Statements of fact:
1. Edward A. Potvin, Executive Director of Bass River, presented the petition afthe hearing.
2. In a petition date-stamped February 1, 2012, petitioner requested a Special Permit and a
Variance to construct a 36' x 18' second floor addition on the side of the building and a 25' x 18' x
16' second floor addition on the rear of the building at 12 Hanson Street.
3. At the hearing, Mr. Potvin stated that the purpose of the additions was to accommodate clients'
changing needs; as they aged, there were more people using wheelchairs and walkers.

4. No one at the hearing spoke in support of or in opposition to the project.
The Board of Appeal, after careful consideration of the evidence presented at the public hearing, and
after thorough review of the plans and petition submitted, makes the following findings:
1. Special conditions and circumstances exist affecting the parcel or building, which do not
generally affect other land or buildings in the same district, since Bass River's clients with physical

limitations require a horizontal rather than vertical expansion, and the building has other
internal restrictions.
2. Owing to the configuration of the lot and building, literal enforcement of the provisions
of this ordinance would involve substantial hardship, financial or otherwise, to the
appellant.

3. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent or purpose of the zoning
ordinance. The design is in keeping with the neighborhood.
4. In permitting such change, the Board of Appeals requires certain appropriate conditions
and safeguards as noted below.

by your company at the property located at 12 Hanson Street. The complaint was investigated and the
work was found to be in violation of the Massachusetts State Building Code, Section 1804.2—Placement
of Backfill and Section 1804.5—Compacted Fill Material, 8`"Edition.
You are hereby ordered to begin to rectify these conditions immediately upon receipt of this notice;
failure to respond to this notification will be construed as non- compliance, with issuance of Municipal
tickets and/or the filing of charges in Massachusetts District Court.
If you feel aggrieved by this Notice you have the right to appeal this order to the State Board of Building

Damage from Earthwork on Adjacent Property
Dear Mr. Potvin:
As requested, the undersigned made a limited visual inspection of the existing
building at the subject location this date. The purpose of the inspection was to
determine if structural damage had occurred due to recent earthwork on the
abutting 5 Nichols Street property.
Background
You explained that approximately two or three days ago, vegetation, soil and
rock removal occurred on the abutting property. The work has stopped as
directed by the City of Salem building inspector.
The 12 Hanson Street building is located at the corner of Nichols, Butler and
Hanson Streets. According to City of Salem records, the building was
constructed in approximately 1900. The building is two stories tall with a partial
roof deck. The building did not appear to have a basement.
Bass River Inc. remodeled the building in approximately 1998. Prior to that time
the building was used for commercial storage and industrial purposes. The
building appears to be a mix of timber, masonry and steel construction. The
exterior of the building has metal siding and trim.
Observations
The north side of the building is supported by a stone masonry and brick
foundation wall that bears on an existing ledge formation (see attached
photograph). The recent stripping of soil and vegetation, and rock removal by a
hydraulic hoe-ram, have disturbed and damaged the stone masonry building
foundation wall. Stones and mortar have been displaced by the recent work.
We visually examined the interior of the building near the area of the recent
earthwork. The building interior is generally finished with painted plaster with
wood trim and a tile acoustical ceiling. Flooring is a mixture of carpet and vinyl
floor coverings. No damage was apparent to these finishes.

On the northwest side of the building a chain-link fence and block retaining wall
exist which secure the property and support a driveway. The aforementioned
earthwork has caused the chain link fence. and wall to rotate towards the
adjacent property, separating the wall from the pavement, and has caused
settlement of the driveway along the wall. The area has been cordoned-off due
to the instability (photograph attached).
Recommendations.
1. We recommend that no further site work occur on the adjacent property
until the damage to the existing building, wall, fence and driveway are
restored and until plans prepared by a registered professional engineer
are presented demonstrating that such site work can be undertaken
without threatening further damage to the existing structures.
2. We recommend that the existing building foundation wall be repointed.
The connection between the existing foundation wall and the ledge was
not apparent during our visual inspection. We recommend cleaning any
loose soil off the ledge as necessary, and pinning the foundation wall to
the ledge as necessary.
3. An existing clay pipe was apparent along the northeast side of the
building. The pipe was partially clogged with soil and partially broken.
We recommend investigating the purpose of this pipe and cleaning and
reparing the pipe as appropriate.
4. The existing fence and retaining wall should be removed and
reconstructed. Wall construction should be in accordance with wall
manufacturer recommendations for the grade and driveway conditions.
5. Continue to inspect the failed retaining wall and pavement area. Maintain
barricades to prevent access to the area.

