the existing nonconforming use to the neighborhood.
In more general terms,this Board is, when reviewing Special Permit requests, guided by the rule that a Special
Permit may be granted upon a finding by the Board that the grant of the Special Permit will promote the public
health. safety,convenience and welfare of the City's inhabitants.
The Variances and Special Permits which have been requested may be granted upon a finding of the Board that:
A. Special conditions and circumstances exist which especially affect the land, building or structure involved and
which are not generally affecting other lands, buildings or structures in the same district.
B. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or
otherwise, to the petitioner.
C. Desirable relief may be granted without substantial detriment to the public good and without nullifying or
substantially derogating from the intent of the district or the purpose of the Ordinance.
The Board of Appeal,after careful consideration of the evidence presented. and after viewing the plans, makes the
tollowing findings of fact:
I. There was no opposition to the Petition.
2. Jean Martin of the Point Neighborhood Action Group and Scott Gelber of 71 Harbor Street spoke in favor of
the Petition.
3. The current nonconforming use for this property is a restaurant/bar serving alcoholic beverages•. The proposed
multiple uses will consist of three(3) units as follows:
a. Take out food restaurant which will not serve alcoholic beverages.
b. Professional office for chiropractic services.
c. Retail or General office use.
4. This will allow the Petitioner fuller use of the property.

On the basis of the above findings of fact,and on the evidence presented at the hearing,the Board of Appeal
concludes as follows:
I. Special conditions exist which especially affect the subject property but not the district in general.
2. Literal enforcement of the provisions of the Ordinance would involve substantial hardship on the petitioner.
3. the relief requested can be ;ranted without substantial detriment to the public good and without nullifying or
substantially derogating from the intent of the district or the purpose of the ordinance.

3. All requirements of the Salem fire Department relative to smoke and fire safety shall be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. A Certificate of Occupancy is to be obtained.
6. A Certificate of Inspection is to be obtained.
7. Petitioner shall obtain proper street numbering from the City of Salem Assessors office for the business accessed
from Congress Street, and display said number so as to be visible from the street.
S. Petitioner is to obtain approval from any City Board or commission having jurisdiction including, but not
limited to, the Planning board.
9. Petitioner shall ensure that the dumpster is not visible from the street and that the dumpster is a reasonable
distance from abutters.

The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations

1, Rent Withholding(Massachusetts General laws,Chapter 239,section 8A): If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A. You can prove thatyour dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in,
your rent.
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rentlinto court if a judge orders you to pay it. (For this,it is best to put the,
rent money aside in a safe place.)
