Dear Mr. McGrath:
I am writing this letter to verify that the details that you and Mike Shea and I have
discussed for fire protection in the existing basement of 1 Hamilton Street are
adequate to meet the constraints of 780 CMR for required fire separation from
abutting uses.
The details discussed are as follows:
• The washer dryer area, consisting of one residential washer and one
residential dryer shall be protected by the installation of 1 4'x8' layer of
5/8" firecode sheetrock affixed to the ceiling per UL Design L501, and
centered over the machine location.
• The approximately 16'x16' storage room located in the right rear corner of
the basement (South East) when facing the building from Hamilton Street
will have a 5/8" firecode sheetrock ceiling installed per UL Design L501.
• The water heaters shall be enclosed in the existing fully sheet-rocked
(ceiling and walls) room behind the new furnace unit.

Dear Tom:
I am writing this letter regarding my findings on fire protection requirements for
the basement of 1 Hamilton Street. The building is a type 3B bearing masonry
exterior wall building with a wood framed interior structure. It is fully sprinklered
throughout in conformance with NFPA 13 for residential structures. It's use is
residential R-2. There are 3 single floor residential units in the building on floors
1, 2, and 3 successively with two means of egress leading to two remote
stairwells from each unit. Between the units are 1 hour rated floors as required
for dwelling unit separations by table 602.
A question has been raised on the requirement for sheetrock on the ceiling of the
basement structure. In table 602, there is a 0 hour rating required for floor
construction as long as it is not separating any dwelling units. There will be a
non-habitable area directly below Unit 1 on the first floor that will be for storage
and laundry use by the first floor unit. Based on table 602 and the fact that the
first floor structure does not demark a tenant separation, my reading is that it is
not required to install sheetrock on the basement ceiling. The fact that the
basement is fully sprinklered also adds an important life safety component to the
condition.

10. Several residents including David Williams (342 Essex Street), Pamela Jendrysik (3
Hamilton Street), William Goldberg (8 Botts Court), the former Mayor of Salcm, Stanley
Usovicz Jr. (2 Botts Court), David Decker(8 Hamilton Street), and Ward 3 Councillor
,lean Pelletier, spoke in favor of the proposal.
I I. Nina Cohen (22 Chestnut Street) spoke against the request spoke of the other options the
owner might choose for the structure.
The Board of Appeal, after careful consideration of the evidence presented at the public hearing,
and atter thorough review of the plans and petition submitted, makes the following findings:
I. Changing the ten ( 10) unit rooming house to a three (3) unit residence would not be
substantially more detrimental than the existing nonconforming use to the neighborhood.
2. Conditions relating to the layout of the parking and structures on the lot do no generally
affect the zoning district in general, and would allow for tandem parking in this location.
3. A literal application of the Ordinance would result in fewer parking spaces on site and
therefore cause substantial hardship to both the applicant and to the neighborhood.
4. Desirable relief may be ,ranted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent or purpose of the
Ordinance.
On the basis of the above findings of fact and all evidence presented at the public hearing
including, but not limited to, the Plans, DOCUmen1S and testimony, the Zoning Board of Appcals
concludes:

7. Petitioner shall obtain street numbering from the City of Salem Assessor's office and
shall display said number so as to be visible front the street.
8. Petitioner is to obtain approval from any City Board or Commission having jurisdiction
including, but not limited to, the Planning Board.
9. Except for the demolition authorized by the Salem Historic Commission, any zoning
relief granted does not empower or authorize the Petitioner to demolish or reconstruct the
structurc(s) located on the subject property to an extent of more than fifty percent (50'%,)
of its floor area or more than fitly percent (50'%,) of its replacement cost at the timeof
destruction. If the structure is demolished by any means to an extent of more than fifty
percent (50,"O Of its replaccmentcost or more than fifty percent (50'Yo) of its floor area at
the time of destruction, it shall not be reconstructed except in conformity with the
provisions ofthe Ordinance.

A hearing on this petition was held on January 19, 2005 with the following Board
Members present:Nina Cohen, Chairman,Richard Dionne, Edward Moriarty and Nyyen
Pinto. Notice of the hearing was sent to abutters and others and notices of the hearing
were properly_published in the Salem-Evening_News-in..accordance with Massachusetts
General Laws Chapter 40A.
Petitioner is requesting a Special Permit to convert Rooming House to a three unit
residence and a Variance from parking for the property located at 1 Hamilton Street
located in an R-2 Zone.
The provision of the Salem Zoning Ordinance which is applicable to this request for a
Special Permit is Section 5-3 0),which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board of
Appeal may,in accordance with the procedure and conditions set forth in Sections 8-6
and 9-4, grant Special Permits for alterations and reconstruction of nonconforming
structures, and for changes, enlargement, extension or expansion of nonconforming lots,
land, structures, and uses,provided,however,that such change, extension, enlargement
or expansion shall not be substantially more detrimental than the existing nonconforming
use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests, guided by
the rule that a Special Permit request may be granted upon a finding by the Board that the
grant of the Special-Permit will-promote-the public health,safety, convenience and
welfare of the City's inhabitants.
The Board of Appeal,after careful consideration of the evidence presented at the hearing
and after reviewing the plans,makes the following findings of fact:
1. Petitioner Michael Shea sought a special permit pursuant to Section 8-5 of the Salem
Zoning Ordinance to convert the property at 1 Hamilton Street from an existing non-
conforming use as a ten-unit boarding house to a non-conforming use as a three-
family residence. Petitioner reported he has entered a purchase and sale agreement
with the property owner Orille L'Heureux.
2. Petitioner seeks a variance from parking requirements of the ordinance to allow
of six cars without separate access. Under the proposed plan, a small lot adjacent to

