DECISION ON-THE PETITION OF SPIROS P. FLOMP FOR VARIANCE AT

A hearing on this petition was held October 20, 1993 with the following
Board Members present: Francis X. Grealish, Chairman; George Ahmed,
Stephen Touchette and Associate Member Arthur Labrecque. Notice of the
hearing was sent to abutters and others and notices of the hearing were
properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, is requesting a Variance to allow
portion of the building to used for auto sales, repair, and body work.
Property is located in the Business Park Development District.
The Variance which has been requested may be granted upon a finding by this
Board that:
1. Special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally affecting
other lands, buildings and structures involved.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the petitioner.
3. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented
at the hearing, and after viewing the plans, makes the following findings
of fact:
1. There was no opposition to the proposed request.
2. The petitioner purchased the property in January of 1988 when the area
was zoned Industrial (I) .
3. There are several businesses on the premises, including a towing
company.
4. There are similar businesses in the area.

On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Board of Appeal concludes as follows:
1. Special conditions exist which especially affect the subject property
but not the district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously, 4-0, to grant the
variance requested, subject to the following conditions:
1. Petitioner shall comply with all city and state statutes, ordinances,
codes and regulations.
2. Petitioner shall comply with all requirements of the Salem Fire
Department relative to smoke and fire safety.
3. Petitioner/Lessee/Tenant shall be required to obtain all proper
licenses/permits from all city departments, including, but not limited
the Licensing Board.

LOCATED IN AN R-2 RESIDENTIAL DISTRICT
A hearing on tris pe .ition vas held on August 31, 1.978 with members Jane T.
Lundregan, Douglas Hooper, Arthur Labrecque and James Boulger present. Notices
were sent to abutters and others and duly published in the Salem Evening News in
accordance with Mass. Ceneral Lairs. Chapter 808.
Mr. Paul Kostopoulos is requesting a Special Pt =,it to change the use of a
non-conforming industrial building located at 5' Greve Street (R-2 District) to
another non-conforming use, and a variance on the southerly sideline in order to
add a loading platform which would be 1.5 ft. from the property. line. Atty.
Harry Ankeles, 27 Lowell Street, Peabody, Mass. represented the Petitioner stat-
ing, the property located at 57 Grove St. was used formerly by a chemical. plant,
Pohl Chemical Co. which has since moved its operation to Netr Jersey and before
that the property was occupied by walnut Leather Finishers. The Petitioner wishes
to operate a trimming leather business on this site. It is a dry type operation
and no chemicals will be used. The Petitioner stated that the operation is free
of odor and no chemicals will go into the sewage system. The material will be
received on pallets and shipped out again after trimming. The business will employ
nine employees at the start and possibly reach fifteen at a later date. Two trucks
will be used by the company on a daily basis and there will. be traffic in and out
of the property totalling one hour a day. There is ample parking on the site.
There is a natural barrier between the. building and the residential area. .
Although the locus is within an R-.2 Zone, there are several business in the area
and abutting the site.
The Petitioner is also requesting a variance from the sideline requirements in
order to construct a ramp 20 £t. x 4 ft. high to serve the building.
The Board voted to grant the Special Permit and Variance requested with the
condition that the property will be used for trimming the leather splits only;
the parking area will be paved; no chemicals of any sort will enter the sewage
system; and the property will be kept clean at all times.
The Board found that the Special Permit requested would not be detrimental
to the surrounding neighborhood. The Board found that the proposed use as a.
leather trimming factory is equally appropriate or more appropriate to the area

than the former use of the building as a chemical company.
The Board also found that the building in question is an old building
that is suitable for industrial use only and not suitable to be used for resi-
dential purposes.
The Board found that to deny the variance requested for a ramp of 1.5 ft.
from the property line would cause a hardship to the Petitioner. The. ramp will
,be away from the residential area and will in no way encroach on the .abutting
residential zone.

non-conforming ind, =trial building located at 57 -Grove Street (I2-2 District) to

add a loading platform which would be 1.5 ft. from the property. line. Atty.
Harry Ankeles, 27 Lowell Street, Peabody, Mass. represented the Petitioner stat=
ing, the property located at 57 Grove St. was used formerly by a chemical- plant,
Pohl Chemicjl Co. which has since moved its operation to New Jersey and before
that the property was occupied by Walnut Leather Finishers. 'Die Petitioner wishes
to operate a trimming leather business on this site. It is a dry type operation
and no chemicals will be used. The Petitioner stated that the operation is free
of odor and no chemicals will go :into the seuvage system. The material will be
received on pallets and shipped out again after trimming. The business will employ
nine: employees at the start and possibly reach fifteen at a later date. Two tricks
will be used by the company on a daily basis and there will. be traffic in and out
of the property totalling one hour a day. There is ample parking on the site.
There is a natural barrier between the building and the residential area.
Although the locus is within an R,2 Zone, there are several business in the area
and abutting the site.
The Petitioner is also requesting a variance from the sideline requirements in
order to construct a ramp 20 £t. x 4 ft. high to serve the building.
The Board voted to grant the Special Permit and Variance requested with the
condition that the property will be used for trinuning the leather splits only;
the parking area will be paved; no chemicals of any sort will enter the sewage
system; and the property will. be kept clean at all times.
The Board found that the Special Permit requested would not be detrimental
to the surrounding neighborhood. T'he Board found that the proposed use as a
leather tri.mming factory is equally appropriate or more appropriate to the area

than the former use of the building as a chemical company.
The Board also found that the building in question is an old building
that is suitable for industrial use only and not suitable to be used for resi-
dential purposes.
The Board found that to deny the variance requested for a, ramp of 1.5 ft.
from the prUperty line would cause a hardship to the Petitioner. The, ramp will
be away from the residential area and will in no, way encroach on the .abutting
residential zone.

Previously,I met with you at your above mentioned property.
At that meeting, we discussed the fact that stockpiling of earth is not an allowed use in a
Business.Park Development zone lot.
At that time,you agreed to begin removing the earth materials and the old truck.
Neither has happened and it would appear that more dirt has been added to the pile.
You are directed to remove the dirt and fill material within 30 days. Failure to comply
with this order will result in municipal code tickets being issued and a complaint being
filed in Salem District Court.
