65 HARBOR STREET - BUILDING INSPECTION 65 HARBOR STRUT BID SPECIFICATIONS CITY OF SALEM DEMOLITION OF 65 HARBOR STREET The City of Salem is requesting sealed bids from qualified contractors to undertake the demolition of 65 Harbor Street. All work to meet current Federal, State and local codes and regulations. A hazardous materials report from Enpro Services, Inc. is part of these bid documents. ALL WORK UNDER THIS CONTRACT MUST BE COMPLETED BY MAY 30, 1998. 1. Scope of Services 1. Conduct site inspection. The demolition contractor shall initially be accompanied to the site by the building inspector or other municipal employee as designated by the building inspector. 2. Assure that all utilities and city services (e.g. water, sewer, gas, electricity, etc.) are disconnected and appropriate steps are taken to protect the City's interest in the property(e.g. capping of disconnected sewers at manhole; water and gas to be disconnected an properly capped at main line). Before demolishing and removing any parts of the building having electrical wiring, gas or water pipes, conduit or similar items embedded in them, notify municipal departments having jurisdiction and the utility company and make sure that these items are out of service so that they can be removed without danger. A permit to demolish shall not be issued until a release is obtained(stating their respective service connections an appurtenance equipment such as meters and regulators have been removed or sealed and Plugged in a safe manner) from any utility company's having service connections in the building. 3. Take rodent control measures prior to demolition. Verification that an extermination has been done will be required prior to demolition. 4. Prior to commencement of demolition work, inspect areas where such work will be performed. Photograph existing conditions of structure, surfaces, equipment and surrounding structures and areas which could be misconstrued as damaged by demolition work; file photos with the Salem Planning Department prior to starting work. 5. Provide all measures required by Federal, municipal and State ordinances, laws, and regulations for the protection of surrounding property,sidewalks, cubs,the public,workmen, and Owner's employees from any and all hazards during and after demolition operations. Measures taken, including sidewalk shed, barricades, fences, warning lights and signs, rubbish chutes, etc., shall be in strict accordance also with the American National Standard Code for Building Construction Al 0.6 as well as all applicable Federal, local, municipal and State ordinances and laws. 6. Provide police protection during demolition. 7. Conduct a thorough search of the property immediately prior to demolition to assure that the property is vacant. S. Complete demolition of the structure located at 65 Harbor Street in conformity with applicable public laws M.G.L. c. 30 s. 39M or M.G.L. c. 149, ss. 44A-H. Conduct selective demolition operations and debris removal in a manner to ensure minimum interference with roads, streets, walks, and other adjacent occupied or used facilities. Do not close, block or otherwise obstruct streets, walks or other occupied or used facilities without written permission from authorities having jurisdiction. Minimize noise-producing activities and perform them during normal working hours. No blasting or use of explosives will be permitted. Demolish foundation walls to a depth of not less than 24" below the proposed grade. Demolish and remove below-grade wood,metal construction and floor construction or floor slab. Demolition shall be carried on in a manner that will insure the safety of adjacent property,property which is occupied, and persons occupying such property against all damage and injury which might occur from falling debris or other cause, and so as not to interfere with the use of adjacent buildings and structures or the free and safe passage to and from the same. Take every precaution to guard against movement or settlement of adjacent buildings, sidewalks and streets. Provide and place at Contractor's own expense, all necessary bracing and shoring in connection with demolition work,and be solely and entirely responsible for the complete safety and support of such construction. Removal of portions of structures shall be done with care using tools and methods that will not transfer heavy shocks to existing adjacent buildings. Care shall be taken to minimize vibration and other disturbances. Protect all walks, roads, streets, curbs, pavements,trees and planting,on or off the premises, and repair and replace or otherwise make good all damage as directed by the City. Promptly repair damage to adjacent facilities caused by demolition work at no additional cost to the City. Materials shall not be dropped or thrown from upper stories, but shall be lowered by means of hoists or rubbish chutes. Materials shall be thoroughly wetted down during demolition. 