Dear Mr. DeSousa,
This Department has received a complaint regarding the number of units at this property. City
building records indicate that there should be two units. A recent inspection by the Salem Board
of Health showed a third unit with only one egress. Apparently this issue was brought up in a
violation sent letter to you from this department in July of 2005.There is no follow up
information in the file.
Therefore, under the authority of the Mass State Building Code 780 section 115.6 an inspection
of the property is required. You are directed to contact this office within 10 days of receipt of
this letter. Failure to respond will result in Municipal code tickets as well as further enforcement
actions. If you feel you are aggrieved by the Building Code matter, your Appeal is to the Board
of Buildings, Regulations and Standards in Boston. If you have any questions, please contact me

The above referenced property has come to the attention of this department for the
following reason(s):
Complaints about the number of units and number of tenants at this property.
Under the provisions of 780 CMR, Section 115.6, State Building Code, access to this
property must be granted for the purposes of inspection. Please call this office upon
receipt of this letter to schedule this required inspection. If this property has rental units,
these tenants must be notified in advance of this inspection, so that access to these spaces
may also be accomplished.
This inspection must be completed on or before August 11, 2005; failure to respond to
this notification will be construed as non-compliance, and as such an Administrative
Search Warrant will be sought, so as to allow the lawful inspection of this property.

Dear Mr. DeSouza
This office, after receiving a complaint and after a site visit, has determined that a third unit
exists at the property. This Department made a determination in September of 2003 that the
building was a two unit building. The third unit has only one means of egress and there is no
record of a building permit as required by 780 C.M.R section 11 land there is no record of the
required relief that would have been needed from the Salem Zoning Board of Appeals.
Therefore , you are directed to cease and desist using the third floor unit. You are further ordered
to submit a plan within 30 days outlining your plans to bring the building into compliance with
all applicable laws and codes. Failure to address this problem will result in Municipal fines and
further enforcement actions. If you feel you are aggrieved by the Building code portion of this
order, your Appeal is to the Board of Buildings, Regulations and Standards in Boston. If you feel
you are aggrieved by the Zoning interpretation, your Appeal is to the Salem Zoning Board of
Appeals