the building would house six parking places. Three of these parking places would be
aligned front to back against the rear property line, and three more spaces would be
lined up behind them, so that the rear spaces are accessible to residents only if the
front spaces are emptied. Under this plan,residents would coordinate to get six cars
off the street at once,which is not permitted under the Salem Zoning Ordinance.
3. Due to illness,only four members of the Zoning Board of Appeal were in attendance.
One-member,-Nina Cohen owns.property-within 300 ft.of the subject_property. Mr.
Shea's legal representative,George Atkins Jr. Esq., drafted a waiver of any objection
to the participation of Ms. Cohen in discussion and voting on this petition,which was
immediately executed by petitioner and delivered to the Board's secretary.
4. Petitioner's plan makes little exterior alteration to the existing building,which was
built sometime in the 1830s or 1840s in the Greek Revival style. Architectural
drawings submitted by petitioner, created by Richard W. Grimm, show that petitioner
plans to include a two-bedroom unit on the fust floor and two two-bedroom units on
the third and fourth floors. An existing side porch would be replaced with a smaller
deck leading to the parking area
5.Mr. Shea submitted an alternate parking plan, in which four cars may be parked
diagonally in the lot,which was rejected by residents who spoke of concern
about the lack of parking to accommodate the needs of the neighborhood.Mr. Shea
also agreed to attempt to use a permeable surface on the parking area to mitigate
water runoff to the street.
6. Mr. Shea's proposal had the support of four neighbors, including abutters Richard&
Pam Jendrysik of 7 Hamilton St., George Osgood of 352 Essex St. and Charles
Hinchey,speaking for Bessie Hinehey-o€335Essex Street:
7. Speaking in opposition to the proposal were David and Sharon Williams of 342 Essex
Street,who expressed concern about increased density of use in the two-family district
and with the difficulty of parking in the environs. Also speaking in opposition was
Tim Jenkins of 343 Essex St.,who opposed increasing density in the district and
noted that the boarding house was well run and had little negative impact on the
surrounding single family homes.
8. The proposed parking of six can;on petitioner's lot seemed on balance to create a
substantial detriment to the public good not warranted by the proposal to convert
the existing nonconforming use to another use not permitted in the district.

On the basis of the above findings of fact,and on the evidence presented,the Board of
Appeal concludes as follows:
1. The Special Permit requested cannot be granted without substantial detriment to
the public good or without nullifying and substantially derogating from the intent
of the district or the purpose of the ordinance.
2_ The granting-of the Special Permit requested will not-be in harmony with the
neighborhood and will not promote the public health, safety, convenience and
welfare of the City's inhabitants.
Therefore,the Zoning Board of Appeal voted 3 in favor and 1 in opposition to the motion
to grant the relief requested. Having failed to garner the four affirmative votes required
to pass,the motion to grant fails and the petition for a Special Permit is denied.

Legal Remedies for Tenants of Residential Housing
The following is a brief summary of some of the legal remedies tenants may use in order to get
housing code violations corrected :
1. Rent Withholding(Massachusetts General Laws, Chapter 239, section 8A): If Code Violations Are Not
Being Corrected you may be entitled to hold back your rent payments. You can do this without being evicted if:
You can prove that your dwelling unit or common areas contain code violations which are serious
enough to endanger or materially impair your health of safety and that your landlord knew about the
violations before you were behind in your rent.
You did not cause the violations and they can be repaired while you continue to live in the
building.
You are prepared to pay any portion of the rent into court if a judge orders you to pay it. ( For this,
it is best to put the rent money aside in a safe place)
2. Repair and Deduct(Massachusetts General Laws, Chapter III, section 127L): The law sometimes allows
you to use your rent money to make the repairs yourself. If your local code enforcement agency certifies that
there are code violations which may endanger or materially impair your health, safety, or well-being, and
your landlord has received written notice of the violations, you may be able to use this remedy. If the owner
fails to begin necessary repairs (or to enter into a written contract to have them made) within five days after
the notice or to complete repairs within 14 days after notice, you can use up to four months rent in any year
to make repairs.
3. Retaliatory Rent Increases or Evictions Prohibited (Massachusetts General Laws, Chapter 186, section
18,and Chapter 239, Section 2A): The owner may not increase your rent or evict you in retaliation for
making a complaint to your local code enforcement agency about code violations. If the owner raises your
rent to try to evict within six months after you have made the complaint, he or she will have to show a good
reason for the increase or eviction which is unrelated to your complaint. You may be able to sue the landlord
for damages or if he or she tries this.
4. Rent Receivership (Massachusetts General Laws Chapter II, section 127 C-H): The occupants and/or the
Board of Health may petition the District or Superior Court to allow rent to be paid into court rather than to
the owner. The court may then appoint a"receiver" who may spend as much of the rent money as is needed
to correct the violation. The receiver is not subject to a spending limitation of four months'rent.
5. Breach of Warranty of Habitability: You may be entitled to sue your landlord to have all or some of your
rent returned if your dwelling unit does not meet minimum standards of habitability.
6. Unfair & Deceptive Practices (Massachusetts General Laws, Chapter 93A) : Renting an apartment with
code violations is a violation of the consumer protection act and regulations, for which you may sue an
owner.

Dear Board Members:
This is a letter to correct the number of units for 1 Hamilton Street, which is owned by
Orille L'Heureux.
Our records clearly state 10 rooms for this address and our Assessors Office shows the
same.
On December 4, 2001, I did an inspection of 1 Hamilton Street and found the units to be
some of the better one I inspect in the City every year.
The Building Department does not have a problem with the Board to correct Orilles
number of rooms to 10.