9. Remove and provide proper off-site disposal of demolition debris, including any hazardous debris. Make all arrangements for legal disposal of such materials. Debris shall not be allowed to accumulate and shall be sprinkled to minimize dust during handling and loading. Combustible material and rubbish shall be hauled away daily. No debris shall be burned at the job site. Comply with applicable environmental protection regulations. Trucks used in hauling debris shall be equipped with tarpaulins to cover the loads and shall not be loaded so excessively as to spill debris on streets. Except otherwise specifically indicated, all existing items removed as part of the work under this Section shall become the property of the Contractor and shall be removed from the site and legally disposed of at his expense. No materials shall be sold on the site. 10. Conduct follow-up rodent control measures. I I. Fill foundation hole with clean fill, compact and grade to meet surrounding elevations. Provisions shall be made to prevent the accumulation of water or damage to any foundations on adjoining property. Install 4" of loam and and establish a continuous lawn surface area on the lot at recommended planting season conditions. Contractor shall be responsible for watering until the lawn is established. Secure the site with 6' chain link fence. 12. At completion of removal work, all rubbish, debris and waste materials from and about the building , including all tools, scaffolds, apparatus and appliances used in connection with work under this specification, shall be removed and the premises shall be left in clean condition. II. Conditions I. The Contractor shall be responsible for obtaining all necessary permits and complying with public health, environmental, and all other federal, state or local laws and regulations applicable to the demolition of a building, and all other work to be performed under this contract. ?. Before a structure can be demolished,the Salem Fire Department shall conduct a preliminary demolition inspection, to ascertain any conditions which may require a fire watch or other preventive measures, to be taken before, during and/or after said demolition process. A permit to demolish or remove a building or structure shall not be issued until said inspection has been conducted, and a report of requirements necessary for prevention of fire and life safety hazards shall be obtained by the applicant for the permit. The requirements outlined in the report shall become a part of the restrictions portion of the demolition permit issued by the Building Inspector, for compliance with the Code. The inspection report shall include, but no necessarily be restricted to the following: a) welding and cutting permit required; and b) fire watch to be maintained by a professional off-duty firefighter, with such equipment as determined by the head of the Fire Department. 3. No demolition may proceed until the City has provided adjacent property owners and tenants with 14 days notification of demolition and measures to be taken for the protection of such properties. 4. Contractor shall submit evidence of the removal and proper off-site disposal of demolition debris, in the form of trucking slips, and, in the case of hazardous materials, manifests and disposal permits. III. Oualifications The Contractor must be DCPO certified and be licensed by the City of Salem. If it appears that such structure would be especially unsafe in case of fire, it shall be deemed dangerous within the meaning hereof, and the building official may affix in a conspicuous place upon its exterior walls a notice of its dangerous condition, which shall not be removed or defaced without authority from him. 123.2 Removal or making structure safe: Any person so notified shall be allowed until twelve o'clock noon of the day following the service of the notice in which to begin to remove such building or structure or make it safe, or to make it secure, and he shall employ sufficient labor speedily to make it safe or remove it or to make it secure; but if the public safety so requires and if the mayor or selectmen so order, the building official may immediately enter upon the premises with the necessary workmen and assistants and cause such unsafe structure to be made safe or demolished without delay and a proper fence put up for the protection of passersby, or to be made secure. SECTION 124.0 EMERGENCY MEASURES 124.1 Failure to remove or make structure safe, survey board, survey report: If an owner of such unsafe structure refuses or neglects to comply with the requirements of such notice within the specified time limit, and such structure is not made safe or taken down as ordered therein, a careful survey of the premises shall be made by a board consisting; in a city, of a city engineer, the head of the fire department, as such term is defined in Section 1 of Chapter 148 of the Massachusetts General Laws Annotated, as amended, and one disinterested person to be appointed by the building official; and, in a town, of a surveyor, the head of the fire department and one disinterested person to be appointed by the building official. In the absence of any of the above officers or individuals, the mayor or selectmen shall designate one or more officers or other suitable persons in place of the officers so named as members of said board. As a resident it was wonderful to have the opportunity to bring to your