The Board of Appeals voted to grant petitioner's request for a Variance and Special Permits

Petition of Bass River Inc. requesting a Variance from the number of stories
allowed (2 %) to allow a third floor roof deck and a Special Permit to modify
an existing non-conforming structure for the property located at 12 HANSON
STREET [R-21.
A public hearing on the above petition was opened on October 17, 2007 pursuant to Mass
General Law Ch. 40A, Sec. 11, with the following Zoning Board members present: Robin Stein,
Rebecca Curran, Richard Dionne, Bonnie Belair and Elizabeth Debski.
Petitioner seeks variances pursuant to Section 9-5 and a special permit pursuant to Section 8-4 to
construct a third (3`d) floor roof deck.
The Board of Appeal, after careful consideration of the evidence presented at the public hearing,
and after thorough review of the plans and petition submitted, makes the following findings of
fact:
1. Attorney Patrick Burke presented the petition for the property owned by Bass River
Inc. at 12 Hanson Street in the R-2 Zoning District.
2. Bass River Inc. provides mentally handicap adults with supervised work and
educational experiences. The facility at 12 Hanson Street is open Monday thru
Friday, typically between 9:00 am and 3:00 pm.
3. Bass River Inc. proposes to construct a third floor roof deck as shown on the plans
prepared by Deer Hill Architects, LLC entitled "Proposed Roof Deck", dated June 8,
2007, sheets Al-A3. Said roof deck is approximately 28' x 19' and includes a
stairway bulkhead.
4. The roof deck will be used for container gardening and it will provide program
participants with the opportunity to get outside and learn new skills. Program
participants will be supervised when using the proposed roof deck.
5. A letter of support was submitted by Leo Jodoin (8 Hanson St) and Mark Chesley (6
Hanson St).
6. The Building Inspector, Thomas St. Pierre informed the Board of Appeals that the
facility is well run and he has never found any problems when doing inspections

On the basis of the above findings of fact and all evidence presented at the public hearing
including,but not limited to, the Plans,Documents and testimony, the Zoning Board of Appeals
concludes as follows:
1. The petitioner may vary the terms of the Residential Two-Family Zoning District to
enable the proposed development, which development is consistent with the intent
and purpose of the City of Salem Zoning Ordinance.
2. In permitting such change, the Board of Appeals requires certain appropriate
conditions and safeguards as noted below.
In consideration of the above, the Salem Board of Appeals voted, five (5) in favor(Stein, Debski,
Belair, Dionne, and Curran)none (0) opposed, to grant petitioner's requests for a variance and
special permit subject to the following terms, conditions, and safeguards:
1. Petitioner shall comply with all city and state statutes, ordinances, codes and regulations.
2. All construction shall be done as per the plans and dimensions submitted to and approved
by the Building Commissioner.

Articles of Incorporation and Mass. Gen. L. Ch. 40A, § 3. I believe that Mr. Potvin is correct in
his application of that section of Chapter 40A, Bass River's intended use of this site is
permissible. Indeed, we are prohibited by state law to restrict this use.
I have also discussed this matter with City Solicitor Robert Ledoux who has also
discussed with Mayor Harrington. At this time, I have informed Mr. Potvin of my decision. Bass
River expected to close on the property on December 1, 1997 and hopes to be in the location by
mid-February 1998. _

According to Section VII, Paragraph C.1- It appears to me that
the intent of Paragraph C comes into place after the effective
date of the Ordinance and then only if parking areas are
erected, enlarged or altered.

