We contacted the owner of the property who was unaware of any previous business activity. The property manager inspected the site and was unable to find any evidence of business activity. The owner has promised to continue to monitor the property and, should business activity occur, to see that such activity is stopped. It appears that the type of business you described is not ongoing but rather undertaken at irregular occasions. MASSACHUSETTS 01970 • 508/745-9595 • FAX 508/744-9327 Leo Jodoin 8 Hanson Street Salem, Ma 01970 November 26, 2002 Thomas St. Pierre Acting Building Inspector In accordance with Massachusetts General Laws, Chapter 40A, Section 7-1, I am hereby requesting that an enforcement action be taken against the owner of 6 Nichols Street for violations of the conditions of his special permit granted on September 30, 1992. The owner of the property which is located in an R-2 district was granted a special permit to change the use of the property from a machine shop to an environmental testing laboratory only. I do not disagree with the current use but I believe he is in violation of the subject conditions of his permit as follows: 1. The basement level is being used and rented to others for storage and not limited to the environmental testing. 2. No special permits have been granted for any further use of the building. 3. Commercial storage vehicles are being stored on the lot and these vehicles are not part of the permitted business. 4. The City of Salem is losing valuable tax revenue by the owner of 6 Nichols Street allowing other commercial vehicles and businesses to use this building]property and the owner receiving rents for those users. 5. The City Health Department needs to step up it's enforcement efforts and conduct the fequired semi-annual inspections and file the results. In reference to your letter dated November 5, 2001 concerning Section 7.1 Trailers. The R-2 District specifically excluded the storage of commercial motor vehicles in the district and that section 5-1.0 A 80 prohibits the storage unless the use is permitted for the building in the district. Also, if you refer to the definitions in Section 2-2 trailers are clearly defined and this definition applies to 7-1. Therefore I am requesting that you take the enforcement action needed to bring this property into compliance.