attention the abandoned apartment building at 65 Harbor Street which is a fire hazard, safety hazard and a liability to adjacent property owners. The property at 65 Harbor Street has not been secured and children from toddlers to teenagers play in the dark,vacant courtyard and garbage shack where they gain access to the roof at 60 and 64 Ward Street through openings in the chain link fence. The building itself is not completely secured and is accessible as well. Numerous senseless acts of vandalism not only damage surrounding property but endanger lives,yet we have no control over the situation. As you know C&A Realty Trust is the owner and the building has been in Land Court since June 1992 due to non payment of taxes dating back to 1990. We, the abutters, suggest that the property be secured to prevent a serious accident and further damage to our property. We would be happy to meet with you to inspect the abandoned property and discuss our experiences with trespassing,rodents and vandalism. We are willing to work with you to improve this situation. As you know C&A Realty Trust is the owner and the building has been in Land Court since June 1992 due to non payment of taxes dating back to 1990.We,the abutters, suggest that the property be secured to prevent a serious accident and further damage to our property. P 921 991 591 ADMINISTRATION AND ENFORCEMENT SECTION 123.0 UNSAFE STRUCTURES 123.1 Inspection: The building official immediately upon being informed by report or otherwise that a building or other structure or anything attached thereto or connected therewith is dangerous to life or limb or that any building in that city or town is unused, uninhabited or abandoned, and open to the weather, shall inspect the same; and he shall forthwith in writing notify the owner to remove it or make it safe if it appears to him to be dangerous, or to make it secure if it is unused, uninhabited or abandoned and open to the weather. If it appears that such structure would be especially unsafe in case of fire, it shall be deemed dangerous within the meaning hereof, and the building official may affix in a conspicuous place upon its exterior walls a notice of its dangerous condition, which shall not be removed or defaced without authority from him. 123.2 Removal or making structure safe: Any person so notified shall be allowed until twelve o'clock noon of the day following the service of the notice in which to begin to remove such building or structure or make it safe, or to make it secure, and he shall employ sufficient labor speedily to make it safe or remove it or to make it secure; but if the public safety so requires and if the mayor or selectmen so order, the building official may immediately enter upon the premises with the necessary workmen and assistants and cause such unsafe structure to be made safe or demolished without delay and a proper fence put up for the protection of passersby, or to be made secure. SECTION 124.0 EMERGENCY MEASURES 124.1 Failure to remove or make structure safe, survey board, survey report: If an owner of such unsafe structure refuses or neglects to comply with the requirements of such notice within the specified time limit, and such structure is not made safe or taken down as ordered therein, a careful survey of the premises shall be made by a board consisting; in a city, of a city engineer, the head of the fire department, as such term is defined in Section 1 of Chapter 148 of the Massachusetts General Laws Annotated, as amended, and one disinterested person to be appointed by the building official; and, in a town, of a surveyor, the head of the fire department and one disinterested person to be appointed by the building official. In the absence of any of the above officers or individuals, the mayor or selectmen shall designate one or more officers or other suitable persons in place of the officers so named as members of said board. (C) Digs Containing Fewer Than Three Dwelling3L: In a dwelling that contains fewer than three dwelling units,the occupant shall be responsible for maintaining in a clean and sanitary condition free of garbage,rubbish,other filth or causes of sickness the stairs or stairways leading to her or his dwelling unit and the landing adjacent to her or his dwelling unit if the stairs,stairways,or landing are not used by another occupant (D) Common ras: In any dwelling,the owner shall be responsible for maintaining in a clean and sanitary condition free of garbage,rubbish, other filth or cusses of sickness that part of the dwelling which is used in common by the occupants and which is not occupied or controlled by me occupant exclusively. - - (i)The owner of any dwelling abutting a private passageway or right-of-way owned or used in common with other dwellings or which the owner or occupants under her or his control have the right to use or are in fact using shall be responsible for maintaining in a clean and sanitary condition free from garbage,rubbish,other filth or cause of sickness that pan of the passageway or right-of-way which abuts her or his property and which s/he or the occupants under her or his control have the right to use,are in fact using,or which s/he owns.