In your letter of June 20, 1990 you state:
" .. it was noted that you have had your yard resurfaced up to
the lot line..:'.
Since by your description I am resurfacing my yard and since
according to Section VIII, Salem Zoning Ordinance covering non
conforming structures, I am not allowed to enlarge or erect; I
fail to see how Section VII, Paragraph C.1. applies to this
situation. I do not believe the intent of this Section or the
Zoning Ordinance, in general, should be used to prevent me
from resurfacing, repaving and improving the safety and
appearance of an 85 year old existing situation.
I feel certain we both could save the city a good deal of time
and money if you were to review this with the City Solicitor
as a "Re-Surfacing" project to a pre-existing yard; in a
neighborhood A where paving to lot lines is very common.
For your infor".mation I am enclosing a copy of a letter which
points out the mutual agreement between myself and my abutter,
showing that he is in favor of resurfacing to our mutual lot
line. I am also enclosing a copy of my letter to Mr. Monroe.
It is my hope that this situation can bee resolved without the
need for your office to take legal action against me.

I am resurfacing existing driveways as they were - up to the
lot lines, �as they have always been. Since my building is
located right on the property line, the driveway area has
always been surfaced up to the building',and property lines.
I have levelled the surface, repaved and resurfaced the entire
area. This area was covered with--rocks, crumbly hot top and
pavement, weeds, dirt etc. and I am trying to clean it up,
improve its appearance and make: it safer.
This driveway area has been in existence for the eight years I
have owned the property and has -always been surfaced up to the
property line.
According to the previous owner the area was paved up to the
lot line for at least 25 years before I bought the property in
1982. I am sure that resurfacing the driveways up to the
property lines, as they have always been, can not hurt the
City now, if being paved to the property lines did not hurt
the City for the last 35 years or more. `

Dear Mr Monroe,
On June 18 ,1990 I wrote you concerning the illegal
activities occuring at 12 Hanson St. You apparently
visited the site and concluded that in fact the owner was
in violation of particular zoning ordinances. You ordered
him to comply with your written notice within 15 days or you
would take legal action.
Mr Monroe, a month has passed and nothing has been done
to comply with your notice. Furthermore, no action has been
taken to remove the landscaping done to create a loading dock

Dear Mr . Mgnroe ,
On Wednesday June 6 , 1990 I informed my councilor Leonard
O 'Leary -in the company of administrative assistant David Shea
that the owner of a vacant building addressed as 12 Hanson St .
was -developing his landscape so to provide a loading dock to
the second floor of the building .
To be right "up front" as the property owner of 2 & 4
Nichols St . a near abutter, I am well aware that 12 Hanson St .
is grandfather zoned as a "tannery" . Being born and brought
up in the immediate neighborhood I accept that .
Through the owners attorney, Mr . Vallis , a petition was
filed with the board of appeal to "re construct" a secondary
loading area at 12 Hanson St . As the minutes will show at this
hearing of Jan. 17 , 1990 , there was strenous opposition . Thus a
continuation was requested and granted . I might add that at
this hearing Mr . Vallis reiterated that the building was to be
used as a "tannery" . An extention was granted to Feb. 21 , 1990
by the board of appeals with the condition that the petitioner
hold a hearing chaired by Ward 4 councilor Leonard O 'Leary .
The hearing was never held and on Feb. 21 , 1990, Mr . Vallis
admitted to this and withdrew his petition "without predudice" .
Sometime between June 4th and June 6th in the area of 30
yards of gravel was off loaded to develop the landscape at 12
Hanson St . to make for a loading dock to the second floor of
this building
Testimony of the residents will prove that there was
never a loading dock at this location and any attemptto con-
struct such will be met with strenous opposition . This is
a direct violation of the zoning code and will not be condoned .

With an elderly housing project (Colonial Terrace ) across
the street , small children (my grandchildren included) and a
four way intersection at the exact location, the traffic impact
and safety alone should forbid this illegal construction .

as it is of prime importance to me and my family .

The Salem City Council recently passed the attached ordinance which
requires that all developers of six (6) or more residential dwelling
units or 10,000 square feet of commercial space hire specifi%
percentages of Salem and Salem area employees for their construction
work.

