This office, after receiving a complaint and after a site visit, has determined that a third unit
exists at the property. This Department made a determination in September of 2003 that the
building was a two unit building. The third unit has only one means of egress and there is no
record of a building permit as required by 780 C.M.R section l l land there is no record of the
required relief that would have been needed from the Salem Zoning Board of Appeals.
Therefore , you are directed to cease and desist using the third floor unit. You are further ordered
to submit a plan within 30 days outlining your plans to bring the building into compliance with
all applicable laws and codes. Failure to address this problem will result in Municipal fines and
further enforcement actions. If you feel you are aggrieved by the Building code portion of this
order, your Appeal is to the Board of Buildings, Regulations and Standards in Boston. If you feel
you are aggrieved by the Zoning interpretation, your Appeal is to the Salem Zoning Board of
Appeals

A POWER STRIP EXTENSION CORD WAS TAPED TO THE TOP OF THE,
SECOND FLOOR SINK. PLEASE REMOVE AND ADD A PERMANENTLY
INSTALLED OUTLET ON COUNTER IF NEEDED.
EXISTING ROMEX CABLE IN FRONT HALLWAY SHOULD BE PROTECTED A
MINIUM OF 6 IN. ABOVE THE FLOOR AND THE LOOSE SWITCH BOX SHOULD
BE.REPAIRE'.D THAT OPERATES THE HALLWAY LIGHTS.
AT THE BASEMENT OUTDOOR ENTRANCE,AN INDOOR LIGHT FIXTURE IS
HANGING OUTDOORS AND AN OUTDOOR RECEPTACLE COVER IS BROKEN,

Our Department's recent inspection on June 24, 2015 in conjunction with the Salem Health
Department of the above referenced property revealed that the second and third floor unit is
currently being operated as a rooming house in a Residential District (See Regulations
below).
The following actions are required immediately to brine the property into compliance
with the City of Salem Zoning Ordinances:
1. Provide a signed and notarized affidavit stating the individuals and their
relationships that will be residing in the 2nd and 3'd Jloor apartment prior to this
department issuing any permits for this unit.
2. Cease and Desist immediately the use of the property as an illegal rooming house.
Rooming House Regulations(from Salem Zoning Ordinance)
3. Rooming Houses are not allowed anywhere in the City except in B1 and B2 Zones.
(Seepage 6 of City of Salem Zoning Ordinances)
4. Two-family or Multi family dwelling units are defined on page 83 of the City of
Salem Zoning Ordinances) . A landlord cannot rent a dwelling unit to more than 3
unrelated people or to any number ofpeople not "living together as a single non-
profit housekeeping unit"

operation of two illegal lodging houses at the following locations:
'1. 229 Hancock St Alleged to be leasing four rooms on each of
two floors-for$85-to $90 per week. The property owner is Marj
�w Mc Master. If the allegation proves true, the property is in
violation of MGL Chapter 148, Section 26G (no system of automatic
sprinklers), and Chapter 140, Section 22 (Lodging House Statute).
2. 335 Lafayette Street. Alleged to be leasing rooms as single room
occupancies in violation-of the above referenced statutes. The

establishment below on the street level.

A hearing on this petition was held July 19, 1989 with the following Board
Members present: James Fleming, Chairman; Messrs. , Bencal, Febonio, Luzinski
and Nutting. Notice of the hearing was sent to abutters and others and notices
of the hearing were properly published in the Salem Evening News in accordance
with Massachusetts General Laws Chapter 40A.
The petitioner, owner of the property, represented by Attorney Robert Ledoux,
is requesting a Variance to allow an existing deck in this R-2 district.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district.
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented and
after viewing the plans, makes the following findings of fact:
1 . Neighbors and abutters spoke in favor.
2. There was no opposition.
3. Due to infirmity, the petitioner is largely housebound, as shown in
correspondence from Dr. Richard Alexander, and this deck would allow
her access to fresh air.
4. This is the most feasible location for the deck.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property, but
not the district generally;
2. Literal enforcement of the Ordinance would work a substantial hardship on
the petitioner;
3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.

As you may know, I have been contacted by a neighbor on Hancock Street who is upset with the
driveway opening/curb-cut the owner of 29 Hancock Street constructed. As you may recall, this
opening was constructed without the benefit of any city permits. It made parking more difficult
on the street. I brought this issue to your collective attention and the City re-installed the curb
cut. I have recently received another complaint that the curb-cut was not installed properly and
that the owner is still parking over the sidewalk. I think the best way to try and bring some
resolution to this issue is to meet on the site to review the circumstances of the curb cut. Can