The purpose of the ordinance is to ensure that Salem and Salem Area
residents receive the maximum benefits from the growing construction
ecomcny of the City of Salem.
A preconstruction conference will be scheduled by the Planning
Department to discuss and explain the developer's requirements as
outlined in the City of Salem Ordinance. The following information
shall be furnished by the developer to ensure compliance with this
ordinance:
Upon issuance of a Building Permit, the developer shall submit to the
Salem Planning Department the following requested information:
a. scope of construction;
b. construction time schedule;
c. projected number of employees and man—hours;
d. types of trades to be hired; and
e. names, addresses, and principals of contractors and
sub—contractors being hired.
Upon initiation of construction, all developers shall submit weekly
workforce reports listing the following:
a. names of employees;
b. residential address of each employee;
c. craft of each employee;
d. job category of each employee;
e. hours worked of each employee;
f. hourly wage of each employee; and
g. company which each employee is employed by.

stated permit is subject to section 127, CONSTRUCTION CONTROL, of the
Massachusetts State Building Code.
All construction documents, including but not limited to working
drawings, shop drawings and specifications shall be prepared and approved
by a registered professional architect or engineer. These documents shall

Progress reports shall be submitted by a registered professional
architect or engineer to the Building Department on a by-weekly basis.

Also, at the completion of the project, the general contractor recorded
on the permit shall certify to the best of his knowledge the the work has

a safe and satisfactory manner in accordance with all applicable local, state
and federal statutes and regulations.
Failure to produce reports shall result in a cease and desist order
placed upon your project within five (5) days after an established due date
has passed.

The above-mentioned statute requires that debris resulting from the demolition, renovation, rehabilitation
or other alteration of a building or structure he disposed of in a properly licensed solid waste disposal
facility as defined by MGL cI11. S150 and that building permits or licenses are to indicate the location
of the facility at which the said debris is to he disposed. THIS REOUIREMENT DOES NOT
APPLY TO NEW CONSTRUCTION.
In order to simnlifv the process and to provide umformuv. we are attaching a copy of a form which you
can either reproduce and use as it is since the completed form will be attached to the office copy of building
permits or licenses; of reproduce it on your letterhead.
In cue of municipal,commercial,industrial,or multi-unit housine construction, the contractor may not know
the dumpster subcontractor at the time of the building permit application. In such cases, the attached copy
of an Affidavit can be used.

Dear Mr . Mgnroe ,
On Wednesday June 6 , 1990 I informed my councilor Leonard
O'Leary in the company of administrative assistant David Shea
that the owner of a vacant building addressed as 12 Hanson St .
was developing his landscape so to provide a loading dock to
the second floor -of the building .
To be right "up front" as the property owner of 2 & 4
Nichols St . a near abutter , I am well aware that 12 Hanson St .
is grandfather zoned as a "tannery" . Being born and brought
up in the immediate neighborhood I accept that .
Through the owners attorney , Mr . Vallis , a petition was
filed with the board of appeal to "re construct" a secondary
loading area at 12 Hanson St . As the minutes will show at this
hearing of Jan . 17 , 1990 , there was strenous opposition . Thus a
continuation was requested and granted . I might add that at
this hearing Mr . Vallis reiterated that the building was to be
used as a "tannery" . An extention was granted to Feb. 21 , 1990
by the board of appeals with the condition that the petitioner
hold a hearing chaired by Ward 4 councilor Leonard O ' Leary .
The hearing was never held and on Feb. 21 , 1990 , Mr . Vallis
admitted to this and withdrew his petition "without predudice" .
Sometime between June 4th and June 6th in the area of 30
yards of gravel was off loaded to develop the landscape at 12
Hanson St . to make for a loading dock to the second floor of
this building
Testimony of the residents will prove that there was
never a loading dock at this location and any attemptto con-
struct such will be met with strenous opposition . This is
a direct violation of the zoning code and will not be condoned .

With an elderly housing project (Colonial Terrace ) across
the street , small children (my grandchildren included) and a
four way intersection at the exact location, the traffic impact
and safety alone should forbid this illegal construction .

as it is of prime importance to me and my family .

Dear Mr. Monroe:
I wish to call your attention to an event that
occurred in our neighborhood concerning the vacant building
at the corners of Hanson,, Butler, and Nichols Streets. The
owner has been modifying this building and applied for a
variance several months ago. The Board of Appeals
application for a Butler-Nichols Street loading dock and
ramp experienced opposition on two occasions and was
withdrawn. Last Tuesday, June 5th, heavy equipment off-
loaded cinder blocks, pavement, and three truck loads of
gravel to shapeta ramp to fa new loading dock for which they
crosseglaecur edthsidewaIk0 aARPHIfed aforemennioeeapment
material to a grade about two feet higher than the street
grade, and the new ramp does not have a curb cut.
A member of your staff reported that a variance was
not required now because a ramp retaining wall was not
built. I request that you review this decision and advise
me.
The potential safety and traffic impact of this
building and ramp could have a dramatic effect and change
on our R-1 neighborhood.

A hearing on this petition was held January 17, 1990 and continued until
February 21 , 1990 with the following Board members present: James Fleming,

Petitioner is requesting a Special Permit permit to allow construction of a

January 17, 1990 to the first meeting in February, denied a request for further
continuance. The petitioner then requested leave to withdraw without prejudice.

A hearing on this petition was held October 15, 1986 with the following Board
Members present: James Hacker, Chairman; Messrs. , Fleming, Luzinski, Strout and
Associate Member Labrecaue. Notice of the hearing was sent to abutters and others
and notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioners, owners under agreement, are requesting Variances & Special Permit from
use and density requirements to allow existing factory building to be converted to
twenty two (22) residential units in this R-2 district.
The Variances which have been requested may be granted upon a finding of the Board
that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner; and
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogatinve from the
intent of the district or the purpose of the Ordinance.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this
Ordinance, the Board of Appeal may, in accordance with the
procedure and conditions set forth in Section VIII F and IX D,
grant Special Permits �,or alterations and reconstruction of
nonconforming structures, and for changes, enlargement, extension
or expansion of nonconforming lots, land, structures, and uses,
provided, however, that such change, extension, enlargement or
expansion shall not be substantially more detrimental than the
existing nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request._may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City's inhabitants.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . Several neighbors end abutters spoke in favor;
2. There was no opposition;

3. There will be adequate parking;
4 . The property cannot be developed for its allowed use because of
the existing building and the nonconformity and because of the
shape and rear of the existing land without substantial hardship;
5• The proposed plan will help alleviate problems with smells and
rodents by removing the business and replacing with residential.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the property involve
but do not generally affect the district;
2. Literal enforcement of the provisions of the Ordinance would involve a
substantial hardship to the petitioner;
3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance;
4. The granting of the relief requested will promote the public health, safety,
convenience and welfare of the City's inhabitants.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant Variances
and Special Permit requested for use, Height, side & rear setbacks, density, front
yard requirements to extend nonconforming structure to allow existing factory
building to be converted to twenty two (22) residential units within the same
footprint as the existing structure. Relief is granted under the following
terms and conditions:
1 . The proposed construction shall conform to all applicable provisions
of the Mass. State Building Code, Salem Fire Prevention Code, Salem
City Ordinances and MGL relative to fire safety;
2. Plans presented to Fire Prevention Bureau for approval prior to the
issuance of a Building Permit;
3. A building permit be obtained and a Certificate of Occupancy for
each unit be obtained;
4. All work to be done in accordance with plans of file.

As requested per our recent telephone conversation, the following
information is being supplied iso outli.nL3 the, basic requirements
of proposed correction of problem of disposal of flammable vapors
from spray booth areas at 12 Hanson Street , Salem, Mass .
1. The Salem Building Inspector shall be the authority having
,jurisdiction for issuance of a building permit to construct
an approved spray exhaust system.
2 . The Salem Fire Prevention Bureau, has the joint jurisdiction
for approval of plans, as the maintainence of the system to
be installed shall fall under the provisions of the Salem Fire
Code.
3 . It shall be standard practice to follow the following Sections
of the Mass . State Building Code for construction and eventual
use of the spray exhaust system:
a. Section 411.0, with specific notice taken of Section 411.4
and Section 401.0
b. Reference is made to the Mechanical Code (BOCA Basic Mechanical
Cod.e ) and using the 1981 edition as a basis for recommendations .
c . Recommendation is to follow the provisions of Section 310.0
of.' said BOCA Basic Mechanical Code (1981 edition) with
particular attention to Section N1310.3 (M310.3 .1 thru M310.3 .7 ) ;
Section 310.4 thru M310.6.3 ; Section 310.7 .1. ; Section 310.7.6;
Section 310.7.7 ; Section 310.8 (T,'1310.8 thru T4310.8.3 ) ; Section
14310.9; and I'2310.10.
d . It shall be noted that Section M310.10 refers to installation
in accordance with National Fire Protection Association
Standard #33 , which shall be followed.
4. As previously mentioned it is adviseable to clear all exhaust
work with the Massachusetts Division of Environmental Quality
Engineering, as the conditions currently existing and which
will exist after installation, are affected by their regulations .

I have been involved in the renovation project at 12 Hanson Street in Salem and
have made numerous site visits during various stages of the construction
process.
I last toured the renovated building on Wednesday, July 29th. At that time I
found the renovation to be virtually complete and to be in general compliance
with the construction documents, with the exception of the bathroom partitions
not yet complete.
I also found that, to the best of my knowledge, the building renovations are in
compliance with 780 CMR State Building Code.

Damage from Earthwork on Adjacent Property
Dear Mr. Potvin:
As requested, the undersigned made a limited visual inspection of the existing
building at the subject location this date. The purpose of the inspection was to
determine if structural damage had occurred due to recent earthwork on the
abutting 5 Nichols Street property.
Background
You explained that approximately two or three days ago, vegetation, soil and
rock removal occurred on the abutting property. The work has stopped as
directed by the City of Salem building inspector.
The 12 Hanson Street building is located at the corner of Nichols, Butler and
1 Hanson Streets. According to City of Salem records, the building was
constructed in approximately 1900. The building is two stories tall with a partial
roof deck. The building did not appear to have a basement.
Bass River Inc. remodeled the building in approximately 1998. Prior to that time
the building was used for commercial storage and industrial purposes. The
building appears to be a mix of timber, masonry and steel construction. The
exterior of the building has metal siding and trim.
Observations
The north side of the building is supported by a stone masonry and brick
foundation wall that bears on an existing ledge formation (see attached
photograph). The recent stripping of soil and vegetation, and rock removal by a
hydraulic hoe-ram, have disturbed and damaged the stone masonry building
foundation wall. Stones and mortar have been displaced by the recent work.
We visually examined the interior of the building near the area of the recent
earthwork. The building interior is generally finished with painted plaster with
wood trim and a tile acoustical ceiling. Flooring is a mixture of carpet and vinyl
floor coverings. No damage was apparent to these finishes.

On the northwest side of the building a chain-link fence and block retaining wall
exist which secure the property and support a driveway. The aforementioned
earthwork has caused the chain link fence and wall to rotate towards the
adjacent property, separating the wall from the pavement, and has caused
settlement of the driveway along the wall. The area has been cordoned-off due
to the instability (photograph attached).
Recommendations.
1. We recommend that no further site work occur on the adjacent property
until the damage to the existing building, wall, fence and driveway are
F restored and until plans prepared by a registered professional engineer
are presented demonstrating that such site work can be undertaken
without threatening further damage to the existing structures.

2. We recommend that the existing building foundation wall be repointed.
t The connection between the existing foundation wall and the ledge was
not apparent during our visual inspection. We recommend cleaning any
loose soil off the ledge as necessary, and pinning the foundation wall to
the ledge as necessary.
3. An existing clay pipe was apparent along the northeast side of the
building. The pipe was partially clogged with soil and partially broken.
We recommend investigating the purpose of this pipe and cleaning and
reparing the pipe as appropriate.
4. The existing fence and retaining wall should be removed and
reconstructed. Wall construction should be in accordance with wall
i manufacturer recommendations for the grade and driveway conditions.
5. Continue to inspect the failed retaining wall and pavement area. Maintain
barricades to prevent access to the area.
